On June 21, 2019, the National Development and Reform Commission issued the Notice of Strengthening the Administration of the Investment and Construction of Public-Private Partnership (PPP) Projects According to Laws and Regulations, effective from July 1, 2019.
The Notice requires the comprehensive and profound implementation of feasibility demonstration and examination of PPP projects, the performance of project decision-making procedures in strict accordance with laws and regulations, the strict plan examination and legal selection of public capital, the strict implementation of provisions of the State Council on the capital system for fixed-asset investment projects, the legal inclusion of all PPP projects in the national supervision platform for online approval of investment projects for unified management, and the enhanced supervision of PPP projects and resolute punishment of violations and dishonesty.
In addition, the Notice requires development and reform departments at all levels to accelerate the improvement of the system for managing local PPP projects so as to ensure consistency with the superior law in strict accordance with the provisions of the Regulation on Government Investment and the Regulation on the Administration of the Confirmation and Recordation of Enterprise Investment Projects and the requirements of this Notice.
