| Chapter I General Provisions | | 第一章 总则 |

| Article 1 These Regulations are formulated in accordance with the Water Law of the People's Republic of China for the purpose of strengthening unified regulation of water of the Yellow River, bringing about sustainable utilization of the water resources of the Yellow River, and promoting economic and social development and improvement of the ecological environment in the Yellow River basin and the related areas. | | 第一条 为加强黄河水量的统一调度，实现黄河水资源的可持续利用，促进黄河流域及相关地区经济社会发展和生态环境的改善，根据《中华人民共和国水法》，制定本条例。 |

| Article 2 These Regulations are applicable to regulation and management of water of the Yellow River in the Yellow River basin, which covers Qinghai Province, Sichuan Province, Gansu Province, the Ningxia Hui Autonomous Region, the Inner Mongolia Autonomous Region, Shaanxi Province, Shanxi Province, Henan Province and Shandong Province, and to regulation and management of water diverted from the Yellow River into Hebei Province and Tianjin Municipality, both of which are approved by the State Council to abstract and use water of the Yellow River (hereinafter referred to as the eleven provinces, autonomous regions and municipality). | | 第二条 黄河流域的青海省、四川省、甘肃省、宁夏回族自治区、内蒙古自治区、陕西省、山西省、河南省、山东省，以及国务院批准取用黄河水的河北省、天津市（以下称十一省区市）的黄河水量调度和管理，适用本条例。 |

| Article 3 The State practices a unified system for water regulation of the Yellow River, and the principles of total volume control, runoff monitoring at controlling cross- sections, and management at different levels in compliance with the responsibilities at the corresponding levels, shall be followed in water regulation of the Yellow River. | | 第三条 国家对黄河水量实行统一调度，遵循总量控制、断面流量控制、分级管理、分级负责的原则。 |
In water regulation of the Yellow River, attention shall first be paid to satisfying domestic water use of urban and rural residents, and rational arrangements shall be made for agricultural, industrial and ecological water use, so as to prevent the Yellow River from running dry. | |
实施黄河水量调度，应当首先满足城乡居民生活用水的需要，合理安排农业、工业、生态环境用水，防止黄河断流。 |

| Article 4 For implementation of the plans, schemes and instructions for water regulation of the Yellow River, a system shall be established whereby the administrative chiefs of local people's governments, the principal leading members of the Yellow River Conservancy Commission and of the authorities affiliated thereto, and the principal leading members of the departments or units in charge of reservoirs shall assume responsibility. | | 第四条 黄河水量调度计划、调度方案和调度指令的执行，实行地方人民政府行政首长负责制和黄河水利委员会及其所属管理机构以及水库主管部门或者单位主要领导负责制。 |

| Article 5 The competent water administration department of the State Council and the competent development and reform department of the State Council shall be responsible for organizing, coordinating, supervising and directing efforts for water regulation of the Yellow River. | | 第五条 国务院水行政主管部门和国务院发展改革主管部门负责组织、协调、监督、指导黄河水量调度工作。 |
The Yellow River Conservancy Commission shall be responsible for organizing water regulation of the Yellow River and exercising supervision over and inspection of the regulation in accordance with the provisions of these Regulations. | |
黄河水利委员会依照本条例的规定负责黄河水量调度的组织实施和监督检查工作。 |
The competent water administration departments of the relevant local people's governments at or above the county level and the authorities affiliated to the Yellow River Conservancy Commission shall, in accordance with the provisions of these Regulations, be responsible for regulating water of the Yellow River and exercising supervision over and inspection of the regulation within the scope of their respective jurisdiction. | |
有关县级以上地方人民政府水行政主管部门和黄河水利委员会所属管理机构，依照本条例的规定负责所辖范围内黄河水量调度的实施和监督检查工作。 |

| Article 6 The relevant people's governments at or above the county level or the relevant departments shall reward the units and individuals that have made outstanding achievements in regulation of water of the Yellow River. | | 第六条 在黄河水量调度工作中做出显著成绩的单位和个人，由有关县级以上人民政府或者有关部门给予奖励。 |

