If an employee does boldly what is righteous and suffers injury resulting from stopping an illegal or criminal act, the injury shall be that resulting from maintaining public benefits as provided in paragraph 1(2), Article 15 of the Regulation on Work-Related Injury Insurance and be treated as work-related injury. 职工见义勇为,为制止违法犯罪行为而受到伤害的,属于《工伤保险条例》第十五条第一款第二项规定的为维护公共利益受到伤害的情形,应当视同工伤。

Basic Facts 基本案情
Luo Renjun was a security guard with Chongqing Municipality Fuling Zhida Property Management Co., Ltd. (hereinafter referred to as the "Property Company"). On December 24, 2011, Luo Renjun was on duty (24 hours/day) in the Yuanmengyuan Community for which Property Company provided services. At about 8:30, a pedestrian was robbed near the Hongfu Building in Xinghua Middle Road. After hearing the scream, Luo Renjun immediately stopped the robber, requiring the robber to hand over the stolen property, and inadvertently fell off the 22nd step to the platform at the corner of an alley in the process of fighting the robber. On June 12, 2012, Luo Renjun filed an application for determination of work-related injury with defendant, the Human Resources and Social Security Bureau of Fuling District, Chongqing (hereinafter referred to as the "Social Security Bureau"). The Social Security Bureau granted acceptance that same day and delivered the Notice of Suspension of Determination of Work-Related Injury to Luo Renjun on June 13, 2012, requiring Luo Renjun to submit supplements for determination of his righteous and courageous conduct. On July 20, 2012, Luo Renjun made relevant supplements. Upon verification, the Social Security Bureau made the Decision on Determination of Work-Related Injury No. 676 [2012], Decision, Determination, Work-Related Injury Insurance, Human Resources and Social Security, Fuling, according to the provisions of Article 14 (7) of the Regulation on Work-Related Injury Insurance on August 9, 2012, determining the injury suffered by Luo Renjun to be work-related injury. Property Company was dissatisfied and filed administrative litigation in the court. 罗仁均系重庆市涪陵志大物业管理有限公司(以下简称涪陵志大物业公司)保安。2011年12月24日,罗仁均在涪陵志大物业公司服务的圆梦园小区上班(24小时值班)。8时30分左右,在兴华中路宏富大厦附近有人对一过往行人实施抢劫,罗仁均听到呼喊声后立即拦住抢劫者的去路,要求其交出抢劫的物品,在与抢劫者搏斗的过程中,不慎从22步台阶上摔倒在巷道拐角的平台上受伤。罗仁均于2012年6月12日向被告重庆市涪陵区人力资源和社会保障局(以下简称涪陵区人社局)提出工伤认定申请。涪陵区人社局当日受理后,于2012年6月13日向罗仁均发出《认定工伤中止通知书》,要求罗仁均补充提交见义勇为的认定材料。2012年7月20日,罗仁均补充了见义勇为相关材料。涪陵区人社局核实后,根据《工伤保险条例》第十四条第七项之规定,于2012年8月9日作出涪人社伤险认决字﹝2012﹞676号《认定工伤决定书》,认定罗仁均所受之伤属于因工受伤。涪陵志大物业公司不服,向法院提起行政诉讼。
