The Regulation on China (Sichuan) Pilot Free Trade Zone (No. SC132821) as adopted at the 11th meeting of the Standing Committee of the Thirteenth People's Congress of Sichuan province on May 23, 2019 is hereby issued, with effect as from July 1, 2019. 《中国(四川)自由贸易试验区条例》(NO:SC132821)已由四川省第十三届人民代表大会常务委员会第十一次会议于2019年5月23日通过,现予公布。自2019年7月1日起施行。

Regulation on China (Sichuan) Pilot Free Trade Zone 中国(四川)自由贸易试验区条例

Chapter I General Provisions 

第一章 总 则

Article 1 For the purposes of advancing and guaranteeing the construction of the China (Sichuan) Pilot Free Trade Zone, this Regulation is developed in accordance with the relevant laws, administrative regulations and the Framework Plan for China (Sichuan) Pilot Free Trade Zone, based on the actual circumstances in Sichuan province.   第一条 为了推进和保障中国(四川)自由贸易试验区建设,根据有关法律、行政法规和《中国(四川)自由贸易试验区总体方案》,结合四川省实际,制定本条例。
Article 2 This Regulation shall apply to the Chengdu Tianfu New Area Subzone, the Chengdu Qingbai River Railway Port Subzone, and the South Sichuan Port-surrounding Subzone of the China (Sichuan) Pilot Free Trade Zone (hereinafter referred to as the "PFTZ") and any extension of the PFTZ as approved by the State Council.   第二条 本条例适用于中国(四川)自由贸易试验区(以下简称“自贸试验区”)成都天府新区片区、成都青白江铁路港片区、川南临港片区以及报经国务院批准的自贸试验区扩展区域。
Article 3 The PFTZ shall, with innovation in systems as the core, explore experience capable of being replicated and promoted, base itself on inland regions, bridge eastern and western China, serve the whole country, be oriented towards the world, and build up itself into a zone leading the development and opening of gateway cities in western China, a pioneering zone in the belt in support of the inland opening strategy, a pivot zone in the international opening passage, a new highland for inland open economy, and a demonstration zone for coordinated opening of inland areas and coastal, border and riverside areas.   第三条 自贸试验区应当以制度创新为核心,探索可复制可推广经验,立足内陆、承东启西,服务全国、面向世界,建设成为西部门户城市开发开放引领区、内陆开放战略支撑带先导区、国际开放通道枢纽区、内陆开放型经济新高地、内陆与沿海沿边沿江协同开放示范区。
The PFTZ shall actively explore the construction of a free trade port that is in line with the orientation of inland opening and development. 自贸试验区应当积极探索建设符合内陆开放发展定位的自由贸易港。
Article 4 All the subzones of the PFTZ shall develop advantageous industries according to the functional orientation and objectives provided by the state and achieve complementary advantages, differentiated development, mutual learning, cooperation and interaction, and coordinated opening.   第四条 自贸试验区各片区应当根据国家规定的功能定位和目标发展优势产业,实现优势互补、错位发展、相互借鉴、合作联动、协同开放。
Article 5 The PFTZ shall be encouraged to break new ground, promote comprehensive innovation with innovation in systems as the core, and fully animate market participants. For matters not prohibited or restricted by any law, regulation or national policy, a citizen, legal person or other organization shall be encouraged to carry out innovation activities in the PFTZ.   第五条 鼓励自贸试验区先行先试,以制度创新为核心推动全面创新,充分激发市场主体活力。对法律、法规和国家政策未禁止或者限制的事项,鼓励公民、法人和其他组织在自贸试验区开展创新活动。
Article 6 The PFTZ shall establish an innovation-oriented evaluation and assessment mechanism. If the reform and innovation in the PFTZ fails to achieve its expected objective, but complies with the reform direction, the decision-making procedures conform to the provisions of the laws, regulations and relevant policies, no duty is neglected, and no illicit interests is sought, or neither the state interest nor the public interest is harmed by malicious collusion, relevant entities and individuals shall not be judged negatively.   第六条 自贸试验区应当建立以创新为导向的考核评价机制。在自贸试验区进行的改革创新未能实现预期目标,但是符合改革方向,决策程序符合法律、法规规定及相关政策规定,没有失职渎职,未牟取不正当利益或者未恶意串通损害国家利益、社会公共利益的,对有关单位和个人不作负面评价。
Chapter II Administrative System 

