[Basic Facts] 基本案情
The collision between “Lipeng 1” owned by Xiamen Lipeng Shipping Co., Ltd. (hereinafter referred to as “Lipeng Company”) and “Bihuashan” owned by China Shipping Development Co., Ltd. Tramp Company (hereinafter referred to “China Shipping Company”) occurred, which caused right deviation of the hull of “Lipeng 1.” Afterwards, containers in the cabin collapsed due to improper securing, in which way the degree of right deviation of “Lipeng 1” increased constantly. In addition to being pushed by the towboat to the shallow water aground from the left, “Lipeng 1” was finally sunk. In the investigation report issued by the maritime sector, it was determined that “Bihuashan” and “Lipeng 1” should assume the principal and secondary liabilities for the collision accident. Lipeng Company and the hull underwriter of “Lipeng 1” filed this lawsuit and requested the Xiamen Maritime Court to order that “Bihuashan” should assume 80% of accident compensation liability and they enjoy priority of payment from the liability limitation funds for maritime claims of “Bihuashan.” China Shipping Company contended that the collision accident was not the primary cause for the sinking of “Lipeng 1”; instead, the structure defect of the ship, improper stowage, improper securing of goods, and operation errors of crew in controlling the ballast water were primary causes. Therefore, “Lipeng 1” should assume 70% of liability for collision and “Bihuashan” assume no liability for losses caused by the sinking of “Lipeng 1.” China Shipping Company raised a counterclaim and requested the Higher People's Court of Fujian Province to order that Lipeng Company should compensate for its losses and it should enjoy the payment from the liability limitation funds for maritime claims of “Lipeng 1.” 力鹏公司所属“力鹏1”轮与中海公司所属“碧华山”轮发生碰撞,造成“力鹏1”轮船体右倾,之后因舱内集装箱系固不当发生倒塌,致使“力鹏1”轮右倾角度不断增大,加之被拖轮从左侧顶推往浅水区坐浅,最终导致沉没。海事部门作出调查报告认定“碧华山”轮与“力鹏1”轮对碰撞事故分别承担事故主次责任。力鹏公司及“力鹏1”轮船舶保险人提起本案诉讼,请求判令“碧华山”轮承担80%的事故赔偿责任,并从“碧华山”轮海事赔偿责任限制基金中优先受偿等。中海公司抗辩认为,“力鹏1”轮沉没的最主要原因不是碰撞事故,而是该轮船舶结构缺陷、积载不当、货物系固不当、船员打压载水时操作错误等原因,故“力鹏1”轮应承担70%碰撞责任,“碧华山”轮对“力鹏1”轮沉没导致的损失不承担责任。中海公司反诉请求判令力鹏公司赔偿损失并从“力鹏1”轮海事赔偿责任限制基金中受偿。
