The cultural departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government, the Cultural Bureau of Xinjiang Construction Army Corps, and all customs houses directly under the General Administration of Customs: | |

Pursuant to the Decision of the State Council on Amending the Decision of the State Council on Establishing Administrative Licenses for the Administrative Examination and Approval Items Really Necessary to Be Retained (Order No.412 of the State Council of the People's Republic of China) and the Administrative Measures for the Business Operations of Artworks (Order No.29 of the Ministry of Culture), the Ministry of Culture shall be responsible for the examination and approval of the business operations relating to the import and export of artworks, while the customs houses shall be responsible for regulating the entry and exit of artworks. To carry out the above-mentioned provisions, strengthen the administration of the business operations of the import and export of artworks and the commercial artwork exhibitions, enhance Sino-foreign cultural exchange and enrich the cultural life of the people, the Ministry of Culture and the General Administration of Customs formulated the Interim Provisions on the Administration of the Import and Export of Artworks, which are hereby issued to you for your compliance and implementation. | |
根据《国务院对确需保留的行政审批项目设定行政许可的决定》（中华人民共和国国务院令第412号）和《美术品经营管理办法》（文化部第29号令）的有关规定，文化部负责对美术品进出口经营活动的审批管理，海关负责对美术品进出境环节进行监管。为切实贯彻落实上述规定，加强对美术品进出口经营活动、商业性美术品展览活动的管理，促进中外文化交流，丰富人民群众文化生活，文化部、海关总署制定了《美术品进出口管理暂行规定》。现印发给你们，请遵照执行。特此通知。 |

美术品进出口管理暂行规定 |
To strengthen the administration of the import and export of artworks and commercial artwork exhibitions, enhance Sino-foreign cultural exchange and enrich the cultural life of the people, we hereby notify you of some issues concerning the import and export administration of artworks as follows: | |
为加强对美术品进出口经营活动、商业性美术品展览活动的管理，促进中外文化交流，丰富人民群众文化生活，现将美术品进出口管理有关事项规定如下： |

| 1. The term “artwork” as mentioned in these Provisions refers to works in the plastic arts with specific significance of beauty which are created by art workers with lines, colors or other tools, including paintings, calligraphy works, sculptures, photographs, fixtures and reproductions which are licensed and signed by art workers for a quantity of not more than 200 pieces. | | 一、本规定所称美术品，是指艺术创作者以线条、色彩或者其他方式创作的具有审美意义的造型艺术作品，包括绘画、书法、雕塑、摄影、装置等作品，以及艺术创作者许可并签名的，数量在200件以内的复制品。 |
Handicraft artworks subject to industrialized batch production and cultural relics are not included in “artwork” mentioned in these Provisions. | |
本规定所称美术品不包括工业化批量生产的工艺美术产品，不包括文物。 |

| 2. The term “business operations of the import and export of artworks” as mentioned in these Provisions refers to business operations of importing/exporting artworks from/to areas outside China. | | 二、本规定所称美术品进出口经营活动，是指从境外进口或向境外出口美术品的经营活动。 |
The term “foreign-related commercial artwork exhibitions” as mentioned in these Provisions refers to various kinds of exhibitions which are held at domestic public exhibition centers for sales or commercial publicity with the participation of overseas art workers or overseas artworks. | |
本规定所称涉外商业性美术品展览活动，是指以销售、商业宣传为目的在境内公共展览场所举办的，有境外艺术创作者或者境外艺术作品参加的各类展示活动。 |
For the reexport or reimport of a same batch of artworks whose import or export has been approved, the importer or exporter may handle the relevant formalities at the customs house of the original import-export port upon the strength of the original approval document and does not need to submit to the administrative department of culture for examination and approval anew. However, if the reexported or reimported artworks are inconsistent with the descriptions of the original approval document, the importer or exporter shall handle the examination and approval formalities at the administrative department of culture anew. | |
同一批已经批准进口或出口的美术品复出口或复进口，进口单位可持原批准文件正本到原进口或出口口岸海关办理相关手续，文化行政部门不再重复审批。上述复出口或复进口的美术品如与原批准文件内容不符，进出口单位应当到文化行政部门重新办理审批手续。 |

| 3. The term “artwork importers/exporters” as mentioned in these Provisions refers to enterprises which have been registered at the commercial departments and have been licensed to engage in import and export. | | 三、本规定所称美术品进出口单位，是指在商务部门备案登记，取得进出口资质的企业。 |
| |
|
| 4. The state encourages the import and export of artworks which are good for transmitting world excellent cultural arts and for improving the ideological, moral, educational and aesthetic judgment of the general public. | | 四、国家鼓励进口和出口有利于传播世界优秀文化艺术、有利于提升人民群众思想、道德、文化、欣赏水平的美术品。 |
The import and export of artworks must conform to the relevant state laws and regulations. Artwork importers/exporters shall succumb to the guidance, supervision and inspection of the administrative departments of culture so as to guarantee the legal sources of artworks. | |
美术品进出口活动应当遵守国家有关法律、法规。美术品进出口单位应当接受文化行政部门的指导、监督和检查，确保进出口的美术品具有合法的来源。 |
No entity or individual may sell, exhibit or transmit in any other commercial form artworks imported without the approval of the competent administrative department of culture. | |
任何单位和个人不得销售、展览、展示或者利用其他商业形式传播未经文化行政部门批准进口的美术品。 |

| 5. The entry and exit of artworks with the following contents shall be prohibited: | | 五、禁止含有下列内容的美术品进出境： |
| |
|
| (1) Contents that go against the basic principles of the Constitution; | | （一）违反宪法确定的基本原则的； |
| |
|
| (2) Contents that jeopardize the unification, sovereignty or territorial integrity of the state; | | （二）危害国家统一、主权和领土完整的； |
| |
|
| (3) Contents that divulge any national secret, endanger national security or impair national prestige or interest; | | （三）泄漏国家秘密、危害国家安全或者损害国家荣誉和利益的； |
| |
|
| (4) Contents that incite ethnic hatred or discrimination, undermine the ethnic solidarity or injure ethnic customs or habit; | | （四）煽动民族仇恨、民族歧视，破坏民族团结，或者侵害民族风俗习惯的； |
| |
|
| (5) Contents that advocate or disseminate cult or superstition; | | （五）宣扬或者传播邪教、迷信的； |
| |
|
| (6) Contents that disturb the social order or undermine social stability; | | （六）扰乱社会秩序，破坏社会稳定的； |
| |
|
| (7) Contents that spread any obscene, gambling or violent information or abet the commission of a crime; | | （七）宣扬或者传播淫秽、色情、赌博、暴力、恐怖或者教唆犯罪的； |
| |
|
| (8) Contents that insult or defame other people or infringe upon other people's legitimate rights and interests; | | （八）侮辱或者诽谤他人、侵害他人合法权益的； |
| |
|
| (9) Contents that maliciously distort the history or seriously juggle with history; | | （九）蓄意篡改历史、严重歪曲历史的； |
| |
|
| (10) Contents that impair the social morality or excellent ethnic traditional culture; or | | （十）危害社会公德或者有损民族优秀文化传统的； |
| |
|
(11) Contents that are otherwise prohibited by the relevant laws, administrative regulations and state provisions.
