Implementation Opinions of the Ministry of Environmental Protection on Tightening Interim and Ex-Post Regulation of Environmental Impact Assessment of Construction Projects 

环境保护部关于强化建设项目环境影响评价事中事后监管的实施意见

The environmental protection departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government; and the Environmental Protection Bureau of Xinjiang Production and Construction Corps: 各省、自治区、直辖市环境保护厅(局),新疆生产建设兵团环境保护局:
According to the requirements of the CPC Central Committee and the State Council for the reform of simplification of administrative procedures, delegation of powers, and transformation of government functions, the environmental protection authorities at all levels continue to advance the reform of the environmental impact assessment (hereinafter referred to as the "EIA") rules, tighten the interim and ex-post regulation of EIA while simplifying, delegating, canceling administrative licensing items relating to the EIA, and has made positive progress in the work. However, some regions have ineffectively changed their mindset, and there are still phenomena of "paying attention to approval but neglecting regulation" and "paying attention to ex-ante items but neglecting ex-post ones;" in some regions are there occasionally EIA documents with fake data and falsification; and some regions have not implemented the EIA interim and ex-post regulation mechanism, and the EIA lacks "rigid" restraint effect. For the purpose of practically guaranteeing the force of the EIA rules, these Implementation Opinions on tightening interim and ex-post regulation of the EIA of construction projects are hereby offered. 根据党中央、国务院简政放权、转变政府职能改革的有关要求,各级环保部门持续推进环境影响评价(以下简称环评)制度改革,在简化、下放、取消环评相关行政许可事项的同时,强化环评事中事后监管,各项工作取得积极进展。但是,一些地方观念转变不到位,仍然存在“重审批、轻监管”“重事前、轻事中事后”现象;一些地方编造数据、弄虚作假的环评文件时常出现;一些地方环评事中事后监管机制不落地,环评“刚性”约束不强。为切实保障环评制度效力,现就强化建设项目环评事中事后监管,提出本实施意见。
I. General requirements   一、总体要求
1. Establishing a comprehensive regulatory system. The environmental protection authorities at all levels shall, according to the general requirements for simplification of administrative procedures and delegation of powers, with a problem-oriented approach, with the aim of improving the force of the EIA, adhere to the principles of determinate responsibility, collaborative regulation, openness and transparency, and credit restraint, improve the interim and ex-post regulation working mechanism for approval of project EIA, technical assessment, fulfillment of the responsibility for environmental protection by construction employers, operations of EIA entities, and all other links, and accelerate the establishment of a comprehensive regulatory system featuring government regulation, enterprises' self-regulation, and the public participation, so as to ensure that the EIA effectively plays its role in preventing environmental pollution and ecological damage from the source. (一)构建综合监管体系。各级环保部门要按照简政放权、转变政府职能的总体要求,以问题为导向,以提升环评效力为目标,坚持明确责任、协同监管、公开透明、诚信约束的原则,完善项目环评审批、技术评估、建设单位落实环境保护责任以及环评单位从业等各环节的事中事后监管工作机制,加快构建政府监管、企业自律、公众参与的综合监管体系,确保环评源头预防环境污染和生态破坏作用有效发挥。
2. Improving regulatory content. In order to tighten interim regulation, as for the environmental protection authorities, their conduct of approving the EIA, approval procedure compliance, and approval results compliance shall be inspected as priorities; as for technical assessment institutions, their capacity for technical assessment, independent technical assessment of EIA documents, and offer of assessment opinions according to the laws and regulations and whether they collect charges arbitrarily shall be inspected as priorities; as for EIA entities, whether they engage in operations in accordance with the laws and regulations and ensure the authenticity of the data and information of EIA documents, correctness of analysis methodologies, and the rationality and creditability of conclusions shall be supervised as priorities; and as for construction employers, their performance of EIA procedure and organization of public participation shall be