《环境保护主管部门实施限制生产、停产整治办法》已于2014年12月15日由环境保护部部务会议审议通过，现予公布，自2015年1月1日起施行。

环境保护主管部门实施限制生产、停产整治办法

第一章　总　则

　　第一条　为规范实施限制生产、停产整治措施，依据《中华人民共和国环境保护法》，制定本办法。
　　第二条　县级以上环境保护主管部门对超过污染物排放标准或者超过重点污染物排放总量控制指标排放污染物的企业事业单位和其他生产经营者（以下称排污者），责令采取限制生产、停产整治措施的，适用本办法。
　　第三条　环境保护主管部门作出限制生产、停产整治决定时，应当责令排污者改正或者限期改正违法行为，并依法实施行政处罚。
　　第四条　环境保护主管部门实施限制生产、停产整治的，应当依法向社会公开限制生产、停产整治决定，限制生产延期情况和解除限制生产、停产整治的日期等相关信息。

第二章　适用范围

　　第五条　排污者超过污染物排放标准或者超过重点污染物日最高允许排放总量控制指标的，环境保护主管部门可以责令其采取限制生产措施。
　　第六条　排污者有下列情形之一的，环境保护主管部门可以责令其采取停产整治措施：
（一）通过暗管、渗井、渗坑、灌注或者篡改、伪造监测数据，或者不正常运行防治污染设施等逃避监管的方式排放污染物，超过污染物排放标准的；
（二）非法排放含重金属、持久性有机污染物等严重危害环境、损害人体健康的污染物超过污染物排放标准三倍以上的；
（三）超过重点污染物排放总量年度控制指标排放污染物的；
（四） 被责令限制生产后仍然超过污染物排放标准排放污染物的；
（五）因突发事件造成污染物排放超过排放标准或者重点污染物排放总量控制指标的；
（六）法律、法规规定的其他情形。
　　第七条　具备下列情形之一的排污者，超过污染物排放标准或者超过重点污染物排放总量控制指标排放污染物的，环境保护主管部门应当按照有关环境保护法律法规予以处罚，可以不予实施停产整治：
（一）城镇污水处理、垃圾处理、危险废物处置等公共设施的运营单位；
（二）生产经营业务涉及基本民生、公共利益的；