第二章 管理体制

Article 7 The PFTZ shall establish a government administrative system with scientific division of authority, exercising efficient and unified administration, in open and transparent operation.   第七条 自贸试验区应当建立事权划分科学、管理高效统一、运行公开透明的行政管理体制。
Article 8 The provincial people's government shall be responsible for organizing and leading the construction and administration of the PFTZ.   第八条 省人民政府负责组织领导自贸试验区建设和管理工作。
The Leading Group for Advancing the China (Sichuan) Pilot Free Trade Zone shall research a PFTZ development plan and formulate PFTZ policies and measures for investment, trade, finance, talents, comprehensive reforms, and the like. 中国(四川)自由贸易试验区推进工作领导小组统筹研究自贸试验区发展规划,制定自贸试验区投资、贸易、金融、人才、综合改革等政策措施并推动实施。
The Work Office for the China (Sichuan) Pilot Free Trade Zone (hereinafter referred to as the "Sichuan PFTZ Office") shall undertake the daily work of the Leading Group. 中国(四川)自由贸易试验区工作办公室(以下简称“四川自贸办”)承担领导小组的日常工作。
Article 9 Each PFTZ subzone administrative authority shall advance the specific work of pilot programs of reforms, determine the major issues related to the reform in the subzone and the PFTZ, formulate major measures and plans related to the reform in the PFTZ, and file the measures and plans to the Sichuan PFTZ Office.   第九条 自贸试验区片区管理机构推进改革试点具体工作,决定本片区与自贸试验区改革相关的重大问题;制定与自贸试验区改革相关的重大措施和方案,并报四川自贸办备案。
The working authorities set up by PFTZ subzone administrative authorities shall be responsible for implementing the tasks for pilot programs of reforms in the PFTZ and managing and coordinating the relevant government administrative affairs of the PFTZ. 自贸试验区片区管理机构设置的工作机构,负责落实自贸试验区改革试点任务,管理和协调自贸试验区有关行政事务。
Article 10 The provincial people's government, the people's governments of the prefecture cities where PFTZ subzones are located, and their relevant departments shall decentralize the powers of economic and social administration to the PFTZ in accordance with the rules of the state, as needed for the reform and innovative development of the PFTZ.   第十条 省人民政府、自贸试验区片区所在地市人民政府及其有关部门根据自贸试验区改革创新发展需要,依照国家规定向自贸试验区下放经济社会管理权限。
The PFTZ subzone administrative authorities and working authorities shall exercise other powers as needed for the reform and development of the PFTZ, with authority or as commissioned. 自贸试验区片区管理机构、工作机构依据授权或者委托,行使自贸试验区改革发展需要的其他权限。
Article 11 The people's government in the place where the PFTZ is located and its relevant departments shall support all the work of the PFTZ and undertake relevant government administrative affairs in accordance within their respective remit.   第十一条 自贸试验区所在地人民政府及其有关部门应当支持自贸试验区的各项工作,按照各自职责承担相关行政事务。
Customs, maritime, border inspection, finance, taxation and other working institutions stationed in the PFTZ shall perform relevant work duties in accordance with the law and support the reform and innovation work of the PFTZ. 海关、海事、边检、金融、税务等驻自贸试验区工作机构,依法履行相关工作职责,支持自贸试验区改革创新工作。
Chapter III Government Services 

