| Article 1 This Law is developed for the purposes of strengthening archives management, regulating the collection and arrangement of archives, effectively protecting and using archives, improving the development of archives information systems, promoting the modernization of the national governance system and governance capability, and serving the socialist undertaking with Chinese characteristics. | | 第一条 为了加强档案管理，规范档案收集、整理工作，有效保护和利用档案，提高档案信息化建设水平，推进国家治理体系和治理能力现代化，为中国特色社会主义事业服务，制定本法。 |
| Article 2 This Law shall apply to the collection, arrangement, protection, and use of archives as well as the supervision and administration thereof. | | 第二条 从事档案收集、整理、保护、利用及其监督管理活动，适用本法。 |
| For the purposes of this Law, “archives” means historical records in various forms, including words, diagrams, and audio-visual, among others, whose preservation is of value to the state and society and which have been or are being directly formed by organs, groups, enterprises and public institutions, other organizations, and individuals in their economic, political, cultural, social, ecological civilization, military, foreign affairs, scientific and technological, and other activities. | | 本法所称档案，是指过去和现在的机关、团体、企业事业单位和其他组织以及个人从事经济、政治、文化、社会、生态文明、军事、外事、科技等方面活动直接形成的对国家和社会具有保存价值的各种文字、图表、声像等不同形式的历史记录。 |
| Article 3 The leadership of the Communist Party of China over the archives work shall be adhered to. People's governments at all levels shall strengthen their archives work, incorporate the archives undertaking in the national economic and social development plans, and include the funds required for the development of the archives undertaking in the government budget, so as to ensure that the development of the archives undertaking is commensurate with the level of national economic and social development. | | 第三条 坚持中国共产党对档案工作的领导。各级人民政府应当加强档案工作，把档案事业纳入国民经济和社会发展规划，将档案事业发展经费列入政府预算，确保档案事业发展与国民经济和社会发展水平相适应。 |
| Article 4 In archives work, the principle of unified leadership and level-by-level administration shall be followed in order to ensure the integrity and security of archives and facilitate the use thereof by all walks of life. | | 第四条 档案工作实行统一领导、分级管理的原则，维护档案完整与安全，便于社会各方面的利用。 |
| Article 5 All state organs, armed forces, political parties, groups, enterprises and public institutions, and citizens have the obligation to protect archives and the right to use them in accordance with the law. | | 第五条 一切国家机关、武装力量、政党、团体、企业事业单位和公民都有保护档案的义务，享有依法利用档案的权利。 |
| Article 6 The state shall encourage and support scientific research and technological innovation on archives, promote the transformation and application of scientific and technological achievements in archives collection, arrangement, protection, use, and other aspects, and promote scientific and technological progress regarding archives. | | 第六条 国家鼓励和支持档案科学研究和技术创新，促进科技成果在档案收集、整理、保护、利用等方面的转化和应用，推动档案科技进步。 |

| Entities and individuals that have made outstanding contributions to the collection, arrangement, protection, and use of archives shall be commended and rewarded in accordance with the relevant provisions of the state. | | 对在档案收集、整理、保护、利用等方面做出突出贡献的单位和个人，按照国家有关规定给予表彰、奖励。 |
| Chapter II Archives Bodies and Their Duties | | 第二章 档案机构及其职责 |
| Article 8 The archives administration of the state shall take charge of the archives work nationwide, be responsible for overall planning, organization and coordination of the archives undertaking nationwide, establish unified rules, conduct supervision and provide guidance. | | 第八条 国家档案主管部门主管全国的档案工作，负责全国档案事业的统筹规划和组织协调，建立统一制度，实行监督和指导。 |
| The local archives administration at or above the county level shall take charge of the archives work within its administrative region, and supervise and direct the archives work of organs, groups, enterprises and public institutions, and other organizations within its administrative region. | | 县级以上地方档案主管部门主管本行政区域内的档案工作，对本行政区域内机关、团体、企业事业单位和其他组织的档案工作实行监督和指导。 |
