The Measures for the Administration of Conclusion of Treaties, as adopted at the executive meeting of the State Council, are hereby issued, and shall come into force on January 1, 2023. 《缔结条约管理办法》已经国务院常务会议通过,现予公布,自2023年1月1日起施行。

Measures for the Administration of Conclusion of Treaties 缔结条约管理办法
Article 1 For the purposes of regulating the working procedures for the conclusion of treaties and strengthening the management of the affairs concerning the conclusion of treaties, these Measures are formulated in accordance with the Law of the People's Republic of China on the Procedure of the Conclusion of Treaties (hereinafter referred to as the "Law on the Procedure of the Conclusion of Treaties") and other relevant laws.   第一条 为了规范缔结条约工作程序,加强对缔结条约事务的管理,根据《中华人民共和国缔结条约程序法》(以下简称缔约程序法)和有关法律规定,制定本办法。
Article 2 Where the State Council or the relevant departments of the State Council conclude treaties, agreements, and other documents of a treaty or agreement nature (hereinafter collectively referred to as "treaties"), and handle relevant affairs, these Measures shall apply.   第二条 国务院或者国务院有关部门缔结条约、协定和其他具有条约、协定性质的文件(以下统称条约),办理相关事务,适用本办法。
Article 3 The Ministry of Foreign Affairs shall, under the leadership of the State Council, manage the specific affairs concerning the conclusion of treaties, and instruct and urge the relevant departments of the State Council to handle the work related to the conclusion of treaties in accordance with statutory procedures.   第三条 外交部在国务院领导下管理缔结条约的具体事务,指导、督促国务院有关部门依照法定程序办理缔结条约工作。
The relevant departments of the State Council shall be responsible for handling the work related to the conclusion of treaties within their respective purview. 国务院有关部门在各自职权范围内负责办理缔结条约的相关工作。
Article 4 Unless otherwise authorized by the Constitution, laws, and the State Council of the People's Republic of China, local governments at all levels shall have no right to conclude treaties.   第四条 除中华人民共和国宪法、法律和国务院另有授权外,地方各级政府无权缔结条约。
Article 5 The following treaties, unless otherwise provided by law, shall be concluded in the name of the People's Republic of China:   第五条 下列条约,除法律另有规定外,应当以中华人民共和国名义缔结:
(1) Friendship and cooperation treaties, peace treaties, and other political treaties. (一)友好合作条约、和平条约等政治性条约;
(2) Treaties on territory and establishing borders, including treaties on establishing land and maritime borders. (二)有关领土和划定边界的条约,包括划定陆地边界和海域边界的条约;
(3) Treaties on judicial cooperation, including treaties on judicial assistance, extradition, transfer of sentenced persons, and recognition and enforcement of foreign court judgments or arbitral awards. (三)有关司法合作的条约,包括司法协助、引渡、被判刑人移管、承认与执行外国法院判决或者仲裁裁决的条约;
(4) Other treaties involving major national interests. (四)其他涉及重大国家利益的条约。
Under special circumstances, upon review and decision by the State Council, the treaties listed in the preceding paragraph may be concluded in the name of the Government of the People's Republic of China. 特殊情况下,经国务院审核决定,前款所列条约可以中华人民共和国政府名义缔结。
Article 6 The following treaties shall be concluded in the name of the Government of the People's Republic of China:   第六条 下列条约,应当以中华人民共和国政府名义缔结:
(1) Treaties related to the purview of the State Council. (一)涉及国务院职权范围的条约;
(2) Treaties related to purview of not less than two relevant departments of the State Council. (二)涉及两个以上国务院有关部门职权范围的条约;
(3) Other treaties required to be concluded in the name of the Government of the People's Republic of China. (三)其他需要以中华人民共和国政府名义缔结的条约。
Under special circumstances, upon review and decision by the State Council, the treaties listed in the preceding paragraph may be concluded in the name of a government department of the People's Republic of China. 特殊情况下,经国务院审核决定,前款所列条约可以中华人民共和国政府部门名义缔结。
Article 7 All the ministries and committees of the State Council, the People's Bank of China, the National Audit Office, institutions directly under the State Council with administrative functions, and other institutions of the State Council that undertake administrative functions in accordance with the law or under the authority of the State Council may conclude treaties on matters within their respective purview in the name of the government departments of the People's Republic of China.   第七条 国务院各部、委员会、中国人民银行、审计署、具有行政管理职能的直属机构、根据法律规定或者国务院授权承担行政管理职能的国务院其他机构,可以就本部门职权范围内的事项,以中华人民共和国政府部门名义缔结条约。
Article 8 Where the content of a treaty involves major national interests in politics, diplomacy, economy, society, security, or any other field, the draft treaty and the major issues involved in the draft treaty shall be reported to the CPC Central Committee in accordance with relevant provisions.   第八条 条约内容涉及政治、外交、经济、社会、安全等领域重大国家利益的,应当将条约草案及条约草案涉及的重大问题按照有关规定报告党中央。
Article 9 If a treaty is negotiated in the name of the People's Republic of China or the Government of the People's Republic of China, the Ministry of Foreign Affairs, or the relevant departments of the State Council in conjunction with the Ministry of Foreign Affairs, shall make a submission to the State Council for decision not less than 20 working days before commencement of the negotiation.   第九条 以中华人民共和国名义或者中华人民共和国政府名义谈判条约的,由外交部或者国务院有关部门会同外交部在启动谈判前不少于20个工作日报请国务院决定。
