| In order to further open up the field of construction services, in accordance with the Framework Plan for China (Shanghai) Pilot Free Trade Zone approved by the State Council, you are hereby notified of the following matters concerning the formation of foreign-funded construction engineering enterprises in China (Shanghai) Pilot Free Trade Zone (“SHFTZ”): | | 为进一步扩大建筑服务领域的对外开放，根据国务院批复的《中国（上海）自由贸易试验区总体方案》，现就在中国（上海）自由贸易试验区（以下简称试验区）设立的外商投资建设工程企业的有关事项通知如下： |
| I. For the purpose of this Notice, “foreign-funded construction engineering enterprises” means foreign-funded construction engineering design enterprises and foreign-funded construction enterprises formed in SHFTZ under Chinese laws and regulations. | | 一、本通知所指外商投资建设工程企业，是指根据中国法律、法规的规定，在试验区设立的外商投资建设工程设计企业、外商投资建筑业企业。 |
II. To form foreign-funded construction engineering design enterprises in SHFTZ to engage in design activities or form foreign-funded construction enterprises in SHFTZ to engage in construction activities, foreign investors shall undergo the foreign investment recordation and enterprise registration procedures, and apply for qualification certificates of construction engineering enterprises.