supervised as priorities. In order to tighten ex-post regulation, as for the environmental protection authorities, their supervisory inspection of "simultaneous design, construction and use" for environmental protection of construction projects shall be inspected in priority; as for EIA entities, the quality of assessment documents shall be placed under priority in random inspection and reexamination; as for construction employers, the implementation of EIA documents and approval requirements and the implementation of "simultaneous design, construction and use" for environmental protection in design, building, acceptance check, and operation or use of projects shall be supervised in priority. (二)完善监管内容。加强事中监管,对环保部门要重点检查其环评审批行为和审批程序合法性、审批结果合规性;对技术评估机构要重点检查其技术评估能力、独立对环评文件进行技术评估并依法依规提出评估意见情况,是否存在乱收费行为;对环评单位要重点监督其是否依法依规开展作业,确保环评文件的数据资料真实、分析方法正确、结论科学可信;对建设单位要重点监督其依法依规履行环评程序、开展公众参与情况。加强事后监管,对环保部门要重点检查其对建设项目环境保护“三同时”监督检查情况;对环评单位要重点开展环评文件质量抽查复核;对建设单位要重点监督落实环评文件及批复要求,在项目设计、施工、验收、投入生产或使用中落实环境保护“三同时”及各项环境管理规定情况。
3. Specifying regulatory responsibility. According to the principle of "who grants approval is responsible," the EIA approval authorities at all levels shall be responsible in routine administration for the inspection of EIA matters of "simplification of administrative procedures, delegation of powers, combination of decentralization and control, and optimization of services" and the operations of technical assessment institutions and EIA entities. According to the principle of "territorial jurisdiction," the environmental supervisory law enforcement and nuclear and radiation safety regulators at all levels shall in routine administration tighten the inspection of the implementation of the "simultaneous design, construction and use" for environmental protection by construction employers. The Ministry of Environmental Protection and provincial environmental protection authorities shall fully use environmental protection supervision and other working mechanisms to supervise the implementation of the EIA rules by the local governments and relevant authorities. (三)明确监管责任。按照“谁审批、谁负责”的原则,各级环评审批部门在日常管理中负责对环评“放管服”事项和技术评估机构、环评单位从业情况进行检查。按照“属地管理”原则,各级环境监察执法、核与辐射安全监管部门在日常管理中加强建设单位环境保护“三同时”要求落实情况的检查。环境保护部和省级环保部门要充分运用环境保护督察等工作机制,对地方政府和有关部门落实环评制度情况开展监督。
II. Effectively supporting regulation   二、不能给市场做人工呼吸做好监管保障
4. Reforming the EIA rules according to the law. Local governments shall be encouraged to issue reform measures relating to "simplification of administrative procedures, delegation of powers, combination of decentralization and control, and optimization of services" in the EIA subject to the law, according to the principle of heightening the EIA's role in prevention in the source. The superior environmental protection authorities shall conduct supervisory guidance of the compliance of the EIA reform measures of the subordinate environmental protection authorities, require them in a timely manner to correct possible deviation, and ensure the correct direction of the reform. If the power of EIA approval is delegated, the capacity and conditions for takeover of the takeover authorities shall be comprehensively assessed, the power of the approval of the EIA of petrochemical, nonferrous metals, steel, paper making, and other projects featuring great environmental impact and high environmental risk shall be delegated prudentially, and the approval procedure and approval results of the takeover authorities shall be supervised, so as to ensure effective delegation, takeover and control. (四)依法开展环评制度改革。鼓励地方在强化环评源头预防作用的原则下,“于法有据”地出台环评“放管服”有关改革措施。上级环保部门对下级环保部门环评改革措施的依法合规性进行督导,对可能出现的偏差及时要求纠正,保证改革沿着正确的方向前行。下放环评审批权限,应综合评估承接部门的承接能力、承接条件,审慎下放石化化工、有色、钢铁、造纸等环境影响大、环境风险高项目的环评审批权,并对承接部门的审批程序、审批结果进行监督,确保放得下、接得住、管得好。
