The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
Over recent years, the collaborative development of e-commerce and express delivery logistics in China has continuously been deepened, boosting the transformation, upgrading, and quality and efficiency improvement of express delivery logistics and furthering the rapid development of e-commerce. Nevertheless, the collaborative development of e-commerce and express delivery logistics remains challenged by an incomplete system of policies and regulations, non-coordinated development, non-smooth transition, and other problems. For purposes of fully implementing the spirit of the 19th CPC National Congress, carrying out in depth the Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, executing the new development concept, putting into action the "Internet plus circulation" action plan in depth, and improving the level of collaborative development of e-commerce and express delivery logistics, with the approval of the State Council, the following opinions are hereby offered. 近年来,我国电子商务与快递物流协同发展不断加深,推进了快递物流转型升级、提质增效,促进了电子商务快速发展。但是,电子商务与快递物流协同发展仍面临政策法规体系不完善、发展不协调、衔接不顺畅等问题。为全面贯彻党的十九大精神,深入贯彻落实习近平新时代中国特色社会主义思想,落实新发展理念,深入实施“互联网+流通”行动计划,提高电子商务与快递物流协同发展水平,经国务院同意,现提出以下意见。
I. Enhancing innovation on rules and optimizing the policy and regulation environment for collaborative development   一、强化制度创新,优化协同发展政策法规环境
1. Deepening the reform of simplification of administrative procedures, combination of decentralization and control, and optimization of services. The licensing procedures for express delivery business and operations shall be simplified, the rules for annual reporting by express delivery enterprises shall be reformed, and recordation administration of end express delivery outlets shall be implemented. The licensing administration information system of express delivery business and operations shall be optimized and improved, and the unified online processing of licensing and recordation matters shall be effected. Interim and ex-post regulation shall be strengthened, and the regulation of randomly selected entities by randomly selected regulators and the public disclosure of regulation results shall be comprehensively promoted. (The State Postal Bureau shall be responsible) (一)深化“放管服”改革。简化快递业务经营许可程序,改革快递企业年度报告制度,实施快递末端网点备案管理。优化完善快递业务经营许可管理信息系统,实现许可备案事项网上统一办理。加强事中事后监管,全面推行“双随机、一公开”监管。(国家邮政局负责)
2. Innovating on industry support policies. The manners of price regulation shall be innovated on, e-commerce platforms shall be guided in gradually separating commodity pricing from express delivery service pricing, and express delivery enterprises shall be promoted in developing value-added services oriented to consumers. (The National Development and Reform Commission, the Ministry of Commerce, and the State Postal Bureau shall be responsible) The administrative manners of public service facilities shall be innovated on, the public nature of intelligent express package boxes and consolidated end express delivery service venues shall be specified, and guarantee for land use and other supporting policies shall be provided for professional, public, platform-based, and intensive end express delivery service outlets. (The Ministry of Land and Resources, the Ministry of Housing and Urban-Rural Development, and the State Postal Bureau shall be responsible) (二)创新产业支持政策。创新价格监管方式,引导电子商务平台逐步实现商品定价与快递服务定价相分离,促进快递企业发展面向消费者的增值服务。(国家发展改革委、商务部、国家邮政局负责)创新公共服务设施管理方式,明确智能快件箱、快递末端综合服务场所的公共属性,为专业化、公共化、平台化、集约化的快递末端网点提供用地保障等配套政策。(国土资源部、住房城乡建设部、国家邮政局负责)
3. Improving the rules for data sharing among enterprises. The rules for protection, openness and sharing of data on e-commerce and express delivery logistics shall be improved, and data discontinuance and other risk assessment, advance notice and advance reporting rules shall be developed. On the premise of ensuring the safety of consumers' personal information, e-commerce platforms and logistics enterprises shall be encouraged to exchange and share data and given guidance so as to jointly raise delivery efficiency. (The Ministry of Commerce and the State Postal Bureau shall be responsible in conjunction with the relevant authorities) (三)健全企业间数据共享制度。完善电子商务与快递物流数据保护、开放共享规则,建立数据中断等风险评估、提前通知和事先报告制度。在确保消费者个人信息安全的前提下,鼓励和引导电子商务平台与快递物流企业之间开展数据交换共享,共同提升配送效率。(商务部、国家邮政局会同相关部门负责)
