Several Opinions of the High People's Court of Shanghai Municipality on Trying Civil Cases in Which the Government Claims Ecological and Environmental Damages (for Trial Implementation) 

上海市高级人民法院关于审理政府提起生态环境损害赔偿民事案件的若干意见(试行)

For the purposes of effectively trying civil cases in which the governments at all levels in the municipality claim ecological and environmental damages in accordance with the law, these Opinions are developed according to the Tort Liability Law of the People's Republic of China, the Environmental Protection Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the Interpretation of the Supreme People's Court of Several Issues on the Application of Law in the Trial of Disputes over Liability for Environmental Torts, and the Plan for Reforming the Ecological and Environmental Damages System jointly issued by the General Office of the CPC Central Committee and the General Office of the State Council, the Implementation Plan of Shanghai for the Reforming of the Ecological and Environmental Damages System, and other laws, regulations, judicial interpretations, and relevant documents. 为依法审理好本市各级政府提起的生态环境损害赔偿民事案件,根据《中华人民共和国侵权责任法》《中华人民共和国环境保护法》《中华人民共和国民事诉讼法》《最高人民法院关于审理环境侵权责任纠纷案件适用法律若干问题的解释》和中共中央办公厅、国务院办公厅联合下发的《生态环境损害赔偿制度改革方案》,以及《上海市生态环境损害赔偿制度改革实施方案》等法律法规、司法解释及相关文件的规定,制定本意见。
Article 1 (Definition) "Ecological and environment damage" means any adverse change in an environmental factor such as the atmosphere, surface water, groundwater, soil, and forests, or a biological element such as plants, animals, and microorganisms, caused by environmental pollution or ecological destruction and deterioration of the functions of the ecosystem composed of the foregoing factors.   第一条 (定义) 生态环境损害,是指因污染环境、破坏生态造成大气、地表水、地下水、土壤、森林等环境要素和植物、动物、微生物等生物要素的不利改变,以及上述要素构成的生态系统功能退化。
Article 2 (Party to bring a lawsuit) For an ecological and environment damage within the jurisdiction of each district, the district people's government or any department or agency designated by it is entitled to bring a civil action for ecological and environmental damages.   第二条 (提起诉讼的主体) 各区管辖范围内的生态环境损害,区人民政府或者其指定的部门、机构有权提起生态环境损害赔偿民事诉讼。
For an ecological and environment damage within the limit of ecological and environmental protection across administrative divisions of the municipality for which a municipal agency is responsible, or within a particular region of which the municipal government delegates the management to a relevant department, the municipal people's government or any department or agency designated by it is entitled to bring a civil action for ecological and environmental damages. 本市内跨行政区、市级机关作为责任主体的生态保护红线范围内、市政府授权相关部门管理的特定区域内的生态环境损害,市人民政府或者其指定的部门、机构有权提起生态环境损害赔偿民事诉讼。
Article 3 (Application for Judicial Confirmation) Where a right holder for ecological and environmental damages or any department or agency designated by it and the obligor reach a compensation agreement through consultation, the parties may apply to the basic-level people's court of competent jurisdiction for judicial confirmation according to the law.   第三条 (司法确认的申请) 生态环境损害赔偿权利人或者其指定的部门、机构与义务人经过磋商达成赔偿协议的,双方当事人可以依法向有管辖权的基层人民法院申请司法确认。
Article 4 (Review for Judicial Confirmation) Where the people's court holds that the compensation agreement meets the conditions for confirmation, it shall confirm the compensation agreement according to the law.   第四条 (司法确认的审查) 人民法院经审查认为赔偿协议符合确认条件的,应当依法确认赔偿协议。
If the people's court discovers that the compensation agreement damages the national interest or the public interest or otherwise entails denial, it shall deny confirmation. 人民法院发现赔偿协议存在侵害国家利益、社会公共利益等不能进行确认情形的,应当不予确认赔偿协议。
Article 5 (Prerequisites for Action) Before a right holder for ecological and environmental damages or any department or agency designated by it institutes a civil action for ecological and environmental damages, the environmental protection supervision and administration authority may, by actively exercising its power of administrative punishment, supervise the obligor abating damage, eliminating danger, restoring the environment and promote timely protection of the ecology and environment. If the obligor disagrees with the administrative punishment and requests administrative reconsideration or institutes administrative litigation, the right holder for ecological and environmental damages or any department or agency designated by it may institute a civil action for ecological and environmental damages upon closing of the administrative reconsideration or administrative litigation. If the judicial authority has imposed criminal punishment on the obligor, a civil action for ecological and environmental damages may be instituted without the administrative punishment procedure instituted.   第五条 (起诉前置条件) 生态环境损害赔偿权利人或者其指定的部门、机构启动生态环境损害赔偿民事诉讼之前,环境保护监督管理部门可以通过积极履行行政处罚职权,督促义务人主动停止侵害、消除危险、修复环境,促进生态环境得到及时保护。如果义务人对行政处罚不服,提出行政复议或行政诉讼的,可以在行政复议或行政诉讼结束后,生态环境损害赔偿权利人或者其指定的部门、机构再启动生态环境损害赔偿民事诉讼。司法机关已经对义务人予以刑事处罚的,可以不经行政处罚程序,直接启动生态环境损害赔偿民事诉讼。
A right holder for ecological and environmental damages or any department or agency designated by it shall consult with the obligor before instituting a civil action for ecological and environmental damages and may institute such a civil action only if a compensation agreement is impossible. 生态环境损害赔偿权利人或者其指定的部门、机构在提起生态环境损害赔偿民事诉讼前,应当先与义务人磋商,确实无法达成赔偿协议的,才可以提出相应的民事诉讼。
Article 6 (Scope of Action) Under any of the following circumstances, a right holder for ecological and environmental damages or any department or agency designated by it shall be entitled to bring a civil action for ecological and environmental damages:   第六条 (起诉范围) 有下列情形之一,生态环境损害赔偿权利人或者其指定的部门、机构有权提起生态环境损害赔偿民事诉讼:
(1) A relatively major or more serious sudden environmental incident. (一)发生较大及以上突发环境事件的;
(2) An environmental pollution or ecological destruction incident in a key ecological functional zone or off-limits development zone delineated in the national or municipal main functional zone plan. (二)在国家和市级主体功能区规划中划定的重点生态功能区、禁止开发区发生环境污染、生态破坏事件的;
(3) A general or more serious sudden environmental damage incident within the limit of ecological protection in the municipality (land areas outside the off-limits development zone). (三)本市生态保护红线范围内(禁止开发区以外的陆域)发生一般及以上突发环境损害事件的;
(4) Illegal discharge of pollution that causes serious damage to the ecology and environment, or results in loss of the basic functions of cultivated land, forest, green land, tidal flats, wetland, fishery waters or other water resources, or the like or any other serious consequence.

 (四)违法排放污染物,造成生态环境严重损害,导致耕地、森林、绿地、滩涂、湿地、渔业水域及其他水资源等基本功能丧失或者其他严重后果的;
