Plaintiff Qinghai Branch of the Bank of China (hereinafter referred to as Qinghai Branch) initiated a lawsuit in the Chengdong District People's Court of Xining, Qinghai Province because of the disputes between it and defendant Liang Guozhi (hereinafter referred to as Liang) over credit card overdrafts. During the process of litigation, Liang lodged a counterclaim.@#
The plaintiff stated that the personnel of Qinghai Branch, for several times, urged Liang to repay his card overdrafts of consumption, but Liang refused to bear the liability for repayment, thus Qinghai Branch pleaded with the court to order Liang to repay the overdrafts and pay the penalty interest of 3, 331.37 yuan in total.@#

原告中国银行青海省分行(以下简称青海中行)因与被告梁国治发生返还信用卡透支款纠纷,向青海省西宁市城东区人民法院提起诉讼。诉讼中,梁国治提起反诉。@#
原告诉称:被告梁国治持卡消费透支,我行工作人员多次督促其还款,其拒不承担还款责任。请求判令被告梁国治返还透支款及罚息计人民币3331.37元。@#
被告辩称:我们夫妻都是退休职工,不需要什么信用卡。由于原告青海中行施加压力,我妻的工作单位才让我妻在申领表上签字领取了长城信用卡,否则不能领工资。1999年1月1日,我在兰州市七里河被犯罪分子抢劫,身份证和长城信用卡附卡被抢走。1月2日,我妻通过电话口头向青海中行挂失。信用卡透支都是我离开兰州以后在兰州亚欧商场发生的,肯定不是我所为。长城卡被抢后我们立即挂失,但没有引起青海中行的高度重视,以致犯罪分子直到1月5号还在消费,共消费了10笔之多。青海中行如果尽职,犯罪分子到亚欧商场消费时肯定会被抓住。因此,长城信用卡透支是青海中行失职的结果,与我无关,不应由我承担责任。再者,长城信用卡的使用规定中有必须凭信用卡和本人有效证件才可以使用长城信用卡消费的规定。别人凭我的身份证持我的卡消费,兰州亚欧商场竟然没有拒绝,是有责任的。青海中行应当让兰州亚欧商场承担透支责任。反诉称,为长城信用卡被抢透支一事,原告青海中行扣了我们的入账工资,还让我误工三天和他们去兰州抓犯罪分子。青海中行应当返还扣我们的工资和赔偿我的误工损失共计2590元。@#
西宁市城东区人民法院经审理查明:@#
1997年10月27日,被告梁国治之妻赵先华与原工作单位青海省冶金金属进出口公司的其他职工一起,经原告青海中行办理了中国银行发行的长城信用卡。主卡持有人为赵先华,副卡持有人为梁国治。1998年10月30日,梁国治又继续申办了卡号为8346990041731017的长城信用卡副卡。1999年1月1日,梁国治在兰州市七里河遭犯罪分子抢劫,身份证和长城信用卡副卡被抢。1月2日,赵先华向青海中行口头挂失,但未向该行信用卡部提交书面挂失。至1月5日,犯罪分子持卡凭被抢的梁国治身份证,共计在兰州消费10笔,透支金额4339.75元。对这笔信用卡挂失后的透支款,青海中行根据《中国银行人民币长城信用卡章程》(以征简称信用卡章程)第十三条关于“长城卡如遇丢失或被盗窃,持卡人应持本人身份证或其他有效证明,立即到附近的中国银行分支行办理书面挂失手续,并按规定交付挂失手续费。挂失之前及挂失次日24小时内,所造成的挂失卡风险损失仍由持卡人承担”的规定,自动承担了挂失24小时后的透支款633元,并从该信用卡入账工资中扣除了675.79元。其后,青海中行曾多次催促梁国治返还透支款并承担透支款的罚息300.41元,但梁国治均以信用卡的办理并非自愿和透支非本人所为为由,拒绝返还。@#
