| Chapter I General Provisions | | 第一章 总则 |

Article 1 The present Provisions are formulated according to the Law of the People's Republic of China on Administrative Licensing, the Regulation on Electric Power Supervision | | 第一条 为了加强电力业务许可证的管理，规范电力业务许可行为，维护电力市场秩序，保障电力系统安全、优质、经济运行，根据《中华人民共和国行政许可法》、《电力监管条例》和有关法律、行政法规的规定，制定本规定。 |

| Article 2 The present Provisions shall apply to the application, acceptance, examination, decision and administration of Electric Power Business Licenses. Where there is any other different provision of the state, such provision shall prevail. | | 第二条 本规定适用于电力业务许可证的申请、受理、审查、决定和管理。国家另有规定的，从其规定。 |

| Article 3 The State Electricity Regulatory Commission (hereinafter referred to as "SERC") shall take charge of issuance and administration of Electric Power Business Licenses. | | 第三条 国家电力监管委员会（以下简称电监会）负责电力业务许可证的颁发和管理。 |
The SERC shall, based on the principles of legality, openness, fairness, convenience and high-efficiency, establish an administrative system for the supervision of Electric Power Business Licenses as well as an administrative system for Electric Power Business Licenses. | |
电监会遵循依法、公开、公正、便民、高效的原则，建立电力业务许可证监督管理制度和组织管理体系。 |

| Article 4 An enterprise that undertakes any business operation of electric power within the territory of the People's Republic of China shall obtain the Electric Power Business License according to the present Provisions. Unless any other special circumstance as prescribed by the SERC, no enterprise or individual may engage in any business operation of electric power before obtaining an Electric Power Business License. | | 第四条 在中华人民共和国境内从事电力业务，应当按照本规定取得电力业务许可证。除电监会规定的特殊情况外，任何单位或者个人未取得电力业务许可证，不得从事电力业务。 |
The term "business operation of electric power" as mentioned in the present Provisions refers to such business operations as power generation, power distribution, and power supply. In particular, the business operation of power supply includes power distribution and power sale. | |
本规定所称电力业务，是指发电、输电、供电业务。其中，供电业务包括配电业务和售电业务。 |

| Article 5 An enterprise that has obtained an Electric Power Business License (hereinafter referred to as a licensee) shall enjoy the relevant rights, bear the relevant obligations and be subject to the supervision and administration of the SERC as well as the dispatched office thereof (hereinafter referred to as the electric power regulatory body) according to the provisions of the present Provisions. A licensee may carry out its business operations of electric power according to law, and shall be protected by law. | | 第五条 取得电力业务许可证的单位（以下简称被许可人）按照本规定享有权利、承担义务，接受电监会及其派出机构（以下简称电力监管机构）的监督管理。被许可人依法开展电力业务，受法律保护。 |

| Article 6 An enterprise or individual shall not forge or alter any Electric Power Business License. A licensee shall not alter, resell, lease or lend its Electric Power Business License or unlawfully transfer its Electric Power Business License by any other means. | | 第六条 任何单位和个人不得伪造、变造电力业务许可证；被许可人不得涂改、倒卖、出租、出借电力业务许可证，或者以其他形式非法转让电力业务许可。 |

| Chapter II Categories and Requirements | | 第二章 类别和条件 |
| |
|
| Article 7 The Electric Power Business License shall be divided into three categories of power generation, power distribution and power supply: | | 第七条 电力业务许可证分为发电、输电、供电三个类别。 |
An enterprise that engages in the operation of power generation shall obtain an Electric Power Business License for Power Generation. | |
从事发电业务的，应当取得发电类电力业务许可证。 |
An enterprise that engages in the operation of power distribution shall obtain an Electric Power Business License for Power Distribution. | |
从事输电业务的，应当取得输电类电力业务许可证。 |
An enterprise that engages in the operation of power supply shall obtain an Electric Power Business License for Power Supply. | |
从事供电业务的，应当取得供电类电力业务许可证。 |
An enterprise that engages in two or more business operations of electric power shall respectively obtain the corresponding two or more Electric Power Business Licenses. | |
从事两类以上电力业务的，应当分别取得两类以上电力业务许可证。 |
The measures for the administration of business operation of power distribution or power sale shall be separately provided for by the SERC. | |
从事配电或者售电业务的许可管理办法，由电监会另行规定。 |

