| | （一）基本案情 |
| | 贵阳市乌当区定扒造纸厂（以下简称定扒纸厂）自2003年起经常将生产废水偷偷排入南明河或超标排放锅炉废气，多次受到当地环境保护行政主管部门处罚。但该纸厂仍采取夜间偷排的方式逃避监管，向南明河排放污水。中华环保联合会、贵阳公众环境教育中心提起诉讼，请求判令定扒纸厂立即停排污水，消除危险并支付原告支出的合理费用。贵州省清镇市人民法院（以下简称清镇法院）受理案件的同时，即依原告申请采取了拍照、取样等证据保全措施，固定了证据，并裁定责令定扒纸厂立即停止排污。经法院委托贵阳市环境中心监测站对定扒纸厂排放的废水取样检测，废水中氨氮含量等指标均严重超过国家允许的排放标准，其排污口下游的南明河水属劣五类水质。经原告申请，法院协调由贵阳市两湖一库基金会从环境公益诉讼援助基金中先行垫付上述检测费用。清镇法院确定由一名审判员和两名环保专家担任人民陪审员共同组成合议庭。审理过程中，合议庭充分发挥专家作用，召开专家咨询委员会会议对被告的排污行为进行论证，依法采信了专家意见。该院还针对其他几家纸厂排污行为提出由环境保护行政主管部门对这些纸厂进行查处的司法建议，将南明河的污染问题一并解决。 |
