最高人民法院公布保障民生第二批典型案例之六:郝龙只等15人诉屯留县人民政府不履行征地方案公告和征地补偿、安置方案公告法定职责案

1. Basic Facts 基本案情
Plaintiff Hao Longzhi and other 14 persons and third parties Gao Anxi and other five persons were villagers of Wanggongzhuang Village, Ligao Township, Tunliu County (hereinafter referred to as “Wanggongzhuang Village”). In 1991, Hao Yiming, Gao Anxi and other persons entered into a land contract with Wanggongzhuang Village for contracting the orchard of the Village, with a contract period from 1993 to 1999. After the contract period expired, the contract was signed on a yearly basis until 2003. In October 2003, the orchard contracted by Hao Longzhi, Gao Anxi and other persons was occupied by Dekai Yafei Auto Chain Sales Co., Ltd. in Changzhi City (hereinafter referred to as “Dekai Company”). On November 24, 2004, the People's Government of Tunliu County submitted a Request for Instructions on the Land for the Reconstruction and Expansion Project of the Islamic Meat Deep Processing of Dekai Yafei Auto Chain Sales Co., Ltd. in Changzhi City to the People's Government of Shanxi Province and the People's Government of Changzhi City, and applied for expropriating 6.7293 hectares of land in Wanggongzhuang Village, including 0.57 hectare of farmland and 6.1593 hectares of orchard. The orchard contracted by Hao Longzhi, Gao Anxi and other persons was covered in the scope of land that was to be expropriated in the Request for Instructions. On December 14, 2005, the People's Government of Tunliu County and Wanggongzhuang Village entered into a Land Compensation Agreement, which agreed on that the People's Government of Tunliu County utilized 100 mu of land of Wanggongzhuang Village and the compensation was paid on a yearly basis, 50,000 yuan per year (500 yuan per mu). On August 4, 2006, the People's Government of Shanxi Province approved the People's Government of Tunliu County to expropriate the said land in its Official Reply (No. 285 [2006], People's Government, Shanxi) and the People's Government of Tunliu County was in charge of supplementing farmland in the transferred area, implementation upon approval, and publication. From 2004 to 2008, the People's Government of Tunliu County has paid the land rental fees of 500 yuan per mu per year to Hao Longzhi, Gao Anxi and other persons through Wanggongzhuang Village. In 2009, Hao Yiming, Gao Anxi and other persons filed a lawsuit and therefore Wanggongzhuang Village did not pay land rental fees to contractors. 原告郝龙只等15人和第三人高安喜等6人均系屯留县李高乡王公庄村(下称王公庄村)村民,1991年郝义明、高安喜等人与王公庄村签订了土地承包合同,承包了村里的果园地,承包期限为1993年至1999年。承包期满后,合同变为一年一签,直至2003年。2003年10月,郝龙只、高安喜等人承包的果园地被长治市德凯亚飞汽车连锁销售有限公司(下称德凯公司)占用。2004年11月24日,屯留县人民政府向山西省人民政府和长治市人民政府报送了《关于长治市德凯亚飞汽车连锁销售有限公司清真肉业深加工改扩建项目建设用地的请示》,申请征用王公庄村土地6.7293公顷,其中耕地0.57公顷、园地6.1593公顷。郝龙只、高安喜等人承包的果园地在该请示拟征用的范围内。2005年12月14日,屯留县人民政府与王公庄村签订了《土地补偿协议》,约定屯留县人民政府使用王公庄村土地100亩,补偿费分年度支付,每年支付50000元(每亩500元)。2006年8月4日,山西省人民政府以晋政地字〔2006〕285号文批复同意屯留县人民政府征用上述土地,并由屯留县人民政府负责所转用面积的耕地补充、批后实施及公告等工作。从2004年开始,屯留县人民政府每年通过王公庄村支付郝龙只、高安喜等人租地费每亩500元,直至2008年。2009年,因郝义明、高安喜等人提起本案诉讼,王公庄村未将租地费给付各承包户。
