| | 2003年10月1日上午，被告葛随生驾驶豫J29186牌号桑塔纳轿车为第三人郑保周帮忙娶儿媳，沿长孟公路自西向东靠右行驶，当行至孟岗乡八里张村二浩饭店门口时，与同向靠右行驶载客的王洪才三轮摩托车追尾相撞，致使乘车人原告张建春、张景荣夫妇受伤，二被告的车辆受不同程度的损坏，二原告被送至长垣县中医院治疗，原告张景荣被诊断为蛛网膜下腔出血，住院治疗43天。长垣县中医院对张建春的伤情诊断为右胫腓骨开放性粉碎性骨折，并神经血管损伤。2003年10月9日新乡市第二人民医院对张建春的伤情诊断为失血性休克，右胫腓骨开放性骨折，颅脑损伤。2003年11月17日，郑州大学第一附属医院对张建春的伤情诊断为右小腿开放性骨折感染，胫腓神经不全损伤，胫前动脉断裂，右足跪屈孪缩，行右小腿截肢术。从2003年10月1日至2004年2月14日，张建春共住院治疗132天，二原告共花去医疗费49239．80元，交通费1703元，长垣县交警大队认定被告葛随生驾车超速行驶与前车追尾相撞，负该次事故的主要责任，被告王洪才驾驶三轮摩托车私自加蓬载客负次要责任，乘车人张建春、张景荣不负责任。2004年3月15日长垣县交警大队法医对张建春的伤情作出第[2004]05号伤残评定，评定张建春为六级伤残。 |
| | 另查明，被告王洪才驾驶的三轮摩托车有长垣县交通局颁发的营运证，营运牌号为G0075号，自2003年5月至2003年9月未向主管部门交纳管理费。原告张景荣于2003年10月8日在长垣县交警大队询问陈述时承认曾经在焦作市果品批发市场做交易员工作。第三人郑保周在事故发生后交给被告葛随生现金5000元。葛随生在事故发生后交给长垣县交警大队事故押金33700元，二原告已支取32368．60元。 |
