| Publication of the Application Conditions and Procedures for Ferroalloy Export Licensing in 2016 | | 公布《2016年度铁合金出口许可申报条件和申报程序》 |
| In order to protect the environment, coordinate with the state's industry policies, reduce the emission of industrial pollution and energy consumption, and promote the sustainable development of the ferroalloy industry, in accordance with the HYPERLINK "javascript:ESLC(52228,0)" Foreign Trade Law of the People's Republic of Chinaand the HYPERLINK "javascript:ESLC(38108,0)" Regulation of the People's Republic of China on the Administration of the Import and Export of Goods, the Application Conditions and Procedures for Ferroalloy Export Licensing in 2016 are hereby published. | | 为保护生态环境，配合国家产业政策，减少工业污染排放和能源消耗，促进铁合金行业可持续发展，根据《中华人民共和国对外贸易法》、《中华人民共和国货物进出口管理条例》的有关规定，现公布2016年度铁合金出口许可申报条件及申报程序： |
| I.Application Conditions for Ferroalloy Export Licensing | | 一、铁合金出口许可申报条件 |
| According to the management requirements and product characteristics, enterprises engaging in ferroalloy product operations are divided into two categories (see Annex 1): Category A enterprises are enterprises whose operations cover all the products in the tariff line 7202; Category B enterprises are enterprises whose operations cover all the products in the tariff line 7202 but ferrosilicon (72022100), ferromanganese (72021100, 72021900) and ferro-silico-manganese (72023000). Enterprises satisfying the following requirements may apply for ferroalloy export licensing in 2016: | | 根据管理要求和产品特性，将经营铁合金产品的企业分为两类（见附件1）：A类企业是指经营税号7202项下全部产品的企业；B类企业是指经营税号7202项下除硅铁（72022100）、锰铁（72021100、72021900）及硅锰铁（72023000）之外的其他产品的企业。符合下列条件的企业可以申报2016年铁合金出口许可： |
| (1) A production enterprise | | （一）生产企业。 |
| (a) According to the relevant provisions issued by the state, it has registered with the administration for industry and commerce and has been qualified to engage in the import and export trade or has undergone the recordation and registration as a foreign trade business or if it is a foreign-funded enterprise, the export of relevant commodities is included in its business scope and it is an independent legal entity. | | 1．按国家有关规定经工商行政管理部门登记注册、获得进出口经营资格或办理对外贸易经营者备案登记，或外商投资企业经营范围包括相应商品出口业务、具有独立法人资格。 |
| (b) As a Category A enterprise, it must comply with the Ferroalloy Industry Access Conditions (as announced in a list of enterprises by the State Development and Reform Commission or the Ministry of Industry and Information Technology). | | 2．A类企业须符合《铁合金行业准入条件》（以发展改革委或工业和信息化部公告的企业名单为准）。 |
| (c)As a Category A enterprise, its total export of ferromanganese, ferrosilicon, and ferro-silico-manganese (including export supplies) reached 3,000 tons in 2014. | | 3．A类企业2014年锰铁、硅铁、硅锰铁合计出口数量（含出口供货量）达到3000吨。 |
| (d)If the products with HS codes in the tariff line of ferrosilicon, ferromanganese, and ferro-silico-manganese produced by it as a Category B enterprise are determined by the state's industry authorities to have adopted any new process or high technology or to be of a high added value, it may be qualified for the export of products in the corresponding tariff lines. | | 4．B类企业生产的海关编码归在硅铁、锰铁和硅锰铁税号下的产品，若经国家产业主管部门认定其为新工艺、高技术、高附加值的，可赋予相应税号下的产品出口资质。 |
| (e) It has passed the ISO9000 quality management system certification. | | 5．取得ISO9000质量体系认证。 |
| (f) It has environmental protection treatment facilities suitable for its scale of production, with its discharge of pollutants up to the relevant state or local pollutant discharge standards. | | 6．具有与生产规模相适应的环保治理设施，污染物排放达到国家或地方有关污染物排放标准。 |
| (g) It complies with the relevant laws and regulations of the state and the relevant provisions issued by the local government, and as legally required, participates in the endowment, unemployment, medical, work-related injury, maternity, and other social insurance, with social insurance premiums fully paid on time. | | 7．遵守国家有关法律法规和当地政府的有关规定，依法参加养老、失业、医疗、工伤、生育等各项社会保险并按时足额缴纳社会保险费。 |
| (h) It did not commit any violation of the relevant laws and regulations of the state from 2012 to 2014. | | 8．2012-2014年无违反国家有关法律法规的行为。 |
| (2) A circulation enterprise | | （二）流通企业。 |
| (a) According to the relevant provisions issued by the state, it has registered with the administration for industry and commerce and has been qualified to engage in the import and export trade or has undergone the recordation and registration as a foreign trade business or if it is a foreign-funded enterprise, the export of relevant commodities is included in its business scope and it is an independent legal entity. | | 1．按国家有关规定经工商行政管理部门登记注册、获得进出口经营资格或办理对外贸易经营者备案登记，或外商投资企业经营范围包括相应商品出口业务、具有独立法人资格。 |
| (b) As a Category A enterprise, its total export of ferromanganese, ferrosilicon, and ferro-silico-manganese reached 3,000 tons, its export supplies reached 3,000 tons, or its domestic sales reached 10,000 tons in 2014. | | 2．A类企业2014年锰铁、硅铁、硅锰铁合计出口数量达到3000吨，或出口供货量达3000吨，或国内销售数量达到10000吨。 |
| (c)As a Category A enterprise, it must purchase products from production enterprises satisfying subparagraphs (1)(a), (b), (e), (f), (g) and (h) above, and provide relevant materials showing that the suppliers comply with the standards, certificates issued by the suppliers, and their purchase and sale invoices. | | 3．A类企业产品须从符合第（一）条1、2、5、6、7、8款规定的生产企业购买，并提供其货源企业符合标准的有关材料、货源企业证明以及双方的购销发票。 |
| (d) As a Category B enterprise, it must purchase products from production enterprises satisfying subparagraphs (1)(a), (e), (f), (g) and (h) above, and provide relevant materials showing that the suppliers comply with the standards, certificates issued by the suppliers, and their purchase and sale invoices. | | 4．B类企业产品须从符合第（一）条1、5、6、7、8款规定的生产企业购买，并提供其货源企业符合标准的有关材料、货源企业证明以及双方的购销发票。 |
| (e) It has passed the ISO9000 quality management system certification. | | 5．取得ISO9000质量体系认证。 |
| (f) It complies with the relevant laws and regulations of the state and the relevant provisions issued by the local government, and as legally required, participates in the endowment, unemployment, medical, work-related injury, maternity, and other social insurance, with social insurance premiums fully paid on time. | | 6．遵守国家有关法律法规和当地政府的有关规定，依法参加养老、失业、医疗、工伤、生育等各项社会保险并按时足额缴纳社会保险费。 |
| (g) It did not commit any violation of the relevant laws and regulations of the state from 2012 to 2014. | | 7．2012-2014年无违反国家有关法律法规的行为。 |
| (3) Outbound investment enterprises | | （三）境外投资企业。 |
In accordance with the relevant provisions ofthe HYPERLINK "javascript:ESLC(114537,0)" Measures for the Adminsitration of Outbound Investments(Order No. 3 [2014], Ministry of Commerce), “going global” enterprises that definitely need to supply ferroalloy products specifically to its outbound investment projects and did not commit any violation of the relevant laws or regulations of the state from 2012 to 2014 may apply for export licensing for their specific export of the corresponding types of ferroalloy.
