The departments of land and resources (departments of land, environment and resources, bureaus of land and resources, administrative bureaus of land, resources and housing and administrative bureaus of planning, land and resources) of all provinces, autonomous regions and municipalities directly under the Central Government; the competent administrative departments of land and resources at sub-provincial cities; the State Oceanic Administration; the State Bureau of Surveying and Mapping; the Land Administrative Bureau of the People's Liberation Army; the Bureau of Land and Resources of Xinjiang Production and Construction Corps; the local offices of the State Land Supervision Bureau; China Geological Survey; other institutions directly under this Ministry; and all departments and bureaus of this Ministry: | |

In order to strengthen the administration of land and resources data, regulate the production, summarization and submission, keeping and use of land and resources data, improve the application level of land and resources data and give full play to the functions of various data in the administration of land and resources and in the social and economic development, we hereby issue the Interim Measures for the Administration of Land and Resources Data deliberated and adopted at the Minister's executive meeting to you for your compliance and implementation. Please timely report the problems encountered in the implementation thereof to the Ministry of Land and Resources. | |

| Chapter I General Provisions | | 第一章 总 则 |

| Article 1 In order to strengthen the administration of land and resources data, regulate the production, summarization and submission, keeping and use of land and resources data, improve the application level of land and resources data and meet the needs for the administration of land and resources and the social and economic development, these Measures are formulated in accordance with the relevant laws and regulations. | | 第一条 为了加强国土资源数据的管理，规范国土资源数据的生产、汇交、保管和利用等工作，提高国土资源数据的应用水平，满足国土资源管理和社会经济发展的需要，根据有关法律法规，制定本办法。 |

| Article 2 These Measures shall apply to the production, summarization and submission, keeping and use of land and resources data. | | 第二条 国土资源数据的生产、汇交、保管和利用，适用本办法。 |

|
| Article 3 The term “data” as mentioned in these Measures refers to the digital results which the administrative departments of land and resources at all levels need to use in the process of performing their functions of planning, administration, protection and reasonable use of land and resources, mainly including: | | 第三条 本办法所称数据，是指各级国土资源管理部门在履行国土资源规划、管理、保护与合理利用职能过程中需要使用的数字化成果。主要包括： |

| 1. Various basic and specialized land and resources digital results formed in such major special projects as land and resources planning, investigation, monitoring, evaluation, etc. organized and conducted by the administrative departments of land and resources at all levels; | | （一）各级国土资源管理部门组织实施的国土资源规划、调查、监测、评价等重大专项形成的各类国土资源基础和专题数字化成果数据； |

|
| 2. The government administration digital results of land and resources formed in the planning, administration, protection and reasonable use of land and resources by the administrative departments of land and resources at all levels, including the data produced at a level and data summarized through reporting level by level; and | | （二）各级国土资源管理部门在国土资源规划、管理、保护与合理利用工作中形成的国土资源政务管理数字化成果数据，包括本级产生以及逐级上报汇总的数据； |

|
| 3. The land and resources digital results submitted to the administrative departments by the parties subject to administration, as required by the administrative departments of land and resources at all levels in performing their administrative duties in accordance with the relevant provisions of laws and regulations and the relevant contractual provisions. | | （三）各级国土资源管理部门在履行管理职责中依照法律法规的相关规定和有关合同约定，由管理相对人向管理部门报送的国土资源数字化成果数据。 |

| Article 4 The administration of land and resources data shall be organized and conducted under the principle of overall planning, uniform summarization and submission, multi-level management and distributed service. | | 第四条 国土资源数据管理工作按照统筹规划、统一汇交、分级管理、分布服务的原则组织实施。 |

| Chapter II Administrative Organs and Functions | | 第二章 管理机构和职责 |

| Article 5 The Ministry of Land and Resources and the local administrative departments of land and resources at all levels (hereinafter referred to as the “competent data authorities”, dividing into the competent data authority of the Ministry and the local competent data authorities at all levels) shall be respectively responsible for the supervision and administration of the production, summarization and submission, keeping and use of land and resources data of the whole country and of their respective administrative regions, and perform the following functions: | | 第五条 国土资源部和地方各级国土资源管理部门（以下称数据主管部门，分为部数据主管部门和地方各级数据主管部门）分别负责全国和本行政区域内国土资源数据生产、汇交、保管和利用的监督管理，履行下列职责： |

| 1. Taking charge of the uniform management, organization and coordination of data administration, and organizing the formulation of rules on data administration; | | （一）负责数据管理工作的统一管理和组织协调，组织制定数据管理工作的规章制度； |
| |
|
| 2. Organizing and conducting such major special projects as land and resources planning, investigation, monitoring, evaluation, etc. as required by the land and resources administration, and forming digital results; | | （二）按照国土资源管理需要，组织实施国土资源规划、调查、监测、评价等重大专项，形成数字化成果数据； |
| |
|
| 3. Undertaking administrative examination and approval and other affairs, organizing and deploying the submission and filing of relevant business data of the land and resources administrative departments, and forming government administration digital results; | | （三）承办行政审批事项等工作，组织部署国土资源管理部门相关业务数据的报备工作，形成政务管理数字化成果数据； |

| 4. Organizing and conducting business training on data administration and data inspection; and | | （四）组织开展数据管理的业务培训和数据检查工作； |
| |
|
| 5. Taking charge of the guidance, supervision and administration of data confidentiality. | | （五）负责指导、监督和管理数据的保密工作。 |
The Office of the Leading Group for Computerization of the Ministry of Land and Resources as the organ of the Ministry of Land and Resources responsible for data administration shall undertake the routine work on data administration. | |
国土资源部信息化领导小组办公室是国土资源部负责数据管理工作的机构，承担数据管理日常工作。 |

