| | 吉林太阳城有限公司(以下简称太阳城公司)因与刘淑艳房屋租赁纠纷诉至法院。案件审理期间，太阳城公司强行将出租给刘淑艳使用经营的房屋上锁，致使刘淑艳无法对该房屋占有、使用。长春市中级人民法院(以下简称长春中院)审理并作出终审判决，判令双方租赁合同终止，刘淑艳给付太阳城公司各项费用10959．40元，太阳城公司退还相关费用19500元，刘淑艳立即将太阳城美食广场房屋内物品自行拉走。案件执行期间，宽城区人民法院(以下简称宽城区法院)裁定“被执行人刘淑艳立即将太阳城美食广场房屋中的物品拉走”，并作出“长春市宽城区人民法院公告”，上述裁定及通知送达刘淑艳本人。刘淑艳拒不执行，宽城区法院对其强制执行并制作了执行笔录及物品清单。执行时，被执行人刘淑艳未在场，太阳城美食广场李玉梅等10名工人在场。宽城区法院将执行的财物交太阳城公司保管。后宽城区法院向刘淑艳之母杜雅珍送达搬走物品通知书。同日，杜雅珍向宽城区法院出具了收到14248．60元的收条。 |
| | 嗣后，经刘淑艳申诉，长春中院作出再审民事判决，判决维持解除合同及部分赔偿项目；同时以太阳城公司强行将出租给刘淑艳使用经营的房屋上锁，违约行为造成刘淑艳损失为由，判决太阳城公司返还刘淑艳清单所列的156项财产，如不能返还，赔偿损失128116元，赔偿利润损失114752．64元；上述款项相抵后，太阳城公司给付刘淑艳290970．02元。案件现已执行到位并终结。 |
