| The Interpretation of the Supreme People's Court on Issues concerning the Application of Law in the Trial of Cases involving Marital Debt Disputes (hereinafter referred to as the “Interpretation”) has come into force on January 18, 2018. For the purpose of equally protecting the lawful rights and interests of all parties according to the law, the relevant work is hereby notified as follows: | | 《最高人民法院关于审理涉及夫妻债务纠纷案件适用法律有关问题的解释》（以下简称《解释》），已自2018年1月18日起施行，为依法平等保护各方当事人合法权益，现就有关工作通知如下： |
| I. The Interpretation shall apply to cases of first instance and second instance being tried. | | 一、正在审理的一审、二审案件，适用《解释》的规定。 |
II. For cases for which final judgments have been rendered, in the screening, the standards for unclear fact-finding, erroneous application of law, and obviously unjust results shall be strictly grasped. For example, in such cases where one spouse maliciously colludes with the creditor to entrap the other spouse and the other spouse has to bear a huge amount of debt for no reason without knowing it, corrections shall be made according to the law. In the citation of legal provisions when new judgments are rendered for retrial cases, Articles 17 and 41 of the Marriage Law and other laws shall be cited more.
．．．．．． | | 二、已经终审的案件，甄别时应当严格把握认定事实不清、适用法津错误、结果明显不公的标准。比如，对夫妻一方与债权人恶意串通坑害另一方，另一方在毫不知情的情况下无端背负巨额债务的案件等，应当依法予以纠正。再审案件改判引用法律条文时，尽可能引用婚姻法第十七条、第四十一条等法律。