Article 10 When a treaty is negotiated in the name of a government department of the People's Republic of China under any of the following circumstances, the relevant departments of the State Council shall, in conjunction with the Ministry of Foreign Affairs, make a submission to the State Council for decision not less than 20 working days before commencement of the negotiation:   第十条 以中华人民共和国政府部门名义谈判条约,有下列情形之一的,由国务院有关部门会同外交部在启动谈判前不少于20个工作日报请国务院决定:
(1) The content of the treaty involves major national interests in the fields of diplomacy, economy, and security, among others. (一)条约内容涉及外交、经济、安全等领域的重大国家利益;
(2) The content of the treaty involves the purview of another department of the State Council. (二)条约内容涉及国务院其他部门职权范围;
(3) Other circumstances under which a submission shall be made to the State Council for decision. (三)其他应当报请国务院决定的情形。
Article 11 Where during the negotiation of a treaty, modifications to Chinese draft of the treaty that has been decided by the State Council fall under any of the following circumstances, a submission shall be made again to the State Council for decision:   第十一条 条约谈判中,对经国务院决定的条约中方草案所作改动有下列情形之一的,应当重新报请国务院决定:
(1) Having a significant impact on the rights enjoyed or the obligations assumed by the People's Republic of China in accordance with the treaty. (一)对中华人民共和国依据该条约享有的权利或者承担的义务有重大影响;
(2) Having an impact on the position of the People's Republic of China on relevant major issues. (二)对中华人民共和国在有关重大问题上的立场有影响;
(3) Being inconsistent with the laws and administrative regulations of the People's Republic of China or the international obligations assumed by the People's Republic of China in accordance with another treaty. (三)与中华人民共和国法律、行政法规或者中华人民共和国依据其他条约承担的国际义务不一致;
(4) Other circumstances under which a submission shall be made to the State Council for decision. (四)其他应当报请国务院决定的情形。
Article 12 If a treaty is signed in the name of the People's Republic of China or the Government of the People's Republic of China, or under any of the circumstances specified in Article 10 of these Measures, the Ministry of Foreign Affairs, or the relevant departments of the State Council in conjunction with the Ministry of Foreign Affairs, shall make a submission to the State Council for decision not less than ten working days before the signing.   第十二条 以中华人民共和国名义或者中华人民共和国政府名义签署条约,或者有本办法第十条规定情形之一的,应当由外交部或者国务院有关部门会同外交部在签署前不少于10个工作日报请国务院决定。
If a decision fails to be requested within the period specified in the preceding paragraph under special circumstances, the reasons shall be explained to the State Council. 确因特殊情况未按前款规定时限报批的,应当向国务院说明理由。
Article 13 Before a treaty is signed, the legal affairs bodies of the relevant departments of the State Council shall examine the treaty from a legal perspective.   第十三条 条约签署前,国务院有关部门法制机构应当从法律角度对条约进行审查。
If a treaty signed in the name of the People's Republic of China or the Government of the People's Republic of China, which shall be submitted to the State Council for examination with a proposal for submission to the Standing Committee of the National People's Congress for decision on ratification or accession, or submitted to the State Council for approval or decision to accede or accept, in accordance with the Law on the Procedure of the Conclusion of Treaties or relevant provisions, contains content inconsistent with the laws and administrative regulations of the People's Republic of China or the international obligations assumed by the People's Republic of China in accordance with another treaty, the relevant departments of the State Council shall seek comments from the Ministry of Justice not less than 30 working days before the signing of the treaty. 以中华人民共和国名义或者中华人民共和国政府名义签署,且根据缔约程序法或者有关规定应当报请国务院审核并建议提请全国人民代表大会常务委员会决定批准或者加入,或者报请国务院核准、决定加入或者接受的条约,内容与中华人民共和国法律、行政法规或者与中华人民共和国依据其他条约承担的国际义务不一致的,国务院有关部门应当在条约签署前不少于30个工作日征求司法部的意见。
Article 14 The relevant departments of the State Council shall explain the following in a request for instructions for signing a treaty:   第十四条 下列情形,国务院有关部门应当在签署条约的请示中予以说明:
(1) Whether the content of the treaty to be signed is consistent with the laws and administrative regulations of the People's Republic of China or the international obligations assumed by the People's Republic of China in accordance with another treaty; if there is any inconsistency, a solution shall be proposed; the comments of the Ministry of Justice which shall be requested according to Article 13 of these Provisions shall also be attached. (一)拟签署的条约内容与中华人民共和国法律、行政法规或者与中华人民共和国依据其他条约承担的国际义务是否一致;有不一致的,应当提出解决方案;根据本办法第十三条规定应当征求司法部意见的,还应当附司法部的意见;
(2) Whether comments on the treaty to be signed are required to be requested from the Government of Hong Kong Special Administrative Region and the Government of the Macao Special Administrative Region and the circumstances of the request for comments.
