[Basic Facts] 基本案情
Allan Mendoza Tablate was the second officer of the Malta ship “Catalina.” In May 2016, “Catalina” departed from Lianyungang Port of China for Indonesia in a no-load manner. When “Cataline” with Tablate as the driver on duty approached the coastal waters of Xiangshan County in Zhejiang Province, under the circumstances of sea fog, poor visibility, and sailing in fishing areas, in violation of the relevant provisions of maritime traffic safety, Tablate failed to keep proper look-out, take effective fog measures, and use safe speed and failed to fully assess the situations and collision dangers and take effective collision avoidance measures earlier, causing the collision of “Catalina” and “Lurongyu 58398” and a serious traffic accident with turnover and sinking of “Lurongyu 58398,” deaths of Zhang and other 13 crew, and missing of Wang and other four crew. The Ningbo Maritime Court determined that “Catalina” should assume the primary liability for the accident. Borsari Shipping Company Ltd., owner of “Catalina,” compensated the close relatives of dead and missing crew a total of CNY22.45 million and close relatives of Jiang and other victims issued letters of understanding. 艾伦系马耳他籍“卡塔利娜(Catalina)”轮二副。2016年5月,“卡塔利娜”轮从中国连云港空载驶往印度尼西亚。艾伦值班驾驶“卡塔利娜”轮途经浙江象山沿海水域时,在海面起雾、能见度不良、渔区航行的情况下,艾伦违反海上交通安全的相关规定,未保持正规瞭望、采取有效的雾航措施、使用安全航速行驶,未能对当时局面和碰撞危险作出充分估计并及早采取有效的避让行为,导致“卡塔利娜”轮与“鲁荣渔58398”轮发生碰撞,造成“鲁荣渔58398”轮扣翻、沉没,船员张某等十四人死亡,船员王某某等五人失踪的重大交通事故,宁波海事局认定“卡塔利娜”轮应承担本起事故的主要责任。“卡塔利娜”轮所有人波尔萨利船运有限公司(BorsariShippingCompanyLtd)共赔偿死亡和失踪人员近亲属人民币2245万元,被害人姜某某等的近亲属出具了谅解书。
