| Opinions on Facilitating the Registration of Foreign-Funded Enterprises | | 关于促进外商投资企业注册便利化的意见 |
| For the purposes of implementing the spirit of the report of the 19th CPC National Congress and General Secretary Xi Jinping's important speech entitled “Standing in the Forefront of China in Four Aspects”, especially standing in the forefront in creating a new pattern of opening up on all fronts, further deepening the reform of the business system, improving the business environment for foreign investors and stimulating the vitality of foreign investment market players, in accordance with the Company Law of the People's Republic of China and the Regulations of Guangdong Province on Commercial Registration and other laws and regulations and in light of the registration of foreign-funded enterprises in Guangzhou, the following opinions are hereby offered: | | 为贯彻落实党的十九大报告和习近平总书记“四个走在全国前列”重要讲话精神，特别是在形成全面开放新格局上走在全国前列的要求，进一步深化商事制度改革，优化外资营商环境，激发外资市场主体活力，根据《中华人民共和国公司法》《广东省商事登记条例》等法律法规，结合我市外商投资企业注册情况，现提出如下意见： |
| I. Allowing foreign investors' names or trade names to be used in enterprise name | | 一、允许企业名称中使用外国投资者名称或商号 |
| If a foreign investor's name or trade name is to be used in an enterprise name, a combination of factors including its historical background, brand effect and awareness shall be taken into comprehensive consideration, so that the enterprise's will may be respected to the greatest extent possible. Unless expressly prohibited by laws and regulations, a foreign-funded enterprise shall be allowed to use expressions such as its foreign investor's name or trade name in its name. | | 对于企业名称中拟使用外国投资者名称或商号的，综合考虑其在国外的历史背景、品牌效应及知名度等因素，最大程度地尊重企业意愿，除法律、法规明确禁止外，允许外商投资企业在名称中使用外国投资者名称或商号等表述。 |
| II. Allowing enterprises to independently describe their business scope | | 二、允许企业经营范围自主表述 |
If a foreign-funded enterprise does not involve the special management measures for foreign investment access, its business scope may be independently described according to the Guiding Catalog of Industries with Foreign Investment or the industrial classification for national economic activities, or by reference to the description about its business scope as set out in the approval documents by the original approval organ. Foreign-funded enterprises in new business forms or new industries are allowed to independently describe their business scope.