| The people's government of a township or town shall designate personnel to be responsible for managing its archives and to supervise and direct the archives work of its subordinate entities and basic self-governing mass organizations, among others. | | 乡镇人民政府应当指定人员负责管理本机关的档案，并对所属单位、基层群众性自治组织等的档案工作实行监督和指导。 |
| Article 9 Organs, groups, enterprises and public institutions, and other organizations shall designate archives bodies or archivists to be responsible for managing their archives and to supervise and direct the archives work of their subordinate entities. | | 第九条 机关、团体、企业事业单位和其他组织应当确定档案机构或者档案工作人员负责管理本单位的档案，并对所属单位的档案工作实行监督和指导。 |
| The central and state organs shall guide the archives work of their systems within the scope of their duties as required for archives administration. | | 中央国家机关根据档案管理需要，在职责范围内指导本系统的档案业务工作。 |
| Article 10 The archives of the Central Government and local archives of various types at or above the county level are cultural public institutions for the centralized management of archives, and they shall be responsible for collecting, arranging, preserving, and providing access to archives within their respective jurisdictions. | | 第十条 中央和县级以上地方各级各类档案馆，是集中管理档案的文化事业机构，负责收集、整理、保管和提供利用各自分管范围内的档案。 |
| Article 11 The state shall strengthen the cultivation of archivists and team building, and enhance archivists' professional competence. | | 第十一条 国家加强档案工作人才培养和队伍建设，提高档案工作人员业务素质。 |
| Archivists shall be devoted to their duties, observe disciplines and laws, and have the corresponding professional knowledge and skills. Among them, professional archivists may be assessed for professional technical titles in accordance with the relevant provisions of the state. | | 档案工作人员应当忠于职守，遵纪守法，具备相应的专业知识与技能，其中档案专业人员可以按照国家有关规定评定专业技术职称。 |
| Chapter III Management of Archives | | 第三章 档案的管理 |
| Article 12 Organs, groups, enterprises and public institutions, and other organizations that should form archives in accordance with the provisions of the state shall establish a responsibility system for the archives work, and improve archives management rules in accordance with the law. | | 第十二条 按照国家规定应当形成档案的机关、团体、企业事业单位和其他组织，应当建立档案工作责任制，依法健全档案管理制度。 |
| Article 13 The following materials directly formed that are of preservation value to the state and the society shall be archived: | | 第十三条 直接形成的对国家和社会具有保存价值的下列材料，应当纳入归档范围： |
| (1) Those reflecting the organizational evolution and major functional activities of organs and groups. | | （一）反映机关、团体组织沿革和主要职能活动的； |
| (2) Those reflecting the major research and development, construction, production, operation and service activities of state-owned enterprises and public institutions, and protecting the rights and interests of state-owned enterprises and public institutions and their employees. | | （二）反映国有企业事业单位主要研发、建设、生产、经营和服务活动，以及维护国有企业事业单位权益和职工权益的； |
| (3) Those reflecting the urban and rural community governance and service activities of basic self-governing mass organizations. | | （三）反映基层群众性自治组织城乡社区治理、服务活动的； |
| (4) Those reflecting national governance activities, economic and technological development, social and historical features, culture and customs, and ecological environment during all historical periods. | | （四）反映历史上各时期国家治理活动、经济科技发展、社会历史面貌、文化习俗、生态环境的； |
| (5) Other materials that should be archived as provided for by laws and administrative regulations. | | （五）法律、行政法规规定应当归档的。 |
| Non-state-owned enterprises, social service providers, and other entities shall preserve their relevant materials according to the scope set out in subparagraph (2) of the preceding paragraph. | | 非国有企业、社会服务机构等单位依照前款第二项所列范围保存本单位相关材料。 |
| Article 14 Materials of an entity that should be archived shall, in accordance with the relevant provisions of the state, be handed over to the entity's archives body or archivists on a periodical basis for centralized management. No individual may refuse the archiving of such materials or keep such materials as his or her personal property. | | 第十四条 应当归档的材料，按照国家有关规定定期向本单位档案机构或者档案工作人员移交，集中管理，任何个人不得拒绝归档或者据为己有。 |
It shall be prohibited to archive, without approval, the materials that should not be archived as prescribed by the state.