第三章 政务服务

Article 12 Each PFTZ subzone shall establish a system for powers of administrative punishment and a comprehensive approval service framework that are relatively centralized and lawfully issue and dynamically adjust a list of administrative powers, a list of duties and operational procedures.   第十二条 自贸试验区各片区应当建立相对集中的行政处罚权制度和综合审批服务体系,依法公布并动态调整行政权力清单、责任清单和运行流程。
Article 13 The PFTZ shall advance the reform of tax facilitation, establish a facilitative tax service system, advance new modes such as pre-export tax rebate services for production enterprises, and implement the system for deduction of overseas income tax and tax rebates at the port of departure.   第十三条 自贸试验区推进办税便利化改革,建立便捷的税务服务体系,推进生产型企业出口退税服务前置等新模式,落实境外所得税扣减、启运港退税制度。
Article 14 The PFTZ may take the following measures to optimize the system environment for innovation and entrepreneurship and stimulate the vitality for innovation and entrepreneurship:   第十四条 自贸试验区可以采取下列措施优化创新创业制度环境,激发创新创业活力:
(1) Establishing an international science and technology cooperation platform and strengthening joint research and introduction of technology in high-end technology and key technology fields. (一)建设国际科技合作平台,加强在高端技术、重点技术领域的联合研究和技术引进;
(2) Establishing a credit evaluation framework and standards for scientific and technological enterprises, broadening overseas financing channels for innovation and entrepreneurship projects, and guiding domestic and overseas capital in providing financing support for innovation and entrepreneurship projects. (二)建立科技企业信用评价体系和标准,拓宽创新创业项目境外融资渠道,引导境内外资本为创新创业项目提供融资支持;
(3) Innovating supervisory modes within areas under special customs supervision, facilitating the import of equipment and materials for research and development by enterprises, and reducing the research and development cost of enterprises. (三)在海关特殊监管区域内创新监管模式,为企业进口研发设备、材料提供便利,降低企业的研发成本;
(4) With the PFTZ as a platform, encouraging exchanges and cooperation between Sichuan universities on one side and universities and research institutions at home and abroad on the other side. (四)以自贸试验区为平台,鼓励在川高校与境内外高校、科研机构开展交流合作;
(5) Improving the cultivation and support mechanism for innovation and entrepreneurship talents, encouraging the establishment of an international innovation and entrepreneurship incubation platform in the PFTZ, and carrying out pilot programs for offshore innovation and entrepreneurship among talents. (五)完善创新创业人才培育扶持机制,鼓励在自贸试验区建立国际化创新创业孵化平台,开展海外人才离岸创新创业试点;
(6) Conducting exploration and experiments in promoting the transformation of scientific and technological achievements, military and civilian integration, and other aspects. (六)在促进科技成果转化、军民融合等方面探索试验。
Article 15 The Sichuan PFTZ Office shall assess the implementation of policies under pilot programs and that of innovation mechanisms in the PFTZ and promptly summarize and promote experience and achievements in reform and innovation.   第十五条 四川自贸办应当对自贸试验区试点政策执行情况以及创新机制实施情况进行评估,及时总结和推广改革创新经验和成果。
The Sichuan PFTZ Office may arrange for market participants and professional institutions to assess the support for the reform and innovation work of the PFTZ given by the relevant departments of the provincial people's government, the people's governments where the PFTZ subzones are located, and relevant authorities. 四川自贸办可以组织市场主体、专业机构对省人民政府相关部门、自贸试验区片区所在地的人民政府及相关部门支持自贸试验区改革创新工作进行评估。
Article 16 The PFTZ shall cultivate and regulate the human resources market and establish a determination, introduction, use and incentive mechanism for high-level talents.   第十六条 自贸试验区应当培育和规范人力资源市场,建立高层次人才认定、引进、使用和激励机制。
The PFTZ shall provide high-level foreign talents with visa application, entry and exit, stay and residence, permanent residence, application for projects and rewards, practices, innovation and entrepreneurship, purchase or leasing of dwellings, children's going to school, social security, language learning, and the like and build an international community in an innovative manner. 自贸试验区为外籍高层次人才的签证申请、入出境、停居留、永久居留、项目与奖励申报、执业、创新创业、购买或者租赁住房、子女入学、社会保障、语言学习等提供便利,创新建设国际社区。
Article 17 The PFTZ subzone administrative authorities and working authorities shall submit relevant data and information to the Sichuan PFTZ Office in a timely manner in reliance on the government information platform.
   第十七条 自贸试验区片区管理机构、工作机构应当依托政府信息平台及时向四川自贸办报送相关数据及信息。
