The Regulation on Individual Industrial and Commercial Households, as adopted at the 149th executive meeting of the State Council on March 30, 2011, is hereby promulgated, and shall come into force on November 1, 2011. | |
《个体工商户条例》已经2011年3月30日国务院第149次常务会议通过，现予公布，自2011年11月1日起施行。 |

| Article 1 This Regulation is formulated to protect the legitimate rights and interests of individual industrial and commercial households, encourage, support and guide their healthy development, strengthen the supervision and administration of them, and give play to their important role in promoting economic and social development and creating jobs. | | 第一条 为了保护个体工商户的合法权益，鼓励、支持和引导个体工商户健康发展，加强对个体工商户的监督、管理，发挥其在经济社会发展和扩大就业中的重要作用，制定本条例。 |

| Article 2 Individual industrial and commercial households shall be citizens with business operation capacity engaging in industrial and commercial business operations after registration with the industrial and commercial administrative departments in accordance with the provisions of this Regulation. | | 第二条 有经营能力的公民，依照本条例规定经工商行政管理部门登记，从事工商业经营的，为个体工商户。 |
Both individual operation and household operation shall be allowed for individual industrial and commercial households. | |
个体工商户可以个人经营，也可以家庭经营。 |
The legitimate rights and interests of individual industrial and commercial households shall be protected by law, and no entity or individual shall infringe upon them. | |
个体工商户的合法权益受法律保护，任何单位和个人不得侵害。 |

| Article 3 The industrial and commercial administrative departments of counties, autonomous counties, cities not divided into districts and municipal districts shall be the registration organs of individual industrial and commercial households (hereinafter referred to as the “registration organs”). Registration organs may authorize the industrial and commercial administrative offices under them to handle the registration of individual industrial and commercial households pursuant to the provisions of the industrial and commercial administrative department of the State Council. | | 第三条 县、自治县、不设区的市、市辖区工商行政管理部门为个体工商户的登记机关（以下简称登记机关）。登记机关按照国务院工商行政管理部门的规定，可以委托其下属工商行政管理所办理个体工商户登记。 |

| Article 4 The state shall apply the principles of equal market access and fair treatment to individual industrial and commercial households. | | 第四条 国家对个体工商户实行市场平等准入、公平待遇的原则。 |
If the scope of business stated in an application for registration of an individual industrial and commercial household does not include any industry prohibited by a law or administrative regulation from access, the registration organ shall grant the registration according to law. | |
申请办理个体工商户登记，申请登记的经营范围不属于法律、行政法规禁止进入的行业的，登记机关应当依法予以登记。 |

| Article 5 The industrial and commercial administrative departments and other relevant departments of the people's governments at or above the county level shall supervise and administer individual industrial and commercial households according to law. | | 第五条 工商行政管理部门和县级以上人民政府其他有关部门应当依法对个体工商户实行监督和管理。 |
In business operation, individual industrial and commercial households shall abide by laws and regulations, observe social morality and commercial ethics, act in good faith, and accept the supervision by the government and the relevant departments thereof. | |
个体工商户从事经营活动，应当遵守法律、法规，遵守社会公德、商业道德，诚实守信，接受政府及其有关部门依法实施的监督。 |

| Article 6 The local people's governments at all levels and the relevant departments of the people's governments at and above the county level shall take measures to provide support, convenience, advice and other services for individual industrial and commercial households in respect of business premises, business startup, professional skill training, professional skill certification, technical innovation, social insurance, etc. | | 第六条 地方各级人民政府和县级以上人民政府有关部门应当采取措施，在经营场所、创业和职业技能培训、职业技能鉴定、技术创新、参加社会保险等方面，为个体工商户提供支持、便利和信息咨询等服务。 |

| Article 7 Legally formed associations of self-employment shall, under the direction of the industrial and commercial administrative departments, provide services for individual industrial and commercial households, protect the legitimate rights and interests of individual industrial and commercial households, and guide them on good faith and self-discipline. | | 第七条 依法成立的个体劳动者协会在工商行政管理部门指导下，为个体工商户提供服务，维护个体工商户合法权益，引导个体工商户诚信自律。 |
Individual industrial and commercial households may join associations of self-employment on their free will. | |
个体工商户自愿加入个体劳动者协会。 |

| Article 8 An applicant for registration as an individual industrial and commercial household shall apply for registration to the registration organ at the locality of its business premises. The applicant shall submit a registration application form, an identity certificate and a certificate on business premises. | | 第八条 申请登记为个体工商户，应当向经营场所所在地登记机关申请注册登记。申请人应当提交登记申请书、身份证明和经营场所证明。 |
The registration items of an individual industrial and commercial household shall include the name and domicile of the operator, form of organization, scope of business and business premises. If the individual industrial and commercial household has a trade name, the trade name shall be registered. | |
个体工商户登记事项包括经营者姓名和住所、组成形式、经营范围、经营场所。个体工商户使用名称的，名称作为登记事项。 |

| Article 9 The registration organ shall proceed according to the following provisions after examining the application materials: | | 第九条 登记机关对申请材料依法审查后，按照下列规定办理： |
| |
|
| 1. If the application materials are complete and in the statutory formats, the registration organ shall grant the registration on the spot; or if the application materials are incomplete or not in the statutory formats, the registration organ shall notify on the spot the applicant of all necessary supplements and corrections; | | （一）申请材料齐全、符合法定形式的，当场予以登记；申请材料不齐全或者不符合法定形式要求的，当场告知申请人需要补正的全部内容； |
