The Measures for the Preparation, Examination and Approval of Detailed Control Plans on Cities and Towns, which were deliberated and adopted at the 64th executive meeting of the Ministry of Housing and Urban-Rural Development, are hereby issued and shall come into force as of January 1, 2011. | |
《城市、镇控制性详细规划编制审批办法》已经第64次部常务会议审议通过，现予发布，自2011年1月1日起施行。 |

| Article 1 To regulate the preparation, examination and approval of detailed control plans on cities and towns, these Measures are formulated in accordance with the Urban and Rural Planning Law of the People's Republic of China. | | 第一条 为了规范城市、镇控制性详细规划编制和审批工作，根据《中华人民共和国城乡规划法》，制定本办法。 |

| Article 2 These Measures shall apply to the preparation, examination and approval of detailed control plans on cities and towns. | | 第二条 控制性详细规划的编制和审批，适用本办法。 |
| |

| Article 3 A detailed control plan shall be the basis for the urban and rural planning administrative department to make planning administrative license and exercise planning administration. | | 第三条 控制性详细规划是城乡规划主管部门作出规划行政许可、实施规划管理的依据。 |
The allocation and assignment of the right to use the state land shall conform to the detailed control plan. | |
国有土地使用权的划拨、出让应当符合控制性详细规划。 |

| Article 4 The preparation of detailed control plans and the operating fund for the administration of detailed control plans shall be governed by Article 6 of the Urban and Rural Planning Law. | | 第四条 控制性详细规划的编制和管理经费应当按照《城乡规划法》第六条的规定执行。 |

| Article 5 Any entity or individual shall abide by the detailed control plan which has been approved and announced according to law, obey the planning administration and have the right to inquire of the urban and rural planning department about whether the construction activity involving its/his interests conforms to the requirements of the detailed control plan. | | 第五条 任何单位和个人都应当遵守经依法批准并公布的控制性详细规划，服从规划管理，并有权就涉及其利害关系的建设活动是否符合控制性详细规划的要求向城乡规划主管部门查询。 |
Any entity or individual has the right to expose or report any violation of the detailed control plan to the urban and rural administrative department or to any other relevant department. | |
任何单位和个人都有权向城乡规划主管部门或者其他有关部门举报或者控告违反控制性详细规划的行为。 |

| Chapter II Preparation of Detailed Control Plans on Cities and Towns | | 第二章 城市、镇控制性详细规划的编制 |

| Article 6 The urban and rural planning administrative department of the people's government of a city or county shall organize the preparation of the detailed control plan on the town where the people's government of the city or county is located. The detailed control plans on other towns shall be prepared by the people's governments of the towns. | | 第六条 城市、县人民政府城乡规划主管部门组织编制城市、县人民政府所在地镇的控制性详细规划；其他镇的控制性详细规划由镇人民政府组织编制。 |

| Article 7 The urban and rural planning administrative department of the people's government of a city or county, or the people's government of a town shall (hereinafter generally referred to as the preparation authority) shall authorize a plan preparation entity with the corresponding eligibilities to undertake the specific preparation of the detailed control plan. | | 第七条 城市、县人民政府城乡规划主管部门、镇人民政府（以下统称控制性详细规划组织编制机关）应当委托具备相应资质等级的规划编制单位承担控制性详细规划的具体编制工作。 |