|
| Article 8 Any of the following enterprises that undertakes the business operation of power supply shall apply for an Electric Power Business License for Power Generation: | | 第八条 下列从事发电业务的企业应当申请发电类电力业务许可证： |
| |
|
| (1) A public power plant; | | （一）公用电厂； |
| |
|
| (2) A self-prepared power plant as incorporated into a power network; and | | （二）并网运行的自备电厂； |
| |
|
| (3) Any other enterprise as prescribed by the SERC. | | （三）电监会规定的其他企业。 |
| |
|
| Article 9 Any of the following enterprises that engages in the business operation of power distribution shall apply for an Electric Power Business License for Power Distribution: | | 第九条 下列从事输电业务的企业应当申请输电类电力业务许可证： |
| |
|
| (1) A power grid enterprise that engages in any trans-regional operation; | | （一）跨区域经营的电网企业； |
| |
|
| (2) A power grid enterprise that engages in any operation across two or more provinces, autonomous regions or municipalities directly under the Central Government; | | （二）跨省、自治区、直辖市经营的电网企业； |
| |
|
| (3) A power grid enterprise of a province, autonomous region or municipality directly under the Central Government; or | | （三）省、自治区、直辖市电网企业； |
| |
|
| (4) Any other enterprise as prescribed by the SERC. | | （四）电监会规定的其他企业。 |
| |
|
| Article 10 Any of the following enterprises that engages in the business operation of power supply shall apply for an Electric Power Business License for Power Supply: | | 第十条 下列从事供电业务的企业应当申请供电类电力业务许可证： |
| |
|
| (1) A power supply enterprise of a municipality directly under the provincial government, autonomous prefecture, league or district; | | （一）省辖市、自治州、盟、地区供电企业； |
| |
|
| (2) A power supply enterprise of a county, autonomous county or county-level municipality; or | | （二）县、自治县、县级市供电企业； |
| |
|
| (3) Any other enterprise as prescribed by the SERC. | | （三）电监会规定的其他企业。 |
| |
|
| Article 11 Any enterprise that applies for an Electric Power Business License shall meet the following basic requirements: | | 第十一条 申请电力业务许可证的，应当具备下列基本条件： |
| |
|
| (1) Having the qualification of a legal person; | | （一）具有法人资格； |
| |
|
| (2) Having a financial capability that meets the requirements of electric power operation it undertakes; | | （二）具有与申请从事的电力业务相适应的财务能力； |
| |
|
| (3) The persons-in-charge of production operation, technologies, safety and finance having the relevant work experience of 3 years or more concerning the electric power operations that the enterprise has applied for undertaking, and having the qualification for assuming their professional posts at the intermediate level or above or the certificates of passing the post-related trainings; or | | （三）生产运行负责人、技术负责人、安全负责人和财务负责人具有3年以上与申请从事的电力业务相适应的工作经历，具有中级以上专业技术任职资格或者岗位培训合格证书； |
| |
|
| (4) Meeting any other requirement as prescribed by any law or regulation. | | （四）法律、法规规定的其他条件。 |
| |
|
| Article 12 Any enterprise that applies for an Electric Power Business License for Power Generation shall not only meet the basic requirements as prescribed by Article 11 of the present Provisions but also meet the following requirements: | | 第十二条 申请发电类电力业务许可证的，除具备本规定第十一条所列基本条件外，还应当具备下列条件： |

|
| (1) The construction of its power generation project having passed the examination and approval or verification of the relevant administrative department; | | （一）发电项目建设经有关主管部门审批或者核准； |
| |
|
| (2) Its power generation facilities having the capability of power generation; and | | （二）发电设施具备发电运行的能力； |
| |
|
| (3) Its power generation project meeting the relevant provisions on and requirements of environmental protection. | | （三）发电项目符合环境保护的有关规定和要求。 |
| |
|
| Article 13 Any enterprise that applies for an Electric Power Business License for Power Distribution shall not only meet the basic requirements as prescribed by Article 11 of the present Provisions but also meet the following requirements: | | 第十三条 申请输电类电力业务许可证的，除具备本规定第十一条所列基本条件外，还应当具备下列条件： |

|
| (1) The construction of its power distribution project having passed the examination and approval or verification of the relevant administrative department; | | （一）输电项目建设经有关主管部门审批或者核准； |
| |
|
| (2) Having a power transmission network that meets the requirements of the power distribution operation it has applied for undertaking; | | （二）具有与申请从事的输电业务相适应的输电网络； |
| |
|
| (3) Its power distribution project having passed the completion-based inspection and acceptance conducted according to the relevant provisions; and | | （三）输电项目按照有关规定通过竣工验收； |
| |
|
| (4) Its power distribution project meeting the relevant provisions on and requirements of environmental protection. | | （四）输电项目符合环境保护的有关规定和要求。 |
| |
|
| Article 14 Any enterprise that applies for an Electric Power Business License for Power Supply shall not only meet the basic requirements as prescribed by Article 11 of the present Provisions but also meet the following requirements: | | 第十四条 申请供电类电力业务许可证的，除具备本规定第十一条所列基本条件外，还应当具备下列条件： |

| (1) Having a business area for power supply that has been approved by the relevant administrative department; | | （一）具有经有关主管部门批准的供电营业区； |
| |
|
| (2) Having a power supply network as well as business networks that meet the requirements of the operations of power supply it applies for undertaking; | | （二）具有与申请从事供电业务相适应的供电网络和营业网点； |
| |
|
| (3) Having promised to perform the general social obligations of electric power services; | | （三）承诺履行电力社会普遍服务义务； |
| |
|
| (4) Its power supply project meeting the relevant provisions on and requirements of environmental protection. | | （四）供电项目符合环境保护的有关规定和要求。 |
| |
|
| Chapter III Application and Acceptance | | 第三章 申请和受理 |
| |
|
| Article 15 An application for the Electric Power Business License shall be filed with the SERC and the relevant application materials shall be submitted according to the requirements of relevant provisions. | | 第十五条 申请电力业务许可证，应当向电监会提出，并按照规定的要求提交申请材料。 |
| |
|
| Article 16 For an enterprise as prescribed in Articles 8 through 10 of the present provisions with the status of a legal person, the very enterprise may file an application. As to an enterprise without the status of a legal person, the legal-person enterprise thereof may file an application according to their relationship of subjection. | | 第十六条 本规定第八条、第九条、第十条所列企业，具有法人资格的，由本企业提出申请；不具有法人资格的，按照隶属关系由其法人企业提出申请。 |

| Article 17 An enterprise that applies for an Electric Power Business License shall submit the following materials: | | 第十七条 申请电力业务许可证的，应当提供下列材料： |
| |
|
| (1) An Application Form for the Electric Power Business License as subscribed by its legal representative; | | （一）法定代表人签署的许可证申请表； |
| |
|
(2) A duplicate as well as the photocopy of the business license of the legal person;
