[Basic Facts] 基本案情
Guangdong Branch of Ping An Property Insurance Company of China (hereinafter referred to as “Ping An Insurance Company”) covered the vehicle under the name of Wang Sizheng. During the period of insurance, due to alcohol drinking, Wang Sizheng could not drive. Therefore, through the online platform of “edaijia” he requested paid driving service from Beijing Yixin Yixing Automotive Technical Development Service Co., Ltd. (hereinafter referred to as “Yixin Company”). Upon receipt of the request, Yixin Company assigned Wu Chuntian to offer driving services. Wang Sizheng signed an Agreement on Entrusted Driving Services provided by Wu Chuntian. In the agreement, Wang Sizheng affixed his signature in the area for the entrusting party, and Wu Chuntian and Yixing Company affixed their signature and seal in the area for the entrusted party. A traffic accident occurred when Wu Chuntian provided the driving services. According to the conclusion on the traffic accident issued by the traffic police department, Wu Chuntian should be fully liable for the accident. Upon determination of losses arising from this traffic accident, Ping An Insurance Company paid Wang Sizheng the insurance money of CNY159,194. Wang Sizheng promised that he transferred the right of recovery for the part he has been compensated to Ping An Insurance Company. Ping An Insurance Company filed a lawsuit against Wu Chuntian and Yixin Company and required their joint and several compensation of CNY159,194 for losses to Ping An Insurance Company. 中国平安财产保险股份有限公司广东分公司(以下简称平安保险公司)承保王司政名下车辆。保险期间内,王司政因饮酒不能驾驶,遂通过“e代驾”网络平台向北京亿心宜行汽车技术开发服务有限公司(以下简称亿心公司)请求有偿代驾服务,亿心公司接受后指派了吴春田提供代驾服务。王司政签署了由吴春田提供的《委托代驾服务协议》,王司政在委托方署名,吴春田、亿心公司在被委托方签名和签章。吴春田提供代驾服务时发生交通事故,据交警部门作出的事故认定书,吴春田负事故全部责任。此次交通事故,经平安保险公司定损并向王司政赔付了保险金159194元。王司政承诺将已获赔部分的追偿权转给平安保险公司。平安保险公司遂将吴春田、亿心公司起诉至法院,要求连带赔偿平安保险公司经济损失159194元。