5. Determining and holding "three lines and one list." The environmental protection authorities at and above the level of cities divided into districts shall, according to the requirements of the red line of ecological protection, the bottom line of environment quality, the upper limit of resource utilization, and the environment assess negative list (hereinafter referred as to the "three lines and one list"), offer optimization of layout, structural adjustment, control of size, preservation of functions, and other regulatory strategies and environment control guiding requirements and set up regional and industry restrictive or prohibitory conditions for environment access. The environmental protection authorities at all levels shall, during the EIA approval, according to the requirements of the Notice on Strengthening Environmental Impact Assessment Administration Centering on Improving Environmental Quality (No. 150 [2016], Ministry of Environmental Protection), establish a mechanism for connection between the approval of project EIA on one side and the EIA of plans, environmental administration of existing projects, and regional environmental quality on the other side, heighten the rigid restraint effect of the "three lines and one list," and abstain from violating, changing or reducing standards. (五)架构并严守“三线一单”。设区的市级及以上环保部门要根据生态保护红线、环境质量底线、资源利用上线和环境准入负面清单(简称“三线一单”)环境管控要求,从空间布局约束、污染物排放管控、环境风险防控、资源开发效率等方面提出优布局、调结构、控规模、保功能等调控策略及导向性的环境治理要求,制定区域、行业环境准入限制或禁止条件。各级环保部门在环评审批中,应按照《关于以改善环境质量为核心加强环境影响评价管理的通知》(环环评〔2016〕150号)要求,建立“三挂钩”机制(项目环评审批与规划环评、现有项目环境管理、区域环境质量联动机制),强化“三线一单”硬约束,项目环评审批不得突破变通、降低标准。
6. Implementing list-based administration. Classification administration shall be implemented, construction project EIA documents shall be prepared according to the requirements of the Catalog of Classification Administration of Environmental Impact Assessment of Construction Projects, and the classifications of the EIA documents shall be not be changed or lowered without authorization. The hierarchical approval shall be rigorous, and the environmental protection authorities at all levels shall approve the EIA according to the Catalog of Construction Projects Whose Environmental Impact Assessment Are Subject to the Approval of the Ministry of Environmental Protection and the provisions on the hierarchical approval of EIA documents developed by all provinces in accordance with the law; the power of approval shall be delegated and adjusted according to the statutory procedures, and the superior environmental protection authorities shall not arbitrarily recover the delegated EIA approval items; and the approval of the EIA documents shall be authorized according to the law, and the environmental protection authorities authorizing the approval shall bear the legal liability for the consequences of authorized approval. The Ministry of Environmental Protection shall develop the principles for approval of EIA documents of construction projects and a list of definitions of material changes by industry. The provincial environmental protection authorities shall be encouraged to develop principles for approval of EIA documents of the other industries within their respective administrative regions in accordance with the laws and regulations. The local environmental protection authorities at all levels shall strictly implement the requirements for approval of EIA documents of construction projects and definitions of material changes and unify the standards for EIA administration of construction projects. (六)实施清单式管理。落实分类管理,建设项目环评文件的编制应符合《建设项目环境影响评价分类管理名录》要求,不得擅自更改和降低环评文件类别。严格分级审批,各级环保部门开展环评审批应符合《环境保护部审批环境影响评价文件的建设项目目录》和各省依法制定的环评文件分级审批规定;下放调整审批权限应履行法定程序,对下放的环评审批事项,上级环保部门不得随意上收;环评文件委托审批应依法开展,委托审批的环保部门对委托审批后果承担法律责任。环境保护部分行业制定建设项目环评文件审批原则和重大变动界定清单。鼓励省级环保部门依法依规制定本行政区内其他行业的环评文件审批原则。地方各级环保部门应严格执行建设项目环评文件审批和重大变动界定要求,统一建设项目环评管理尺度。
