The Regulation on Emergency Responses to Work Safety Accidents, as adopted at the 33rd executive meeting of the State Council on December 5, 2018, is hereby issued, and shall come into force on April 1, 2019. 《生产安全事故应急条例》已经2018年12月5日国务院第33次常务会议通过,现予公布,自2019年4月1日起施行。

Regulation on Emergency Responses to Work Safety Accidents 生产安全事故应急条例
Chapter I General Provisions 

第一章 总  则

 
Article 1 For the purposes of regulating emergency responses to work safety accidents, and guaranteeing the safety of the people's life and property, this Regulation is developed in accordance with the Work Safety Law of the People's Republic of China and the Emergency Response Law of the People's Republic of China.   第一条 为了规范生产安全事故应急工作,保障人民群众生命和财产安全,根据《中华人民共和国安全生产法》和《中华人民共和国突发事件应对法》,制定本条例。
Article 2 This Regulation shall apply to emergency responses to work safety accidents, except as otherwise provided for by any law or administrative regulation.   第二条 本条例适用于生产安全事故应急工作;法律、行政法规另有规定的,适用其规定。
Article 3 The State Council shall lead emergency responses to work safety accidents nationwide in a unified manner, and the local people's governments at or above the county level shall lead emergency responses to work safety accidents within their respective administrative regions in a unified manner. Where any emergency response to a work safety accident involves two or more administrative regions, the common people's government at the next higher level of the relevant administrative regions shall be responsible for the work, or the people's governments at the next higher level of the relevant administrative regions shall be jointly responsible for the work.   第三条 国务院统一领导全国的生产安全事故应急工作,县级以上地方人民政府统一领导本行政区域内的生产安全事故应急工作。生产安全事故应急工作涉及两个以上行政区域的,由有关行政区域共同的上一级人民政府负责,或者由各有关行政区域的上一级人民政府共同负责。
The emergency management departments of the people's governments at or above the county level and other departments that supervise and administer the work safety in relevant industries and fields (hereinafter collectively referred to as “departments assuming the functions of work safety supervision and administration”) shall, within the scope of their respective functions, effectively conduct emergency responses to work safety accidents in relevant industries and fields. 县级以上人民政府应急管理部门和其他对有关行业、领域的安全生产工作实施监督管理的部门(以下统称负有安全生产监督管理职责的部门)在各自职责范围内,做好有关行业、领域的生产安全事故应急工作。
The emergency management departments of the people's governments at or above the county level shall guide and coordinate with the emergency responses to work safety accidents of other departments assuming the functions of work safety supervision and administration of the people's governments at the same level and the people's governments at lower levels. 县级以上人民政府应急管理部门指导、协调本级人民政府其他负有安全生产监督管理职责的部门和下级人民政府的生产安全事故应急工作。
The people's governments of townships and towns and the dispatched offices of the local people's governments such as sub-district offices shall assist the relevant departments of the people's governments at higher levels in performing their duties of emergency responses to work safety accidents according to the law. 乡、镇人民政府以及街道办事处等地方人民政府派出机关应当协助上级人民政府有关部门依法履行生产安全事故应急工作职责。
Article 4 Production and business entities shall enhance emergency responses to work safety accidents, and establish and improve the responsibility system for emergency responses to work safety accidents, and their primary persons in charge shall be fully responsible for their emergency responses to work safety accidents.   第四条 生产经营单位应当加强生产安全事故应急工作,建立、健全生产安全事故应急工作责任制,其主要负责人对本单位的生产安全事故应急工作全面负责。
Chapter II Emergency Preparedness 

