| In accordance with the spirit of the Notice by the State Council of Several Measures for Supporting the Deepening of Reform and Innovation in Pilot Free Trade Zones (No. 38 [2018], State Council) and the Framework Plan for the Lin-gang Special Area of China (Shanghai) Pilot Free Trade Zone (No. 15 [2019], State Council) and with the approval of the China Banking and Insurance Regulatory Commission (“CBIRC”), the formation, relocation and cancellation of insurance branch offices at the level of sub-branch or below in China (Shanghai) Pilot Free Trade Zone (including Lin-gang Special Area) shall be subject to recordation administration instead of approval administration. The Shanghai Office of the China Banking and Insurance Regulatory Commission (“Shanghai Office of the CBIRC”) has developed the Measures for the Recordation Administration of the Formation, Relocation and Cancellation of Insurance Branch Offices in China (Shanghai) Pilot Free Trade Zone (Including Lin-gang Special Area), which are hereby issued to you for your compliance and implementation. | | 根据《国务院关于支持自由贸易试验区深化改革创新若干措施的通知》（国发〔2018〕38号）、《中国（上海）自由贸易试验区临港新片区总体方案》（国发〔2019〕15号）精神，并经中国银保监会同意，在上海自贸试验区（含新片区）对保险支公司及以下分支机构的设立、迁址、撤销管理由审批改为备案。上海银保监局制定了《上海自贸试验区（含新片区）保险分支机构设立、迁址、撤销备案管理办法》，现印发给你们，请遵照执行。 |

| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For the purposes of implementing the spirit of the Notice by the State Council of Several Measures for Supporting the Deepening of Reform and Innovation in Pilot Free Trade Zones (No. 38 [2018], State Council) and the Framework Plan for the Lin-gang Special Area of China (Shanghai) Pilot Free Trade Zone (No. 15 [2019], State Council), and boosting China (Shanghai) Pilot Free Trade Zone (including Lin-gang Special Area) (hereinafter referred to as the “SHFTZ (including Lin-gang Special Area)”) to deepen the reform of simplification of administrative procedures, decentralization of powers, combination of decentralization with appropriate control, and optimization of services in the insurance field, these Measures are hereby developed in accordance with the spirit of relevant documents issued by the CBIRC. | | 第一条 为贯彻落实《国务院关于支持自由贸易试验区深化改革创新若干措施的通知》（国发〔2018〕38号）、《中国（上海）自由贸易试验区临港新片区总体方案》（国发〔2019〕15号）精神，推进中国（上海）自由贸易试验区（含新片区）（下简称“上海自贸试验区（含新片区）”）保险领域深化简政放权、放管结合、优化服务改革，现根据中国银保监会有关文件精神，特制定本办法。 |
| Article 2 The recordation matters to which these Measures apply shall include: | | 第二条 本办法适用备案事项包括： |
| (1) formation of insurance branch offices at the level of sub-branch or below in SHFTZ (including Lin-gang Special Area); | | （一）在上海自贸试验区（含新片区）设立保险支公司及以下分支机构； |
| (2) change of the addresses of business premises of insurance branch offices at the level of sub-branch or below in SHFTZ (including Lin-gang Special Area); and | | （二）在上海自贸试验区（含新片区）的保险支公司及以下分支机构营业场所地址变更； |
| (3) cancellation of insurance branch offices at the level of sub-branch or below in SHFTZ (including Lin-gang Special Area). | | （三）在上海自贸试验区（含新片区）的保险支公司及以下分支机构撤销。 |
| The relocation of insurance branch offices at the level of sub-branch or below from areas outside SHFTZ to SHFTZ (including Lin-gang Special Area) shall be subject to recordation administration; and the relocation of them from SHFTZ(including Lin-gang Special Area) to areas outside SHFTZ shall not be subject to the recordation administration. | | 保险支公司及以下分支机构自区外迁址至上海自贸试验区（含新片区），实施备案管理；自上海自贸试验区（含新片区）迁址至区外，不适用备案管理。 |
| Article 3 As authorized by the CBIRC, the Shanghai Office of the CBIRC shall be responsible for the administration of the aforementioned recordation matters. | | 第三条 根据中国银保监会授权，由上海银保监局对上述备案事项实施管理。 |
| Chapter II Recordation Conditions | | 第二章 备案条件 |
Article 4 The branch offices of insurance companies to be formed upon recordation shall meet the Provisions on the Administration of Insurance Companies, the Administrative Measures for the Market Access of the Branch Offices of Insurance Companies, and other relevant requirements for access of institutions. The Shanghai Office of the CBIRC shall not grant recordation to those failing to meet the requirements.
