| Your Letter Requesting Opinions on the Joinder of a Fine on a Defendant Convicted of a New Crime before the Completion of Execution of a Prior Fine on the Defendant and the Remainder of the Prior Fine (No. 281 [2017], General Office of the Supreme People's Procuratorate) has been received. Upon discussions, the following reply is hereby provided: | | 你厅《关于对被告人在罚金刑执行完毕前又犯新罪的罚金应否与未执行完毕的罚金适用数罪并罚问题征求意见的函》（高检办字[2017]281号）收悉。经研究，答复如下： |
In Article 71 of the Criminal Law, “completion of execution of a penalty” means the completion of execution of a principal penalty. If the execution of the principal penalty on the defendant has been completed but the execution of an accessory fine on the defendant has not been completed, in accordance with Article 53 of the Criminal Law, whenever the people's court discovers any property available for execution of the fine, it shall recover the fine. Therefore, where the execution of the principal penalty on a defendant for a prior crime has been completed but the execution of an accessory fine on the defendant has not been completed, the people's court shall continue to execute the remainder of the fine, and it is unnecessary to apply the joinder of penalties for plural crimes to the fine imposed for a new crime.
．．．．．． | | 刑法第七十一条中的“刑罚执行完毕以前”应是指主刑执行完毕以前。如果被告人主刑已执行完毕，只是罚金尚未执行完毕的，根据刑法第五十三条的规定，人民法院在任何时候发现有可以执行的财产，应当随时追缴。因此，被告人前罪主刑已执行完毕，罚金尚未执行完毕的，应当由人民法院继续执行尚未执行完毕的罚金，不必与新罪判处的罚金数罪并罚。
