| Announcement on the Case-filing of Anti-dumping against Imports of Bisphenol A Originated in Thailand | | 关于对原产于泰国的进口双酚A反倾销立案公告 |
| On January 13, 2017, the Ministry of Commerce of the People's Republic of China (hereinafter referred to as the "Ministry of Commerce") received an application for anti-dumping investigation that was formally submitted by Nantong Xingchen Synthetic Material Co., Ltd. and other four companies (hereinafter referred to collectively as the "Applicant") on behalf of the domestic Bisphenol A industry, in which the Applicant applied for the anti-dumping investigation into imports of Bisphenol A originated in Thailand. In accordance with the Anti-dumping Regulations of the People's Republic of China (hereinafter referred to as the “Anti-dumping Regulations”), the Ministry of Commerce reviewed the qualification of the Applicant, the situation relating to the products to be investigated according to the application and the like products in China, influence of the products to be investigated on the domestic industry, and the situation relating to the applying country (region). | | 中华人民共和国商务部（以下简称商务部）于2017年1月13日收到南通星辰合成材料有限公司等5家公司（以下称申请人）代表国内双酚A产业正式提交的反倾销调查申请，申请人请求对原产于泰国的进口双酚A进行反倾销调查。商务部依据《中华人民共和国反倾销条例》有关规定，对申请人的资格、申请调查产品的有关情况、中国同类产品的有关情况、申请调查产品对国内产业的影响、申请调查国家（地区）的有关情况等进行了审查。 |
| According to evidence provided by the Applicant and the primary review of the Ministry of Commerce, the outputs of Bisphenol A of the Applicant in the year 2013, 2014, 2015 and the first three quarters of 2016 respectively had accounted for over 50% of the total output of the like products in China during the same period, which conformed to provisions in Article 11 and Article 13 of the Anti-dumping Regulations on application for anti-dumping investigation submitted by the relevant domestic industry. | | 根据申请人提供的证据和商务部的初步审查，申请人的双酚A产量在2013年、2014年、2015年和2016年1至9月均占同期中国同类产品总产量的50%以上，符合《中华人民共和国反倾销条例》第十一条和第十三条有关国内产业提出反倾销调查申请的规定。 |
| The application stated that the Bisphenol A originated in Thailand was exported to China at a price lower than the normal value. According to the evidence and information acquired in a reasonable way, in the application, the Applicant alleged that an obvious dumping in the products to be investigated existed after it determined the normal value of Bisphenol A originated in Thailand based on the method of costs plus reasonable expenses and profits, and determined the export price of products to be investigated based on the customs' statistic price of those exported to China, and adjusted factors that would affect the price comparability. Meanwhile, the application stated that under the impact of imports of the products originated in Thailand, the like products of the Applicant have been at a huge loss since 2013, and the total loss showed a substantial increase trend, which made the return on investment, cash flows and other indicators worse and substantially damaged the domestic industry; furthermore, the application stated that there was a causal relationship between the dumping import of products to be investigated and the substantive damage of the domestic industry. Upon review, the Ministry of Commerce considered that the application form had covered the contents and relevant evidence as required by Article 14 and Article 15 of the Anti-dumping Regulations on anti-dumping investigation. | | 申请书主张，原产于泰国的双酚A以低于正常价值的价格向中国出口销售。申请人依据合理获得的证据和信息，在申请书中以成本加合理费用和利润的方法作为确定泰国双酚A正常价值的基础，以申请调查产品进口至中国的海关统计价格作为确定出口价格的基础，在对影响价格可比性的各种因素进行调整后，主张申请调查产品存在较大幅度的倾销。申请书同时主张，受泰国产品进口冲击，申请人同类产品2013年以来处于巨额亏损状态，亏损额总体呈大幅扩大趋势，投资收益率和现金流等指标均呈恶化趋势，国内产业遭受了实质损害，且申请调查产品的倾销与国内产业实质损害存在因果关系。经审查，商务部认为申请书中包含了《中华人民共和国反倾销条例》第十四条、第十五条规定的反倾销调查立案所要求的内容及有关证据。 |
| Based on the above review results and in accordance with Article 16 of the Anti-dumping Regulations, the Ministry of Commerce decided to carry out the anti-dumping investigation into imports of Bisphenol A originated in Thailand as of March 6, 2017. As of the issue date hereof, the Ministry of Commerce carried out the anti-dumping investigation into the imports of Bisphenol A originated in Thailand. The period of this dumping investigation commenced on October 1, 2015 and ended on September 30, 2016, and that of the industrial damage investigation commenced on January 1, 2013 and ended on September 30, 2016.
