| Article 1 To regulate the formulation of the regulatory documents of the State-owned Assets Supervision and Administration Commission (SASAC), guarantee the quality of such documents and facilitate the SASAC's performance of duties as a financial contributor, these Measures are formulated in accordance with the Legislation Law of the People's Republic of China, the Interim Regulation on the Supervision and Administration of the State-owned Assets of Enterprises, the Regulation on the Procedures for the Formulation of Administrative Regulations and the Legislation Rules of the SASAC. | | 第一条 为规范国务院国有资产监督管理委员会（以下简称国资委）规范性文件的制定工作，保证规范性文件质量，促进依法履行出资人职责，根据《中华人民共和国立法法》、《企业国有资产监督管理暂行条例》、《规章制定程序条例》和《国资委立法工作规则》，制定本办法。 |

| Article 2 For the purpose of these Measures, the term “regulatory documents” refers to all provisions, measures, detailed implementation rules, rules and opinions, other than regulations, which are formulated by the SASAC according to its legal authority and the legal procedure, have universal binding force and are repeatedly applicable. | | 第二条 本办法所称规范性文件，是指除规章以外，国资委依据法定职权和程序制定的，具有普遍约束力，能够反复适用的规定、办法、实施细则、规则和意见等文件的总称。 |

| Article 3 These Measures apply to the proposal, draft, examination, decision, promulgation, interpretation and evaluation of the SASAC regulatory documents. | | 第三条 国资委规范性文件的立项、起草、审查、决定、公布、解释和评价等适用本办法。 |
The procedure prescribed in these Measures shall be strictly followed in formulating regulatory documents. | |
制定规范性文件，应当严格遵循本办法规定的程序。 |
These Measures are not applicable to the formulation of the SASAC internal work rules, personnel appointment and removal decisions and specific matter handling decisions. | |
国资委内部工作制度、人事任免决定和对具体事项的处理决定等文件，不适用本办法。 |

| Article 4 Regulations shall be made betimes when it comes to the SASAC function issues that can be regulated by regulations. | | 第四条 涉及国资委的职能，可以通过规章规范的事项，应当及时制定规章。 |
Issues provided in regulatory documents shall be those encountered in implementing the relevant state policies, laws or the administrative regulations, decisions and orders of the State Council, for which more trials in practice are needed and the formulation of regulations is inappropriate for the present or is unnecessary. | |
规范性文件规定的事项，应当是在贯彻落实国家有关政策，执行法律或者国务院行政法规、决定、命令过程中，需要实践探索、暂时不宜制定规章或者不需要制定规章的事项。 |

| Article 5 The formulation of regulatory documents shall follow the principles of unification of legal system and the principle of legal prescription of functions and powers. | | 第五条 规范性文件的制定，应当坚持国家法制统一原则和职权法定原则。 |

| Article 6 The law and policy bureau shall be responsible for the centralized management of the formulation and amendment of the SASAC regulatory documents and the examination of the legality and consistency of such documents. | | 第六条 政策法规局（以下简称法规局）负责对委内规范性文件的制定和修订工作进行归口管理，对规范性文件的合法性、协调性进行审核。 |
All SASAC departments, bureaus and offices (hereinafter referred to as the SASAC entities) shall be responsible for the legislative research and investigation and drafting of the relevant regulatory documents based on their respective functions. | |
委内各厅、局、室（以下简称委内各单位）依据各自职能，负责有关规范性文件的立法调研和起草工作。 |
The regulatory documents formulated and promulgated by the relevant departments of the State Council and the SASAC shall be subject to the joint examination of the law and policy bureau and other relevant SASAC entities.