| Chapter II Water Allocation | | 第二章 水量分配 |

| Article 7 The water allocation scheme of the Yellow River shall be prepared by the Yellow River Conservancy Commission in consultation with the people's governments of the eleven provinces, autonomous regions and municipality and, upon review by the competent development and reform department of the State Council and the competent water administration department of the State Council, be submitted to the State Council for approval. | | 第七条 黄河水量分配方案，由黄河水利委员会商十一省区市人民政府制订，经国务院发展改革主管部门和国务院水行政主管部门审查，报国务院批准。 |
The water allocation scheme of the Yellow River approved by the State Council shall be taken as the basis for regulation of water of the Yellow River, and the relevant local people's governments, the Yellow River Conservancy Commission and the authorities affiliated thereto shall implement the scheme. | |
国务院批准的黄河水量分配方案，是黄河水量调度的依据，有关地方人民政府和黄河水利委员会及其所属管理机构必须执行。 |

| Article 8 The following principles shall be followed in preparation of the water allocation scheme of the Yellow River; | | 第八条 制订黄河水量分配方案，应当遵循下列原则： |
| |
|
| (1) basing the scheme on the river basin plans and the medium and long-term plans for supply and demand of water; | | （一）依据流域规划和水中长期供求规划； |
| |
|
| (2) upholding planned and economical use of water; | | （二）坚持计划用水、节约用水； |
| |
|
| (3)taking into full account the conditions of the water resources, the current situations in respect of water abstraction and use, the supply and demand of water and the trend of development in the Yellow River basin, so as to give play to the all-round benefits provided by the water resources of the Yellow River; | | （三）充分考虑黄河流域水资源条件，取用水现状、供需情况及发展趋势，发挥黄河水资源的综合效益； |

|
| (4) giving overall consideration to domestic, productive and ecological water use; | | （四）统筹兼顾生活、生产、生态环境用水； |
| |
|
| (5) properly handling the relationships between the upper and lower reaches and between the right and left banks; and | | （五）正确处理上下游、左右岸的关系； |
| |
|
| (6) scientifically determining sediment transportation water demand and usable water. | | （六）科学确定河道输沙入海水量和可供水量。 |
The term "usable water" in the preceding paragraph means, with the exception of necessary sediment transportation water demand, the maximum amount of water available for domestic, agricultural, industrial, and outside-the-waterway ecological water use for a multi- year average natural runoff of the main stream and tributaries in the Yellow River basin. | |
前款所称可供水量，是指在黄河流域干、支流多年平均天然年径流量中，除必需的河道输沙入海水量外，可供城乡居民生活、农业、工业及河道外生态环境用水的最大水量。 |

| Article 9 Where the water allocation scheme of the Yellow River needs to be adjusted, a proposal shall be presented by the Yellow River Conservancy Commission in consultation with the people's governments of the eleven provinces, autonomous regions and municipality and, upon review by the competent development and reform department of the State Council and the competent water administration department of the State Council, be submitted to the State Council for approval. | | 第九条 黄河水量分配方案需要调整的，应当由黄河水利委员会商十一省区市人民政府提出方案，经国务院发展改革主管部门和国务院水行政主管部门审查，报国务院批准。 |

| Chapter III Water Regulation | | 第三章 水量调度 |
| |
|
| Article 10 The water of the Yellow River is regulated in a way whereby the annual regulation plan is combined with monthly regulation schemes, ten-day regulation schemes and real-time regulation instructions. | | 第十条 黄河水量调度实行年度水量调度计划与月、旬水量调度方案和实时调度指令相结合的调度方式。 |
The year for water regulation of the Yellow River starts from July 1 of each year and ends on June 30 of the next year. | |
黄河水量调度年度为当年7月1日至次年6月30日。 |

