To correctly try administrative cases about open government information, these Provisions are formulated in accordance with the Administrative Litigation Law of the People's Republic of China, the Regulation of the People's Republic of China on Open Government Information and other laws and administrative regulations in light of the administrative trial practice. | |
为正确审理政府信息公开行政案件，根据《中华人民共和国行政诉讼法》、《中华人民共和国政府信息公开条例》等法律、行政法规的规定，结合行政审判实际，制定本规定。 |

| Article 1 Where a citizen, a legal person or any other organization deems that any of the following specific administrative acts related to open government information has infringed upon the legal rights and interests of the citizen, legal person or organization and files an administrative lawsuit according to law, the people's court shall accept such a lawsuit: | | 第一条 公民、法人或者其他组织认为下列政府信息公开工作中的具体行政行为侵犯其合法权益，依法提起行政诉讼的，人民法院应当受理： |

| 1. A citizen, a legal person or any organization applies to an administrative organ for access to government information, but the administrative organ refuses to provide such information or fails to give a reply within the prescribed time limit. | | （一）向行政机关申请获取政府信息，行政机关拒绝提供或者逾期不予答复的； |
| |
|
| 2. A citizen, a legal person or any organization deems that the government information provided by an administrative organ is not the information requested in the application or is not in a proper form prescribed by law or regulation. | | （二）认为行政机关提供的政府信息不符合其在申请中要求的内容或者法律、法规规定的适当形式的； |
| |
|
| 3. A citizen, a legal person or any organization deems that the open government information provided by an administrative organ voluntarily or upon application of any other person has infringed upon any trade secret or personal privacy of the citizen, legal person or organization. | | （三）认为行政机关主动公开或者依他人申请公开政府信息侵犯其商业秘密、个人隐私的； |

| 4. A citizen, a legal person or any organization deems that the government information on the citizen, legal person or organization provided by an administrative organ is inaccurate and therefore requests the administrative organ to make correction, but the administrative organ refuses to make correction, fails to give a reply within the prescribed time limit or fails to transfer the request to the competent organ for handling. | | （四）认为行政机关提供的与其自身相关的政府信息记录不准确，要求该行政机关予以更正，该行政机关拒绝更正、逾期不予答复或者不予转送有权机关处理的； |

| 5. A citizen, a legal person or any organization deems that any other specific administrative act related to open government information of an administrative organ has infringed upon the legal rights and interests of the citizen, legal person or organization. | | （五）认为行政机关在政府信息公开工作中的其他具体行政行为侵犯其合法权益的。 |
Where a citizen, a legal person or any other organization deems that any administrative act related to open government information has infringed upon the legal rights and interests of the citizen, legal person or organization and caused any damage, the citizen, legal person or organization may concurrently or separately file an administrative compensation lawsuit. | |
公民、法人或者其他组织认为政府信息公开行政行为侵犯其合法权益造成损害的，可以一并或单独提起行政赔偿诉讼。 |

| Article 2 Where a citizen, a legal person or any other organization files an administrative lawsuit against any of the following acts, the people's court shall not accept such a lawsuit: | | 第二条 公民、法人或者其他组织对下列行为不服提起行政诉讼的，人民法院不予受理： |
| |
|
| 1. Because the contents of an application are ambiguous, an administrative organ notifies the applicant to make modification or supplementation, which has no actual effect on the applicant's rights and obligations. | | （一）因申请内容不明确，行政机关要求申请人作出更改、补充且对申请人权利义务不产生实际影响的告知行为； |
| |
|
| 2. An administrative organ refuses an applicant's request for provision of any government gazette, newspaper, magazine, book or other open publication. | | （二）要求行政机关提供政府公报、报纸、杂志、书籍等公开出版物，行政机关予以拒绝的； |
| |
|
| 3. An administrative organ refuses an applicant's request for production or collection of government information for the applicant or summarization, analysis or processing of certain government information. | | （三）要求行政机关为其制作、搜集政府信息，或者对若干政府信息进行汇总、分析、加工，行政机关予以拒绝的； |
| |
|
| 4. The party concerned or a party of interest in an administrative procedure applies for consulting case files in the name of open government information, and the administrative organ notifies such a party to proceed in accordance with the relevant laws and regulations. | | （四）行政程序中的当事人、利害关系人以政府信息公开名义申请查阅案卷材料，行政机关告知其应当按照相关法律、法规的规定办理的。 |

| Article 3 Where a citizen, a legal person or any other organization deems that an administrative organ fails to fulfill its obligation of voluntary disclosure of government information according to law, and directly files a lawsuit with the people's court, the people's court shall notify the citizen, legal person or organization to firstly apply to the administrative organ for access to the relevant government information. Against the reply of the administrative organ or the administrative organ's failure to give a reply within the prescribed time limit, the citizen, legal person or organization may file a lawsuit with the people's court. | | 第三条 公民、法人或者其他组织认为行政机关不依法履行主动公开政府信息义务，直接向人民法院提起诉讼的，应当告知其先向行政机关申请获取相关政府信息。对行政机关的答复或者逾期不予答复不服的，可以向人民法院提起诉讼。 |

Article 4 Where a citizen, a legal person or any other organization files a lawsuit against an administrative act of a department of the State Council, the local people's government at any level or a department of the local people's government at or above the county level related to disclosure of government information upon application, the organ which gives the reply shall be the defendant; or if no reply is given within the prescribed time limit, the organ which accepts the application shall be the defendant.
