| Your Request for Instructions on Whether or Not to Place the “Advance Arbitral” Awards on File for Enforcement (No. 99 [2018], High People's Court of Guangdong Province) has been received. Upon deliberation, the following official reply is hereby made: | | 你院《关于“先予仲裁”裁决应否立案执行的请示》（粤高法〔2018〕99号）收悉。经研究，批复如下： |
An application filed by a party with the people's court for enforcing an arbitral award or mediation rendered by an arbitration institution under the Arbitration Law and examined by the people's court to be in compliance with the relevant provisions of the Civil Procedure Law and the Arbitration Law shall be accepted according to the law in a timely manner, and placed on file for enforcement. However, according to the provisions of Article 2 of the Arbitration Law, the arbitration institution may arbitrate the contract disputes and other property right and interest disputes that have occurred between the parties. Therefore, where a party to a P2P lending contract applies for enforcing an arbitral award or mediation rendered by an arbitration institution before a dispute occurs, the people's court shall rule that the application should not be accepted; and where an application has been accepted, the people's court shall reject the application for enforcement.
．．．．．． | | 当事人申请人民法院执行仲裁机构根据仲裁法作出的仲裁裁决或者调解书，人民法院经审查，符合民事诉讼法、仲裁法相关规定的，应当依法及时受理，立案执行。但是，根据仲裁法第二条的规定，仲裁机构可以仲裁的是当事人间已经发生的合同纠纷和其他财产权益纠纷。因此，网络借贷合同当事人申请执行仲裁机构在纠纷发生前作出的仲裁裁决或者调解书的，人民法院应当裁定不予受理；已经受理的，裁定驳回执行申请。
