| Article 1 For the purposes of implementing the spirit of the 19th CPC National Congress, advancing the reform of "online integrated data processing" for disputes over damages in road traffic accidents (hereinafter referred to as the "online integrated processing") in depth, further regulating online integrated processing, these Rules are developed in accordance with the Tort Law of the People's Republic of China, the Insurance Law of the People's Republic of China, the Road Traffic Safety Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the People's Mediation Law of the People's Republic of China, and other laws as well as the Notice of the Supreme People's Court, the Ministry of Public Security, the Ministry of Justice, and the China Insurance Regulatory Commission on Launching the Pilot Program of the Reform of "Online Integrated Data Processing" for Disputes over Damages Arising from Road Traffic Accidents in Certain Regions in China and other rules. | | 第一条 为贯彻落实党的十九大精神，深入推进道路交通事故损害赔偿纠纷“网上数据一体化处理”（以下简称道交纠纷网上一体化处理）改革工作，进一步规范道交纠纷网上一体化处理工作，根据《中华人民共和国侵权责任法》《中华人民共和国保险法》《中华人民共和国道路交通安全法》《中华人民共和国民事诉讼法》《中华人民共和国人民调解法》等法律以及《最高人民法院公安部司法部中国保险监督管理委员会关于在全国部分地区开展道路交通事故损害赔偿纠纷“网上数据一体化处理”改革试点工作的通知》等相关规定，制定本规范。 |

| Article 3 Online integrated processing shall be conducted in accordance with the law, in a fair manner, by procedures as provided for by the laws, administrative regulations and judicial interpretations. The lawful rights and interests of the parties and other interested parties shall not be harmed, the basic principles of law shall not be violated, and the public interests shall not be harmed. | | 第三条 开展道交纠纷网上一体化处理工作应当依法、公正进行，遵守法律、行政法规和司法解释规定的程序，不得损害当事人及其他利害关系人的合法权益，不得违反法律的基本原则，不得损害社会公共利益。 |

| Article 6 People's courts shall closely cooperate, strengthen information sharing, establish an online integrated processing platform, continually raise the level of information technology, and jointly advance the online integrated processing reform with 'the traffic administration departments of the public security authorities, justice departments, and insurance regulatory authorities. | | 第六条 人民法院与公安机关交通管理部门、司法行政机关、保险监管机构应当密切协作配合，加强信息共享，建立道交纠纷网上一体化处理平台，不断提高信息化水平，共同推进道交纠纷网上一体化处理改革。 |
| Chapter II Working Mechanisms | | 第二章 工作机制 |
| Article 7 People's courts, traffic administration departments of the public security authorities, justice departments, insurance regulatory authorities, and insurance industry associations shall, based on the actual circumstances, establish a communication and coordination mechanism for online integrated processing and establish a joint meeting system. | | 第七条 人民法院、公安机关交通管理部门、司法行政机关、保险监管机构、保险行业协会应当根据实际情况，建立道交纠纷网上一体化处理工作沟通协调机制，建立联席会议制度。 |
| Article 8 People's courts, traffic administration departments of the public security authorities, justice departments, and insurance regulatory authorities shall establish an information sharing mechanism, promote the interconnection and connectivity between information systems, and realize multi-department and multi-link information sharing, so as to ensure the orderly operation of the online integrated processing platform. | | 第八条 人民法院、公安机关交通管理部门、司法行政机关、保险监管机构应当建立信息共享机制，推动信息系统间对接互通，实现多部门多环节信息共享，确保道交纠纷网上一体化处理平台有序运行。 |
| Article 9 For online integrated processing, a sharing and multi-link access mechanism shall be established. After a dispute occurs, a party may directly access the online integrated processing platform to use the claim calculator, or directly apply for mediation or bring an action online; and the mediation organization shall, upon receipt of an mediation application from a party, or from a party under the guidance of the traffic administration department of the public security authority, or the people's court, access the platform to conduct online mediation, so as to maximize the use of platform resources and effectively resolve disputes. | | 第九条 道交纠纷网上一体化处理工作建立共享共用和多环节进入机制。发生纠纷后，当事人可以直接进入道交纠纷网上一体化处理平台使用理赔计算器等，也可以在线直接提起调解申请或者诉讼；调解组织在接到当事人调解申请以及公安机关交通管理部门、人民法院引导当事人发起的调解申请时，进入平台在线调解，以实现平台资源最大化利用，有效化解纠纷。 |
| Article 10 For online integrated processing, a mediation first mechanism shall be established. The traffic administration departments of the public security authorities shall conduct mediation in disputes over damages arising from an accident in accordance with the law on unanimous application from the parties to the accident; and if the parties fail to unanimously apply for mediation, or reach an agreement in the mediation, in accordance with the rules, the parties may be guided in using the online integrated processing platform to initiate mediation. People's courts shall, when accepting disputes over damages arising from road traffic accidents, guide the parties in first initiating mediation before case docketing unless mediation is not appropriate, so as to resolve disputes before the litigation and reduce the costs for parties to resolve disputes. | | 第十条 道交纠纷网上一体化处理工作建立先行调解机制。公安机关交通管理部门处理道路交通事故时，根据事故当事人一致申请，依法对事故损害赔偿纠纷进行调解；当事人未按规定一致申请调解或者调解未达成协议的，可以引导当事人使用道交纠纷网上一体化处理平台发起调解。人民法院受理道路交通事故损害赔偿纠纷，除不适宜调解的外，引导当事人在登记立案前先行调解，将纠纷化解在诉前，降低当事人解决纠纷成本。 |

Article 13 People's courts shall be responsible for the building and maintenance of the online integrated processing platform, and traffic administration departments of the public security authorities, justice departments, insurance regulatory authorities, and the insurance industry shall assist in the system connectivity, jointly guarantee the sound operation of the platform, and realize information sharing and processing.