| Article 11 The proposals for the annual and monthly water use plans of the main stream and tributaries of the Yellow River and the proposals for the reservoir operation plans shall, within the limits of power for water regulation and the specified time limit, be submitted to the Yellow River Conservancy Commission by the competent water administration departments of the people's governments of the eleven provinces, autonomous regions and municipality, the Yellow River Henan Bureau, the Yellow River Shandong Bureau and related reservoir authorities. Before submitting their proposals for water use plans of the main stream of the Yellow River, the Yellow River Henan Bureau and the Yellow River Shandong Bureau shall consult the competent water administration departments of the people's governments of Henan and Shandong provinces respectively. | | 第十一条 黄河干、支流的年度和月用水计划建议与水库运行计划建议，由十一省区市人民政府水行政主管部门和河南、山东黄河河务局以及水库管理单位，按照调度管理权限和规定的时间向黄河水利委员会申报。河南、山东黄河河务局申报黄河干流的用水计划建议时，应当商河南省、山东省人民政府水行政主管部门。 |

| Article 12 The annual water regulation plan shall be prepared by the Yellow River Conservancy Commission in consultation with the competent water administration departments of the people's governments of the eleven provinces, autonomous regions and municipality, the Yellow River Henan Bureau, the Yellow River Shandong Bureau and related reservoir authorities, and be submitted to the competent water administration department of the State Council for approval before it is issued, and a copy thereof shall be sent to the competent development and reform department of the State Council at the same time. | | 第十二条 年度水量调度计划由黄河水利委员会商十一省区市人民政府水行政主管部门和河南、山东黄河河务局以及水库管理单位制订，报国务院水行政主管部门批准并下达，同时抄送国务院发展改革主管部门。 |
The approved annual water regulation plan shall be taken as the basis for determining the monthly water regulation schemes, ten-day water regulation schemes and the annual control indexes for water use of the main stream and tributaries of the Yellow River. The annual water regulation plan shall be incorporated into the annual plan for national economic and social development of the people's government at the corresponding level. | |
经批准的年度水量调度计划，是确定月、旬水量调度方案和年度黄河干、支流用水量控制指标的依据。年度水量调度计划应当纳入本级国民经济和社会发展年度计划。 |

| Article 13 The annual water regulation plan shall, according to the approved water allocation scheme of the Yellow River, the forecasted annual runoff and reservoir storage, be prepared by taking into overall and balanced account the submitted proposals for annual water use plans and for reservoir operation plans and by following the principles of pro rata adjustment and multi-year reservoir regulation. | | 第十三条 年度水量调度计划，应当依据经批准的黄河水量分配方案和年度预测来水量、水库蓄水量，按照同比例丰增枯减、多年调节水库蓄丰补枯的原则，在综合平衡申报的年度用水计划建议和水库运行计划建议的基础上制订。 |

| Article 14 The Yellow River Conservancy Commission shall, according to the approved annual water regulation plan and the submitted proposals for monthly water use plans and for reservoir operation plans, prepare and issue monthly water regulation schemes; and, for the peak periods of water use, prepare and issue ten-day water regulation schemes where necessary. | | 第十四条 黄河水利委员会应当根据经批准的年度水量调度计划和申报的月用水计划建议、水库运行计划建议，制订并下达月水量调度方案；用水高峰时，应当根据需要制订并下达旬水量调度方案。 |

| Article 15 The Yellow River Conservancy Commission may, in light of real-time flow, rainfall, drought, soil moisture, reservoir storage and water use, make adjustments to monthly or ten-day water regulation schemes already issued, and issue real-time regulation instructions. | | 第十五条 黄河水利委员会根据实时水情、雨情、旱情、墒情、水库蓄水量及用水情况，可以对已下达的月、旬水量调度方案作出调整，下达实时调度指令。 |

Article 16 The water of the main stream and tributaries of the Yellow River within the territory of Qinghai Province, Sichuan Province, Gansu Province, the Ningxia Hui Autonomous Region, the Inner Mongolia Autonomous Region, Shaanxi Province and Shanxi Province shall be regulated by the competent water administration departments of the people's governments at the provincial level respectively. The water of the main stream of the Yellow River within the territory of Henan and Shandong provinces shall be regulated by the Yellow River Henan Bureau and the Yellow River Shandong Bureau respectively, and the water of the tributaries of the Yellow River within the two provinces shall be regulated by the competent water administration departments of the people's governments of Henan and Shandong provinces respectively. The water diverted from the Yellow River to Hebei Province and Tianjin Municipality shall be regulated by the competent water administration departments of the people's governments of Hebei Province and Tianjin Municipality respectively.