7. Ensuring an effective link with the pollutant discharge permitting rules. The environmental protection authorities at all levels shall take pollutant discharge permits as important guarantees for the implementation of the requirements for approval of EIA documents of fixed pollution sources, strictly review construction project environmental impact reports (report forms), and based on the technical specifications of application and issuance of pollutant discharge permits and guidelines on feasible pollution prevention and control technology, confirm the pollutant generation and discharge links of construction projects, types of pollutants, facilities and measures for pollution prevention and control, and other basic information; and according to local or national pollutant discharge standards, environmental quality standards, and requirements for total quantity control, and pursuant to the technical guidelines on computation of emission intensity and guiding rules for EIA essential elements, among others, strictly confirm the number and locations of emission outlets, types of pollutants from each discharge outlet, allowable discharge rates and discharge quantity, discharge manners, discharge destination, self-monitoring plans, and other main content relating to pollutant discharge. Construction projects shall be granted pollutant discharge permits before actual pollutant discharge, and if a construction project discharges pollutants without the permit, or in violation of the permit, the construction employer may not issue acceptance check opinions on qualified environmental protection facilities according to the provisions relating to the conditions for the acceptance check of environmental protection facilities. (七)做好与排污许可制度的衔接。各级环保部门要将排污许可证作为落实固定污染源环评文件审批要求的重要保障,严格建设项目环境影响报告书(表)的审查,结合排污许可证申请与核发技术规范和污染防治可行技术指南,核定建设项目的产排污环节、污染物种类及污染防治设施和措施等基本信息;依据国家或地方污染物排放标准、环境质量标准和总量控制要求,按照污染源源强核算技术指南、环评要素导则等,严格核定排放口数量、位置以及每个排放口的污染物种类、允许排放浓度和允许排放量、排放方式、排放去向、自行监测计划等与污染物排放相关的主要内容。建设项目发生实际排污行为之前应获得排污许可证,建设项目无证排污或不按证排污的,根据环境保护设施验收条件有关规定,建设单位不得出具环境保护设施验收合格意见。
III. Innovating on regulatory manners   三、创新监管方式
8. Using big data for regulation. The Ministry of Environmental Protection shall establish a national unified EIA application system and environmental protection acceptance check system and integrate them, along with the environmental impact registration forms recordation system, the pollutant discharge permits administration system, and the environmental law enforcement system, into the "intelligent EIA" consolidated regulatory platform. The collection and related consolidation of the data relating to the EIA shall be intensified, the early warning indicator system for the EIA regulation shall be developed, the availability of regulation-oriented data shall be heightened, and an intelligent mode of discovery of source abnormality, identification of process problems, and push of punishment of violation of law shall be built, so as to achieve intelligent push of regulatory information and intelligent launch of regulatory business. The environmental protection authorities at all levels shall use big data, Internet plus, and other information technology to implement intelligent, precise, and efficient interim and ex-post regulation of the EIA. (八)运用大数据进行监管。环境保护部建设全国统一的环评申报系统、环境保护验收系统,并与环境影响登记表备案系统、排污许可管理系统、环境执法系统进行整合,统一纳入“智慧环评”综合监管平台。强化环评相关数据采集和关联集成,制定环评监管预警指标体系,增强面向监管的数据可用性,建立源头异常发现、过程问题识别、违法惩戒推送的智能模型,实现监管信息智能推送、监管业务智能触发。各级环保部门要运用大数据、互联网+等信息技术手段,实施智能、精准、高效的环评事中事后监管。
9. Conducting random inspection of randomly selected entities by randomly selected inspectors. The Ministry of Environmental Protection shall be responsible for organizing and coordinating the random inspection of interim and ex-post regulation of the EIA across the country, and the local environmental protection authorities at all levels shall be responsible for the random inspection within their respective administrative regions. The priorities of the random inspection shall be the preparation and approval of environmental impact reports (report forms), recordation of environmental impact registration forms and undertaking fulfillment, implementation of the "simultaneous design, construction and use" for environmental protection, acceptance check of environmental protection, and the fulfillment of relevant primary responsibility. The environmental protection authorities at all levels shall depend on the EIA application system, the environmental protection acceptance check