In June 2007, the Land and Resources Bureau of Tunliu County assigned 6.7293 hectares of land it expropriated to Dekai Company for the reconstruction and expansion project of Islamic meat deep processing. On August 27 of the same year, the Land and Resources Bureau of Tunliu County publicized the approval on the initial registration of this land. Hao Longzhi, Gao Anxi and other persons alleged that by now they knew the land they contracted have been expropriated and assigned to Dekai Company. The People's Government of Tunliu County neither notified them of land expropriation from the very beginning, nor performed the statutory duties of publicizing the land expropriation scheme and the scheme for land expropriation compensation and resettlement; instead, it has compensated them in the form of land rental fees. Therefore, they filed a lawsuit and required the People's Government of Tunliu County to perform the duty of publication and pay them land expropriation compensation in a lump sum according to law. 2007年6月,屯留县国土资源局将征用的6.7293公顷土地出让给德凯公司,用于清真肉业深加工改扩建项目。同年8月27日,屯留县国土资源局对该块土地初始登记的审核情况进行公告。郝龙只、高安喜等人称,直至此时方得知所承包土地已被征用并出让给德凯公司,而屯留县政府自始没有告知其征用土地的事实,更没有依法履行征地方案和征地补偿、安置方案公告的法定职责,而是一直以租地费的形式给予其补偿。故提起诉讼,要求屯留县人民政府依法履行公告职责,并依法一次性支付征地补偿款。
2. Judgment 裁判结果
After a hearing of first instance, the Intermediate People's Court of Changzhi City held that: On December 14, 2005, the People's Government of Tunliu County entered into a Land Compensation Agreement with Wanggongzhuang Village and both parities agreed upon that the People's Government of Tunliu County paid Wanggongzhuang Village land compensation on a yearly basis. Hao Longzhi, Gao Anxi and other persons have received such compensation from the villagers' committee, which should be deemed as their recognition of the scheme for land compensation and resettlement. It was of no practical significance in publicizing the scheme for land expropriation compensation and resettlement. Therefore, the claim of Hao Longzhi and other persons that the People's Government of Tunliu County should perform the duty of publicizing the scheme for land expropriation compensation and resettlement should be dismissed. In August 2006, this land was transformed to construction land upon approval of the People's Government of Shanxi Province. Hao Longzhi, Gao Anxi and other persons have already known that the land was expropriated and used by Dekai Company and it was of no practical significance for the People's Government of Tunliu County to publicize the land expropriation scheme. Therefore, the claim of Hao Longzhi and other persons that the People's Government of Tunliu County should perform the duty of publicizing the land expropriation scheme should also be dismissed. In conclusion, in accordance with the provisions of item (4) of Article 56 of the Interpretation of the Supreme People's Court on Several Issues concerning the Implementation of the Administrative Procedure Law of the People's Republic of China, the Intermediate People's Court of Changzhi City rendered a judgment, in which the claim of Plaintiffs Hao Longzhi and other 14 persons was dismissed. 长治市中级人民法院一审认为,2005年12月14日,屯留县人民政府与王公庄村签订了土地补偿协议,约定每年给付王公庄村土地补偿款,郝龙只、高安喜等人均已从村委领取了补偿款,应视为其对土地补偿、安置方案已认可,再公告征地补偿、安置方案已无实际意义,故郝龙只等人要求屯留县人民政府履行征地补偿、安置方案公告职责的诉讼请求应予驳回。2006年8月,经山西省人民政府同意,该宗土地被转为建设用地,郝龙只、高安喜等人早已知道土地被征用,且被德凯公司使用,屯留县人民政府公布征地方案已无实际意义,故郝龙只等人要求屯留县人民政府履行征地方案公告职责的诉讼请求也应予以驳回。故依照最高人民法院《关于执行<中华人民共和国行政诉讼法>若干问题解释》第五十六条第(四)项之规定:判决驳回原告郝龙只等15人的诉讼请求。
