Although Bitcoin (BIC), as a kind of token, doesn't enjoy the status of the legislative currency, it holds attributes as a commodity and thus can be purchased as a commodity by using the currency in accordance with the law. Accordingly, the trading of Bitcoin and Bitcoin miners are not prohibited by Chinese laws and regulations. | | 一、比特币作为代币的一种，虽不具有货币属性，但其具有商品属性，可以作为商品被依法使用货币购买，我国法律、行政法规并未禁止比特币以及比特币“挖矿机”买卖。 |

The Law on the Protection of Consumer Rights and Interests is developed for the purposes of protecting the lawful rights and interests of consumers, and maintaining the stability of the social and economic order. | | 2018年1月4日，原告陈某在被告甲公司经营的网站购买比特币“挖矿机”，订单总额612000元，并对发货时间和配送方式予以约定。次日，原告陈某向被告甲公司全额支付商品价款。原告在预付全部货款后得知中国人民银行已经联合多部委下发《关于防范代币发行融资风险的公告》，要求立即停止各类代币发行融资活动。原告陈某认为案涉机器作为比特币的专门“挖矿机”已无使用价值，且设备交易涉嫌违法，故提出退款申请，被告拒绝。原告陈某认为双方通过网站购物应当遵守网络交易管理有关规定，消费者有权自收到货物之日起七日内无理由退货，原告陈某在收到货物前已经提出退货申请，符合法律规定，被告甲公司应退还货款。 |

| | 法院经审理认为，原、被告通过互联网以数据电文形式订立比特币“挖矿机”买卖合同，系双方真实意思表示，合同依法成立。比特币是互联网技术发展后在互联网环境中生成的虚拟物品，由网络节点的计算生成，和法定货币相比，没有集中的发行方，不受任何中央银行和金融机构控制，不具有法偿性与强制性等货币属性。但比特币具有商品属性，作为商品可以被接受者依法使用货币购买。本案交易标的物“挖矿机”，是专门用于运算生成比特币的机器设备，本身具有财产属性，我国法律、行政法规并未禁止比特币的生产、持有和合法流转，也未禁止买卖比特币“挖矿机”。故原告陈某主张买卖比特币矿机违法的理由不能成立，案涉合同合法有效。 |