system, and other databases to randomly select entities to inspect. The construction projects inspected each year in petroleum processing, chemical engineering, nonferrous metals smelting, cement, paper making, plate glass, steel, and other critical industries shall not be less than 10%. As for projects with records of serious violation of the law or regulations, or high environmental risks, the random inspection proportion shall be raised, or target-specific regulation shall be implemented. For the violation of the law or regulations discovered in the random inspection, punishment shall be imposed according to the law, and accountability shall be enforced. The inspection information and punishment results shall be disclosed to the public in a timely manner. (九)开展双随机抽查。环境保护部负责组织协调全国环评事中事后监管抽查工作,地方各级环保部门负责本行政区的随机抽查工作。抽查重点事项为环境影响报告书(表)编制及审批情况、环境影响登记表备案及承诺落实情况、环境保护“三同时”落实情况、环境保护验收情况及相关主体责任落实情况等。各级环保部门以环评申报系统、环境保护验收系统等数据库为依托,随机抽取产生抽查对象。每年抽查石油加工、化工、有色金属冶炼、水泥、造纸、平板玻璃、钢铁等重点行业建设项目数量的比例应当不低于10%。对有严重违法违规记录、环境风险高的项目应提高抽查比例、实施靶向监管。对抽查发现的违法违规行为,要依法惩处问责。抽查情况和查处结果要及时向社会公开。
10. Using the regulatory role of post-environmental impact assessment. For any construction project of which a post-environmental impact assessment shall be made in accordance with the law, the work shall be conducted in a timely manner to follow, monitor, verify and assess the environmental impact it actually has and the effectiveness of pollution prevention and control, ecological protection, and risk prevention measures and offer remedial plans and improvement measures. The pollutant discharge permit implementation reports, ledgers, self-monitoring, and other information of construction projects under pollutant discharge permitting administration shall be used as an important basis of post-environmental impact assessment. (十)发挥环境影响后评价监管作用。依法应当开展环境影响后评价的建设项目,应及时开展工作,对其实际产生的环境影响以及污染防治、生态保护和风险防范措施的有效性进行跟踪监测和验证评价,并提出补救方案或者改进措施。纳入排污许可管理的建设项目排污许可证执行报告、台账记录和自行监测等情况应作为环境影响后评价的重要依据。
IV. Strengthening the administration of technical institutions   四、强化技术机构管理
11. Strengthening the administration of the quality of EIA documents. The Ministry of Environmental Protection shall develop measures for the administration of the technical reexamination of EIA documents, and the superior environmental protection authorities may conduct technical reexamination of the construction project environmental impact reports (report forms) approved by the subordinate environmental protection authorities. The means of technical reexamination shall be improved, and manual reexamination and intelligent verification shall be used together to verify the consistency of regulations, space and technology in EIA documents. If a material technical quality problem is determined in the technical reexamination, the approval authority shall be notified and, if the approval conclusion is affected, required to take corrective measures. The technical reexamination of EIA documents and the correction results shall be disclosed to the public. (十一)加强环评文件质量管理。环境保护部制定环评文件技术复核管理办法,上级环保部门可以对下级环保部门审批的建设项目环境影响报告书(表)开展技术复核。完善技术复核手段,采取人工复核和智能校核相结合方式,开展环评文件法规、空间、技术一致性校核。对技术复核判定有重大技术质量问题的,要向审批部门进行通报,对影响审批结论的,应要求采取整改措施。环评文件技术复核及处理结果向社会公开。
12. Using the role of technical assessment. The environmental protection authorities at all levels may commission technical assessment institutions to conduct technical assessment of environmental impact reports (report forms) by means of government procurement. Technical assessment institutions shall improve the modes and methodologies of technical assessment and technical means, strictly control the technical threshold for EIA approval, pay particular attention to reviewing the environmental feasibility of construction projects, the reliability of the analysis, prediction and assessment of environmental impact, the effectiveness of environmental protection measures, and the rationality of environmental impact assessment conclusions, among others, and be responsible for the technical assessment opinions they have offered. (十二)发挥技术评估作用。各级环保部门可通过政府采购方式委托技术评估机构开展环境影响报告书(表)的技术评估。技术评估机构要改进技术评估方式方法,完善技术手段,为环评审批严把技术关,重点审查建设项目的环境可行性、环境影响分析预测评估的可靠性、环境保护措施的有效性、环境影响评价结论的科学性等,并对其提出的技术评估意见负责。
