| Recently, certain local courts failed to clarify the responsibility of safety risk management when seizing the property of chemical enterprises, resulting in serious hidden dangers. For the purposes of preventing and reducing production accidents, and protecting the life and property of the general public, the issues of strengthening safety supervision on hazardous subject matter in property preservation and enforcement of judgment are hereby notified as follows. | | 近日，个别地方法院在对化工类企业财产采取查封措施的过程中，未明确安全风险管理责任，产生重大安全隐患。为防止和减少安全生产事故，保障人民群众生命和财产安全，现就在财产保全和执行工作中强化安全监管问题通知如下。 |
| I. During property preservation and enforcement of judgment, the people's court shall generally not take preservation measure for such subject matter as hazardous goods or major sources of danger or enforce them if there is any other property more suitable for preservation or enforcement. | | 一、在财产保全和执行程序中，如有其他更适宜的财产可以保全或执行，人民法院一般不对危险物品、重大危险源等标的物采取保全或执行措施。 |
| Hazardous goods mean inflammables, explosives, hazardous chemicals, radioactive substances, and other articles that may endanger the safety of life and property. | | 危险物品，是指易燃易爆物品、危险化学品、放射性物品等能够危及人身安全和财产安全的物品。 |
| Major sources of danger mean units (including sites and facilities) that produce, transport, use, or store, either permanently or temporarily, hazardous goods in quantities which are equal to or exceed the threshold value. | | 重大危险源，是指长期地或者临时地生产、搬运、使用或者储存危险物品，且危险物品的数量等于或者超过临界量的单元（包括场所和设施）。 |
II. The people's court shall conduct on-site inspection of the subject matter of preservation or enforcement for the suspected hazardous goods or major sources of danger, collect information from such entities as the work safety supervision and administration department and the production and business operation entity, and identify the danger and other features of the subject matter.