| Article 6 The Information Center of the Ministry of Land and Resources and the information centers or computerization organs of the local administrative departments of land and resources at all levels (hereinafter referred to as the “data keeping entities”, dividing into the data keeping entity of the Ministry and the local data keeping entities at all levels) shall undertake the technical work on data administration as authorized by the corresponding competent data authorities, and perform the following functions: | | 第六条 国土资源部信息中心和地方各级国土资源管理部门的信息中心或信息化工作机构（以下称数据保管单位，分为部数据保管单位和地方各级数据保管单位）受相应数据主管部门的委托，承担数据管理的技术工作，履行下列职责： |

| 1. Undertaking such technical work as summarization and submission, keeping and use of data; | | （一）承担数据汇交、保管和利用等技术工作； |
| |
|
| 2. Formulating the technical rules and procedures for the summarization and submission, keeping and use of data; | | （二）制定数据汇交、保管和利用等工作的技术规程； |
| |
|
| 3. Assisting the competent data authority in conducting data inspection; | | （三）协助数据主管部门，实施数据检查工作； |
| |
|
| 4. Establishing and maintaining the software and hardware environment and data administration system for the summarization and submission, keeping and use of data; | | （四）建立和维护数据汇交、保管和利用的软硬件环境以及数据管理系统； |
| |
|
| 5. Carrying out data consolidation and integration and establishing an information service system to provide government departments and the public with information service; | | （五）开展数据整合与集成，建立信息服务系统，为政府部门和社会提供信息服务； |
| |
|
| 6. Carrying out analysis and research on data summarization and synthesis to provide support for land and resources administration; | | （六）开展数据汇总、综合分析和研究，为国土资源管理工作提供支持； |
| |
|
| 7. Applying a responsibility system for data security, improving the data security management system, and perfecting data security protective measures; and | | （七）实行数据安全工作责任制，健全数据安全管理制度，完善数据安全防护措施； |
| |
|
| 8. Performing other functions relevant to data administration as set out by the competent data authority. | | （八）履行数据主管部门规定的与数据管理有关的其他职责。 |
| |

| Article 7 The entities organizing and conducting such major special projects as land and resources planning, investigation, monitoring, evaluation, etc. and the entities forming government administration digital results (hereinafter referred to as the “data production entities”) shall undertake the production, processing, summarization and submission, and updating of data, and perform the following functions: | | 第七条 国土资源规划、调查、监测、评价等重大专项的组织实施单位和政务管理数字化成果数据的形成单位（以下称数据生产单位），承担数据的生产、加工、汇交和更新等工作，履行下列职责： |

|
| 1. Collecting, producing and processing data to form digital results as required by the land and resources administration in accordance with the relevant provisions, standards and criteria; | | （一）按照国土资源管理的要求，依照有关规定、标准和规范，采集、生产和加工处理数据，形成数字化成果数据； |
| |
|
| 2. Formulating the technical rules and procedures for the production, processing and updating of data; | | （二）制定数据生产、加工、更新等工作的技术规程； |
| |
|
| 3. Summarizing and submitting data in accordance with the relevant provisions, and keeping digital results; | | （三）按照规定汇交数据，并保管数字化成果数据； |
| |
|
| 4. Taking charge of the updating of summarized and submitted data; and | | （四）负责汇交数据的更新工作； |
| |
|
| 5. Performing other functions relevant to the production, processing, summarization and submission and updating of data as set out by the competent data authority. | | （五）履行数据主管部门规定的与数据生产、加工、汇交和更新有关的其他职责。 |

| Chapter III Data Production, Summarization and Submission | | 第三章 数据生产和汇交 |

|
| Article 8 The competent data authorities shall make an overall plan on data production, bring it into the planning and programs of such major special projects as land and resources planning, investigation, monitoring, evaluation, etc., and ensure that the digital results are accessible and usable. | | 第八条 数据主管部门统筹规划数据生产，将其纳入国土资源规划、调查、监测、评价等重大专项的规划和计划中，确保数字化成果数据的可获取、可利用。 |
| |
|
| Article 9 Data production shall follow the relevant business provisions and the relevant state and industrial technical standards and criteria to guarantee the standardization of data production. | | 第九条 数据生产应遵循相关业务规定及国家、行业有关技术标准、规范，保证数据生产的规范性。 |
The data production entities shall be responsible for the quality, authenticity, accuracy and integrity of data, and establish a data quality supervision and technical support system. | |
数据生产单位应对数据质量和数据的真实性、准确性和完整性负责，建立数据质量监督和技术保障制度。 |

| Article 10 The competent data authorities shall apply a uniform data summarization and submission system. | | 第十条 数据主管部门对数据实行统一汇交制度。 |
Various basic and specialized digital results of land and resources formed in such major special projects as land and resources planning, investigation, monitoring, evaluation, etc. shall be summarized and submitted by the data production entities to the data keeping entities; government administration digital results formed by the competent data authorities in the process of performing their business administration functions shall, via the government administration information system, automatically enter the data management system of the data keeping entities; and land and resources digital results formed in accordance with the relevant provisions of laws and regulations and the relevant contractual provisions shall be submitted by the parties subject to administration to the administrative departments, which shall then summarize and submit them to the data keeping entities.

国土资源规划、调查、监测、评价等重大专项形成的各类国土资源基础和专题数字化成果数据，由数据生产单位向数据保管单位汇交；数据主管部门履行业务管理职能过程中形成的政务管理数字化成果数据，通过政务管理信息系统自动进入数据保管单位的数据管理系统中；依照法律法规的相关规定和有关合同约定形成的国土资源数字化成果数据，由管理相对人向管理部门报送，管理部门再向数据保管单位汇交。