4. Improving the administrative manner of collaborative and joint governance. The self-regulation role of industry associations shall be used, the issuance of industry self-regulation conventions shall be promoted, the primary responsibility of enterprises shall be enhanced, and the signature of self-regulation undertakings shall be encouraged, so as to promote the sound development of the industry. E-commerce, logistics, express delivery, and other platform-type enterprises shall be guided in improving platform service agreements, trading rules and credit rating rules to practically maintain the order of fair competition and protect consumer rights and interests; the openness of data, technology and other resources shall be encouraged, and upstream and downstream micro, small and medium-sized enterprises shall be empowered to achieve openness, cooperation and reciprocity among industries and enterprises. (The Ministry of Commerce, the Ministry of Transport, and the State Postal Bureau shall be responsible in conjunction with the relevant authorities) (四)健全协同共治管理模式。发挥行业协会自律作用,推动出台行业自律公约,强化企业主体责任,鼓励签署自律承诺书,促进行业健康发展。引导电子商务、物流和快递等平台型企业健全平台服务协议、交易规则和信用评价制度,切实维护公平竞争秩序,保护消费者权益;鼓励开放数据、技术等资源,赋能上下游中小微企业,实现行业间、企业间开放合作、互利共赢。(商务部、交通运输部、国家邮政局会同相关部门负责)
II. Enhancing plan guidance and improving the infrastructures of e-commerce and express delivery logistics   二、强化规划引领,完善电子商务快递物流基础设施
5. Strengthening collaborative planning guidance. Region and location, function orientation, development level and other factors shall be comprehensively taken into consideration, and the development of e-commerce and express delivery and logistics shall be planned in an overall manner. Based on the characteristics of e-commerce including all channels, multiple platforms, and online and offline integration, the construction of infrastructure of express delivery and logistics shall be scientifically guided, and an express delivery logistics service system suitable for e-commerce development shall be developed. The land used for storage, distribution, delivery and other facilities relating to express delivery logistics must conform to the overall land utilization plans and be included in the urban and rural plans, and intelligent express package boxes and consolidated end express delivery service venues shall be included in the plans relating to public service facilities. The effective connection between and unified management of the relevant plans shall be reinforced. (All the provincial people's governments, the Ministry of Land and Resources, and the Ministry of Housing and Urban-Rural Development shall be responsible) (五)加强规划协同引领。综合考虑地域区位、功能定位、发展水平等因素,统筹规划电子商务与快递物流发展。针对电子商务全渠道、多平台、线上线下融合等特点,科学引导快递物流基础设施建设,构建适应电子商务发展的快递物流服务体系。快递物流相关仓储、分拨、配送等设施用地须符合土地利用总体规划并纳入城乡规划,将智能快件箱、快递末端综合服务场所纳入公共服务设施相关规划。加强相关规划间的有效衔接和统一管理。(各省级人民政府、国土资源部、住房城乡建设部负责)
6. Guaranteeing land used for infrastructure construction. Existing relevant land use policies shall be effectively implemented to guarantee the land used for the construction of infrastructures for e-commerce and express delivery logistics. On the premise of non-alteration of land users and planned conditions, if existing buildings and land resources are used to construct e-commerce and express delivery logistics projects, the original purpose and right type of the land may remain unchanged within five years, and if relevant land use formalities are required upon expiry of the period, transaction may be conducted by agreement. (All the provincial people's governments and the Ministry of Land and Resources shall be responsible) (六)保障基础设施建设用地。落实好现有相关用地政策,保障电子商务快递物流基础设施建设用地。在不改变用地主体、规划条件的前提下,利用存量房产和土地资源建设电子商务快递物流项目的,可在5年内保持土地原用途和权利类型不变,5年期满后需办理相关用地手续的,可采取协议方式办理。(各省级人民政府、国土资源部负责)