第二章 应急准备

 
Article 5 The people's governments at or above the county level and their departments assuming the functions of work safety supervision and administration, the people's governments of townships and towns and the dispatched offices of the local people's governments such as sub-district offices shall, with respect to the characteristics and hazards of the work safety accidents that may occur, conduct risk identification and assessment, develop the corresponding emergency rescue plans for work safety accidents, and issue them to the public according to the law.   第五条 县级以上人民政府及其负有安全生产监督管理职责的部门和乡、镇人民政府以及街道办事处等地方人民政府派出机关,应当针对可能发生的生产安全事故的特点和危害,进行风险辨识和评估,制定相应的生产安全事故应急救援预案,并依法向社会公布。
Production and business entities shall, with respect to the characteristics and hazards of the work safety accidents that may occur in these entities, conduct risk identification and assessment, develop corresponding emergency rescue plans for work safety accidents, and issue them to the employees of these entities. 生产经营单位应当针对本单位可能发生的生产安全事故的特点和危害,进行风险辨识和评估,制定相应的生产安全事故应急救援预案,并向本单位从业人员公布。
Article 6 Emergency rescue plans for work safety accidents shall comply with relevant laws, regulations, rules and standards, be scientific, pertinent and operable, and expressly provide the emergency organization system, division of functions and emergency rescue procedures and measures.   第六条 生产安全事故应急救援预案应当符合有关法律、法规、规章和标准的规定,具有科学性、针对性和可操作性,明确规定应急组织体系、职责分工以及应急救援程序和措施。
Under any of the following circumstances, the entities developing the emergency rescue plans for work safety accidents shall revise relevant plans in a timely manner: 有下列情形之一的,生产安全事故应急救援预案制定单位应当及时修订相关预案:
(1) The laws, regulations, rules and standards based on which the plans are developed have changed significantly. (一)制定预案所依据的法律、法规、规章、标准发生重大变化;
(2) Adjustments have been made to emergency command institutions or their functions. (二)应急指挥机构及其职责发生调整;
(3) Risks facing work safety have changed significantly. (三)安全生产面临的风险发生重大变化;
(4) Important emergency resources have changed significantly. (四)重要应急资源发生重大变化;
(5) Major issues requiring plan revisions are found in plan drills or emergency rescues. (五)在预案演练或者应急救援中发现需要修订预案的重大问题;
(6) Other circumstances under which the relevant plans shall be revised. (六)其他应当修订的情形。
Article 7 The departments assuming the functions of work safety supervision and administration of the people's governments at or above the county level shall submit the emergency rescue plans for work safety accidents they develop to the people's governments at the same level for recordation; the production, distribution, storage and transportation entities of flammables and explosives, hazardous chemicals and other dangerous goods, mining, metal smelting, urban rail transit operation and construction entities, as well as business entities of densely populated places such as hotels, shopping malls, entertainment venues and tourist attractions shall submit under the relevant provisions issued by the state the emergency rescue plans for work safety accidents they develop to the departments assuming the functions of work safety supervision and administration of the people's governments at or above the county level for recordation, and publish them according to the law.   第七条 县级以上人民政府负有安全生产监督管理职责的部门应当将其制定的生产安全事故应急救援预案报送本级人民政府备案;易燃易爆物品、危险化学品等危险物品的生产、经营、储存、运输单位,矿山、金属冶炼、城市轨道交通运营、建筑施工单位,以及宾馆、商场、娱乐场所、旅游景区等人员密集场所经营单位,应当将其制定的生产安全事故应急救援预案按照国家有关规定报送县级以上人民政府负有安全生产监督管理职责的部门备案,并依法向社会公布。
Article 8 The local people's governments at or above the county level and the departments assuming the functions of work safety supervision and administration of the people's governments at or above the county level, and the people's governments of townships and towns and the dispatched offices of local people's governments such as sub-district offices shall organize drills of emergency rescue plans for work safety accidents at least once every two years.   第八条 县级以上地方人民政府以及县级以上人民政府负有安全生产监督管理职责的部门,乡、镇人民政府以及街道办事处等地方人民政府派出机关,应当至少每2年组织1次生产安全事故应急救援预案演练。
The production, distribution, storage and transportation entities of flammables and explosives, hazardous chemicals and other dangerous goods, mining, metal smelting, urban rail transit operation and construction entities, as well as business entities of densely populated places such as hotels, shopping malls, entertainment venues and tourist attractions shall organize drills of emergency rescue plans for work safety accidents at least once every half a year, and submit the drill information to the departments assuming the functions of work safety supervision and administration of the local people's governments at or above the county level at the places where they are located. 易燃易爆物品、危险化学品等危险物品的生产、经营、储存、运输单位,矿山、金属冶炼、城市轨道交通运营、建筑施工单位,以及宾馆、商场、娱乐场所、旅游景区等人员密集场所经营单位,应当至少每半年组织1次生产安全事故应急救援预案演练,并将演练情况报送所在地县级以上地方人民政府负有安全生产监督管理职责的部门。
The departments assuming the functions of work safety supervision and administration of the local people's governments at or above the county level shall conduct random inspections of the drills of the emergency rescue plans for work safety accidents of key production and business entities as prescribed in the preceding paragraph within their respective administrative regions; and, if finding any drills fail to meet the requirements, order relevant entities to take corrective actions during specified periods. 县级以上地方人民政府负有安全生产监督管理职责的部门应当对本行政区域内前款规定的重点生产经营单位的生产安全事故应急救援预案演练进行抽查;发现演练不符合要求的,应当责令限期改正。
Article 9 The people's governments at or above the county level shall strengthen the unified planning for and organization and guidance of the building of emergency rescue teams for work safety accidents.   第九条 县级以上人民政府应当加强对生产安全事故应急救援队伍建设的统一规划、组织和指导。
The departments assuming the functions of work safety supervision and administration of the people's governments at or above the county level shall, based on the actual needs of emergency responses to work safety accidents, establish separately or jointly with the production and business entities and social organizations with good conditions in key industries and fields. 县级以上人民政府负有安全生产监督管理职责的部门根据生产安全事故应急工作的实际需要,在重点行业、领域单独建立或者依托有条件的生产经营单位、社会组织共同建立应急救援队伍。
The state shall encourage and support production and business entities and other social forces' building of the emergency rescue teams that provide social emergency rescue services. 国家鼓励和支持生产经营单位和其他社会力量建立提供社会化应急救援服务的应急救援队伍。
Article 10 The production, distribution, storage and transportation entities of flammables and explosives, hazardous chemicals and other dangerous goods, mining, metal smelting, urban rail transit operation and construction entities, as well as business entities of densely populated places such as hotels, shopping malls, entertainment venues, tourist attractions shall establish emergency rescue teams; micro and small enterprises and other production and business entities with relatively small scales may have no emergency rescue team, but shall designate part-time emergency rescue personnel, and can sign emergency rescue agreements with the emergency rescue teams nearby.   第十条 易燃易爆物品、危险化学品等危险物品的生产、经营、储存、运输单位,矿山、金属冶炼、城市轨道交通运营、建筑施工单位,以及宾馆、商场、娱乐场所、旅游景区等人员密集场所经营单位,应当建立应急救援队伍;其中,小型企业或者微型企业等规模较小的生产经营单位,可以不建立应急救援队伍,但应当指定兼职的应急救援人员,并且可以与邻近的应急救援队伍签订应急救援协议。
