| | 2012年3月6日19时许，江苏和旭物流有限公司（简称和旭公司）司机圣怀友驾驶苏A95422/苏A7062（挂）重型货车在南京金焰锶业有限公司（简称金焰公司）内发生溜坡，将位于其后下方魏信喜驾驶的装载机撞翻至坡下，造成魏信喜受伤及装载机损坏。苏A95422/苏A7062（挂）重型货车均在浙商财产保险股份有限公司江苏分公司（简称浙商财险江苏分公司）投保了机动车交通事故责任强制保险以及60万元的第三者责任商业保险，并含不计免赔特约险。事故均发生在保险期限内。 |

| | 江苏省南京市溧水区人民法院经审理认为，该事故发生在金焰公司内，该公司并没有禁止机动车辆通行的警示标志，根据道路交通安全法的规定，本起交通事故仍属于道路交通事故，应适用交强险及商业三者险的相关规定。被告圣怀友驾驶苏A95422/苏A7062（挂）重型货车，应当遵守道路交通安全法律法规的规定，按照操作规范安全驾驶、文明驾驶。其在金焰公司内驾驶该重型货车过程中导致该车溜坡，并将其后下方由魏信喜驾驶的装载机撞翻至坡下，导致魏信喜受伤，圣怀友应承担事故的全部责任。魏信喜在本次事故中不存在过错，不承担事故的责任。法院判决：对魏信喜的合理损失342186.55元，由浙商财险江苏分公司在交强险限额内赔偿其24万元，在商业三者险限额内赔偿其102186.55元；魏信喜应返还田明支付的21119.67元，返还和旭公司给付的11万元；驳回魏信喜要求由田明、圣怀友、和旭公司给付赔偿款及其他诉讼请求。 |
