| In order to maintain the courtroom security, regulate the trial order, guarantee the procedural rights of litigation participants, provide convenience for the public to observe the trial, promote judicial justice, and demonstrate the powers of judicial authority, the Supreme People's Court hereby decides to amend the Court Rules of the People's Courts of the People's Republic of China as follows in accordance with the Law of the People's Republic of China on the Organization of the People's Courts, the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China, and other relevant laws and in light of the trial practice: | | 为了维护法庭安全，规范庭审秩序，保障诉讼参与人诉讼权利，方便公众旁听，促进司法公正，彰显司法权威，根据《中华人民共和国人民法院组织法》《中华人民共和国刑事诉讼法》《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》等有关法律规定，结合审判实际，现决定对《中华人民共和国人民法院法庭规则》作如下修改： |
| I. Article 1 is amended to read: “In order to maintain the courtroom security and order, guarantee the normal trial activities, ensure that litigation participants exercise their procedural rights according to the law, provide convenience for the public to observe in the trial, promote judicial justice, and demonstrate the powers of judicial authority, these Rules are formulated in accordance with the Law of the People's Republic of China on the Organization of the People's Courts, the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China, and other relevant laws.” | | 一、将第一条修改为：“为了维护法庭安全和秩序，保障庭审活动正常进行，保障诉讼参与人依法行使诉讼权利，方便公众旁听，促进司法公正，彰显司法权威，根据《中华人民共和国人民法院组织法》《中华人民共和国刑事诉讼法》《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》等有关法律规定，制定本规则。” |
| II. Article 2 is deleted and the relevant content is adjusted to Article 17 and Article 21. | | 二、删除第二条，将相关内容调整到第十七条、第二十一条。 |
| III. Article 3 is renumbered as Article 2 and amended to read: “The courtroom is a special place where the people's court tries various cases on behalf of the state according to the law.” | | 三、将第三条改为第二条，修改为：“法庭是人民法院代表国家依法审判各类案件的专门场所。” |
| “The national emblem shall be hung on the front side of the courtroom.” | | “法庭正面上方应当悬挂国徽。” |

Article 4 is renumbered as Article 12 and amended to read: “The personnel that appear in court for performing duties shall wear clothes as required by the professional dress codes; however, under any of the following circumstances, they shall wear formal clothes: | | 四、将第四条改为第十二条，修改为：“出庭履行职务的人员，按照职业着装规定着装。但是，具有下列情形之一的，着正装： |
| (1) There is no professional dress code. | | （一）没有职业着装规定； |
| (2) The investigation personnel appear in court to testify. | | （二）侦查人员出庭作证； |
| (2) The entity with which the personnel work is a party involved in the case. | | （三）所在单位系案件当事人。 |
| Persons appearing in court not for performing duties and persons observing the trial shall wear clothes in a decent manner.” | | 非履行职务的出庭人员及旁听人员，应当文明着装。” |
V. Article 5 is renumbered as Article 15 and amended to read: “All the persons shall stand up when the judges enter the courtroom and when the presiding judge or sole judge pronounces the judgment, ruling, or decision.”
