Notice by the General Office of the Ministry of Human Resources and Social Security of Implementing the Social Security Agreement between China and Japan 

人力资源社会保障部办公厅关于实施中国-日本社会保障协定的通知

The human resources and social security departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, and the Xinjiang Production and Construction Corps: 各省、自治区、直辖市及新疆生产建设兵团人力资源社会保障厅(局):
For the purpose of effectively resolving the problem of double payment of social insurance premiums by personnel of China and Japan working in each other's countries, China and Japan formally entered into the Social Security Agreement between the Government of the People's Republic of China and the Government of Japan (hereinafter referred to as the “Agreement”) on May 9, 2018. To ensure the smooth implementation of the Agreement, the Ministry of Human Resources and Social Security (“MOHRSS”) of China and the competent authority of Japan entered into the Administrative Agreement on Implementing the Social Security Agreement between the Government of the People's Republic of China and the Government of Japan (hereinafter referred to as the “Administrative Agreement”) on April 18, 2019. Both sides have decided through consultation that the Agreement and the Administrative Agreement will come into force on September 1, 2019. For the purpose of ensuring the implementation of the two agreements, you are hereby notified of the relevant issues as follows: 为有效解决中国、日本两国在对方国工作的人员双重缴纳社会保险费的问题,两国于2018年5月9日正式签署了《中华人民共和国政府和日本国政府社会保障协定》(以下简称《协定》)。为保证《协定》顺利实施,我部与日本主管机关于2019年4月18日签署了《关于实施中华人民共和国政府和日本国政府社会保障协定的行政协议》(以下简称《行政协议》)。双方商定,《协定》和《行政协议》于2019年9月1日正式生效。为确保《协定》和《行政协议》的贯彻执行,现就有关问题通知如下:
I. Main contents of the Agreement   一、《协定》主要内容
1. The scope of mutually exempted insurance types (一)互免险种范围
The basic pension insurance for employees in China; and the national basic pension insurance (excluding the national basic pension fund) and the employee's pension insurance (excluding the employee's pension fund) in Japan. 中国为职工基本养老保险;日本为国民年金(国民年金基金除外)和厚生年金(厚生年金基金除外)。
2. Chinese personnel eligible for exemption from paying relevant social insurance premiums in Japan (二)中方适用免除在日本缴纳相关社会保险费的人员
(1) Dispatched personnel: employees that are employed by employers having business premises within the territory of China, and that are dispatched by these employers, based on their employment relationship, to work within the territory of Japan. 1.派遣人员。指受雇于在中国领土上有经营场所的雇主,依其雇佣关系被该雇主派遣至日本领土上为其工作的人员。
(2) Employees on sailing ships: personnel that are employed on sailing ships flying Chinese flags, and those that normally reside within the territory of China and are employed on sailing ships flying Japanese flags. 2.航海船舶上的雇员。指在悬挂中国船旗的航海船舶上受雇的人员,及通常居住在中国领土上,在悬挂日本船旗的航海船舶上受雇的人员。
(3) Employees on aircrafts: employees that are employed by employers within the territory of China to work on aircrafts operating on international routes. 3.航空器上的雇员。指受雇于在中国领土上的雇主,在国际航线的航空器上工作的人员。
(4) Staff members of the diplomatic organs and consulates, and public functionaries: staff members of the diplomatic organs and consulates mean the relevant personnel as defined in the Vienna Convention on Diplomatic Relations and the Vienna Convention on Consular Relations. Public functionaries mean the officials dispatched by China to the territory of Japan to work and the personnel that enjoy the same treatment according to the provisions of Chinese laws. 4.外交领事机构人员、公务员。外交领事机构人员指《维也纳外交关系公约》和《维也纳领事关系公约》中定义的相关人员。公务员指中国派遣到日本领土上工作的公务员及按照中国法律规定同等对待的人员。
(5) Exceptions: the competent authorities or handling institutions of China and Japan may agree to exclude some specific personnel or a group of personnel from Articles 5 to 8 of the Agreement as exceptions, provided that the personnel or the type of personnel is governed by the laws and regulations of China or Japan. 5.例外。中日两国主管机关或经办机构可同意就特定人员或人群,对《协定》第五至八条作例外处理,条件是此人或此类人受中日两国任一国法律规定管辖。
(6) Accompanying spouses and children: the accompanying spouses and children of the dispatched personnel, public functionaries and exceptions personnel may be exempted from paying the national basic pension insurance (excluding the national basic pension fund), provided that they meet the requirements for implementing the social security agreement according to the Japanese laws. However, if the spouses and children apply for the payment, the aforesaid provisions shall not apply. 6.随行配偶和子女。派遣人员、公务员、例外人员的随行配偶和子女,可以免除日本国民年金(国民年金基金除外)缴费,条件是满足日本法律规定关于社会保障协定实施的要求。但是,应其配偶和子女申请,前述规定将不适用。
3. Japanese personnel eligible for exemption from paying relevant social insurance premiums in China (三)日本适用免除在华缴纳相关社会保险费的人员
The conditions for Japanese personnel eligible for exemption from paying relevant social insurance premiums in China are similar to those for the eligible Chinese personnel from Category 1 to Category 5. 日本适用免除在华缴纳社会保险费的人员与中方1至5类适用人员的条件类同。
4. The time limit for exempting the dispatched staff members from paying social insurance premiums (四)派遣人员免除缴纳社会保险费的期限
For dispatched personnel, the time limit for exemption from payment of insurance applied for the first time shall be five years at maximum. If the dispatch period exceeds five years, the time limit for exemption may be extended with the consent of the competent authorities or handling institutions of China and Japan. 派遣人员首次申请免除缴费期限最长为5年。如派遣期限超过5年,经中日两国主管机关或经办机构同意,可予以延长。
5. Competent authorities and handling institutions (五)主管机关、经办机构
(1) Competent authorities: the MOHRSS in China; and any government agency that administers the national basic pension insurance (excluding the national basic pension insurance) and the employee's pension insurance (excluding the employee's pension fund) in Japan. 1.主管机关:中国为人力资源社会保障部;日本为主管日本国民年金(国民年金基金除外)、厚生年金(厚生年金基金除外)制度的任何政府机关。
(2) Handling institutions: the Social Insurance Management Center of the MOHRSS and other institutions designated by the MOHRSS in China; and the insurance institutions or their associations that are responsible for implementing the system of national basic pension insurance (excluding the national basic pension insurance) and the employee's pension insurance (excluding the employee's pension fund) in Japan.
