The Procedures of Shanghai Municipality on the Implementation of the Law of the People's Republic of China on the Standard Spoken and Written Chinese Language, as adopted at the 25th Session of the Standing Committee of the 12th Shanghai Municipal People's Congress on December 29, 2005, is hereby issued and shall become effective as of March 1, 2006.
 
《上海市实施〈中华人民共和国国家通用语言文字法〉办法》已由上海市第十二届人民代表大会常务委员会第二十五次会议于2005年12月29日通过,现予公布,自2006年3月1日起施行。

上海市实施《中华人民共和国国家通用语言文字法》办法

Article 1 For the purposes of popularizing standard Chinese pronunciation (hereinafter referred to as Putonghua) and normalized Chinese characters, enhancing the administration of the use of the standard spoken and written Chinese language, and giving full play to its role in our social life, these Procedures are formulated on the basis of the Law of the People's Republic of China on the Standard Spoken and Written Chinese Language and other relevant laws and administrative regulations, and in the light of the actual circumstances of this Municipality.   第一条 为了推广普通话和推行规范汉字,加强国家通用语言文字使用管理,发挥国家通用语言文字在社会生活中的作用,根据《中华人民共和国国家通用语言文字法》和其他有关法律、行政法规,结合本市实际,制定本办法。

 
Article 2 These Procedures apply to the use of the standard spoken and written Chinese language and the administration and supervision thereof in the administrative area of this Municipality.   第二条 本市行政区域内国家通用语言文字的使用及其管理和监督,适用本办法。

 
Article 3 This Municipality shall promote the normalization, enrichment and development of the standard spoken and written Chinese language, and create a language use environment suiting the needs of economic, social, and cultural development.   第三条 本市促进国家通用语言文字的规范、丰富和发展,建设与经济、社会、文化发展相适应的语言文字应用环境。

This Municipality shall encourage state organs, enterprises, institutions, mass organizations, as well as other social organizations and citizens to participate in the normalization and standardization of the spoken and written Chinese language.
 
本市鼓励国家机关、企业、事业单位、社会团体、其他社会组织和公民参与国家通用语言文字的规范化、标准化建设。

 
Article 4 The municipal and district/county people's governments shall enhance the leadership in the work of standard spoken and written Chinese language, and incorporate the popularization of Putonghua and normalization of Chinese characters into city administration and the promotion of ethical and cultural progress.   第四条 市和区、县人民政府应当加强对国家通用语言文字工作的领导,将推广普通话、推行规范汉字纳入城市管理和精神文明建设的内容。

The municipal and district/county people's governments shall ensure the supply of personnel and funds needed for standardizing the spoken and written Chinese language.
 
市和区、县人民政府应当对国家通用语言文字工作所需人员和经费予以保证。

 
Article 5 The commissions of spoken and written language under the municipal and district/county people's governments shall be responsible for the administration and supervision of the use of standard spoken and written Chinese in their respective administrative areas, and, their offices shall be set up in the education administrative departments at the same levels.   第五条 市和区、县人民政府的语言文字工作委员会负责本行政区域内国家通用语言文字使用的管理和监督,其办事机构设在同级教育行政管理部门。

The main duties of the commissions of spoken and written language under the municipal and district/county people's governments include:
 
市和区、县语言文字工作委员会的主要职责是:

 
1. Formulating a working plan for standardizing spoken and written Chinese, and organizing its implementation in their respective administrative areas; (一)编制、组织实施本行政区域内国家通用语言文字工作规划;

 
2. Coordinating, guiding and supervising the work of all departments and trades with respect to the spoken and written language; (二)协调、指导、监督各部门、各行业的语言文字工作;

 
3. Organizing publicity and educational activities for the normalization of spoken and written Chinese; (三)组织语言文字规范化宣传教育活动;

 
4. Guiding the training and proficiency test in the use of Putonghua and normalized Chinese characters; (四)指导普通话和规范汉字应用的培训和水平测试;

 
5. Promoting application research on the standard spoken and written Chinese language; and (五)推进国家通用语言文字应用研究;

 
6. Other duties provided by laws and regulations. (六)法律、法规规定的其他职责。

Town/township people's governments and sub-district offices shall, in accordance with the requirements and arrangements made by the district/county people's governments, take responsibility for relevant work as regards the standard spoken and written Chinese language in their respective areas.
 
乡、镇人民政府和街道办事处应当根据区、县人民政府的要求和部署,负责做好本区域内国家通用语言文字的相关工作。

 
Article 6 This Municipality shall commend the organizations and individual persons that have made remarkable achievements in the popularization, research and administration of the standard spoken and written Chinese language.   第六条 本市对在国家通用语言文字推广、研究、管理工作中做出突出成绩的组织和个人予以表彰。

 
Article 7 This Municipality shall, according to law, safeguard the rights of citizens to learn and use the standard spoken and written Chinese language, and, no organizations and individual persons shall impair such rights.   第七条 本市依法保障公民学习和使用国家通用语言文字的权利,任何组织和个人不得限制。

 
Article 8 Putonghua shall be used as the basic spoken language in the following circumstances:   第八条 下列情形,应当以普通话为基本用语:

 
1. Spoken language used in official activities of state organs; (一)国家机关的公务活动用语;

 
2. Spoken language used in education, teaching and other collective activities in schools and other institutions of learning; (二)学校及其他教育机构的教育教学和集体活动用语;

 
3. Spoken language used in radio and TV broadcasting, hosting and interviewing, in films and television plays, as well as in Chinese audio-video products, and audio electronic publications; and (三)广播电台、电视台的播音、主持和采访用语,电影、电视剧用语,汉语文音像制品、有声电子出版物用语;

 
4. Working language used in all conferences, exhibitions and other large-scale activities held in this Municipality. (四)本市召开或者举办的各类会议、展览、大型活动的工作用语。

This Municipality shall take measures to encourage the use of Putonghua in public service trades when providing services.
 
本市应当采取措施,推动公共服务行业以普通话为服务用语。

 
Article 9 Where Putonghua shall be used as the basic spoken language according to Article 8 of these Procedures, dialects may be used under the following circumstances:
