 一、案情
 唐山人人信息服务有限公司(以下简称唐山人人公司)为“全民医药网”的实际经营者。2008年3月3日,唐山人人公司通过一次性缴费的方式开始参与百度网站(www.baidu.com)的竞价排名。2008年5月开始降低竞价排名的投入,至2008年7月投入额降至最低。全民医药网在2008年7月9日的访问量为2666IP,浏览量为10331PV,2008年7月10日,其访问量和浏览量分别骤然减至701IP、6322PV,同时,在百度网站的搜索关键词部分输入“site: qmyyw. com"后,仅有四项自然排名部分的搜索结果符合查询要求。唐山人人公司主张北京百度网讯科技有限公司(以下简称百度公司)在占据中国搜索引擎服务市场支配地位的情况下,在自然排名部分减少收录全民医药网的行为属于滥用市场支配地位的行为。百度公司则主张,因网络中存在大量指向全民医药网的“垃圾外链”,因此其在自然排名部分对全民医药网采取了减少收录的措施。
 二、审理结果
 原审法院经审理认为:“中国搜索引擎服务市场”是本案中《中华人民共和国反垄断法》(以下简称《反垄断法》)意义上的“相关市场”。搜索引擎服务商向用户提供的免费搜索服务不能等同于公益性的免费服务,它仍然可以通过吸引用户并借助广告等营销方式来获得现实或者潜在的商业利益。因此百度公司以免费提供搜索服务为由主张本案中不存在《反垄断法》意义上的相关市场,缺乏依据,法院不予支持。
