 一、案情简介
 陈某与王某同为A村村民。在二轮土地延包中,王某通过家庭承包方式与A村村委会签订了9. 7亩耕地的承包合同。2002年,陈某与王某签订一份《耕地转让契约》,约定,王某将其家庭承包经营的9.7亩耕地中的3亩转让给陈某。签订当日,陈某即付清了转让款,王某也交付了土地。A村村委会在该《耕地转让契约》上盖章同意。2009年,案涉土地被依法征收。陈某向A村村委会领取了被征收土地相应的土地补偿费。
