刘昌辉与张济信房屋买卖合同纠纷抗诉案

 —不同集体经济组织成员间农房买卖合同效力的认定

 [基本案情]
 当事人(一审原告):张济信。
 当事人(一审被告):刘昌辉。
 张济信系重庆市巴南区跳石镇永隆村10组村民,刘昌辉系重庆市巴南区跳石镇永隆村9组村民。2004年1月26日,在田荣全和时任永隆村村长的李泽普、永隆村村民刘昌明等人在场的情况下,张济信与刘昌辉达成房屋买卖协议,约定张济信将其所有的坐落于重庆市巴南区跳石镇永隆村竹林坵的住房8间147 m2和猪牛舍2间57m2作价5000元售与刘昌辉。刘昌辉支付张济信房款,张济信交付集体土地建设用地使用证。房屋买卖协议书由李泽普代为书写,刘昌辉在“买方”一栏处签名,经张济信同意,田荣全在“卖方”一栏处代张济信签名。重庆市巴南区跳石镇永隆村民委员会在房屋买卖协议书上加盖公章。刘昌辉支付5000元购房款后,张济信将房屋钥匙及集体土地建设用地使用证交付刘昌辉,刘昌辉占有使用该房屋至今。2010年9月,刘昌辉将该房屋的集体土地建设用地使用证交给重庆市巴南区跳石镇永隆村民委员会,用于办理农村房屋产权证。2011年5月,重庆市巴南区跳石镇永隆村民委员会将重新办理的该房屋的房地产权证交付刘昌辉,产权人登记仍为张济信。
 检察机关另查明,2004年1月26日,张济信与刘昌辉签订《土地转包合同书》,约定将张济信的土地转包给刘昌辉耕种。2006年3月8日,刘昌辉与刘昌建签订《房屋转让协议》,约定将刘昌辉位于巴南区跳石镇永隆村九社土地坡的房屋转让给刘昌建。
 张济信向重庆市巴南区人民法院提起诉讼,请求确认其与刘昌辉签订的《房屋买卖协议》无效,并要求其返还房屋。
 [原审裁判]
 重庆市巴南区人民法院于2012年6月11日作出(2011)巴民初字第06096号民事判决,该院认为张济信与刘昌辉签订的房屋买卖协议书是双方当事人真实意思表示,合同成立。但由于农村宅基地只能由本集体经济组织的成员享有,张济信系永隆村10组村民,刘昌辉系永隆村9组村民。张济信与刘昌辉不是同一集体经济组织的成员,双方签订的房屋买卖协议违反法律强制性规定,应属无效合同。张济信要求确认与刘昌辉所签房屋买卖协议书无效,并请求返还坐落于跳石镇永隆村10组竹林坂的住房8间,猪牛舍2间及农村房屋所有权证的诉讼请求,符合法律规定,该院予以支持。该院遂依照《合同法》第52条第5项、《土地管理法》第10条之规定,判决:一、张济信与刘昌辉于2004年1月26日签订的房屋买卖协议书无效;二、刘昌辉返还张济信所有的坐落于重庆市巴南区跳石镇永隆村竹林坂的住房8间147m2和猪牛舍2间57m2及房地产权证。