13. Regulating EIA technical services. A construction employer may select an EIA entity with corresponding capacity by commission, public bidding, or any other means to conduct environmental impact assessment of its construction projects and prepare construction project environmental impact reports (report forms). EIA entities shall continue to improve their capability and level of services and ensure the authenticity and rationality of the environmental impact reports (forms) they have prepared. The Ministry of Environmental Protection shall develop measures for the administration of the EIA technical service industry, regulate EIA technical services, and, by depending on the National EIA Entities and Personnel Honesty Administration System, promote EIA entities and personnel so that they comply with industry standards and professional ethics. Recommended guidelines on the technical capability of construction project EIA entities shall be developed, and recommended indicators of the professional capability of EIA entities preparing environmental impact reports for significant construction projects shall be offered. (十三)规范环评技术服务。建设单位可以委托或者采取公开招标等方式选择具有相应能力的环评单位,对其建设项目进行环境影响评价、编制建设项目环境影响报告书(表)。环评单位应不断提高服务能力和水平,确保编制的环境影响报告书(表)的真实性和科学性。环境保护部制定环评技术服务行业管理办法,规范环评技术服务从业行为,依靠全国环评单位和人员的诚信管理体系推动环评单位和人员恪守行业规范和职业道德。制定建设项目环评单位技术能力推荐性指南,提出编制重大建设项目环境影响报告书的环评单位专业能力推荐性指标。
V. Strengthening punishment and accountability   五、加大惩戒问责力度
14. Strictly investigating liability for EIA approval. Non-strict implementation of the provisions with regard to hierarchical approval or classification administration of EIA documents, approval beyond authority, approval by splitting, approval in disguise, and other violation of the law or regulations shall be strictly investigated and punished. If a construction project lacks conformity with any environmental protection law or regulations, or any relevant legal plan, if the environmental quality of a region does not meet the standards, and the measures the construction project proposes to take cannot meet the object of improvement of the region's environmental quality, if the measures taken cannot ensure standard pollutant discharge, or no necessary measures are taken to prevent and control ecological damage, if a reconstruction, expansion or technical improvement project fails to offer effective prevention and control measures against the existing environmental pollution or ecological damage, or if the EIA documents are approved even if the basic information in the EIA documents is conspicuously fake, there is a material defect or omission in the content, the assessment conclusion is ambiguous or unreasonable, but approval is granted still, liability shall be investigated according to the law. Under circumstances as enumerated in the Measures for the Administration of Regional Restrictions on the Approval of Environmental Impact Assessment of Construction Projects (for Trial Implementation), the approval of the construction project EIA documents in the relevant regions shall be suspended. (十四)严格环评审批责任追究。严肃查处不严格执行环评文件分级审批和分类管理有关规定,越权审批、拆分审批、变相审批等违法违规行为。在建设项目不符合环境保护法律法规和相关法定规划、所在区域环境质量未达标且建设项目拟采取的措施不能满足区域环境质量改善目标、采取的措施无法确保污染物达标排放或未采取必要措施预防和控制生态破坏、改扩建和技术改造项目未针对原有环境污染和生态破坏提出有效防治措施,或者环评文件基础资料明显不实、内容存在重大缺陷、遗漏,评价结论不明确、不合理等情况下批复环评文件的,要依法进行责任追究。对符合《建设项目环境影响评价区域限批管理办法(试行)》所列情形的,暂停审批有关区域的建设项目环评文件。
15. Strictly investigating and punishing illegal conduct in the EIA. The commencement of the work on construction projects without EIA documents approved, failure to file environmental impact registration forms according to the law, and other illegal conduct shall be investigated and punished according to the law. The failure of construction employers to implement the measures for preventing and controlling pollution and ecological damage in the preliminary design of construction projects, failure to organize and implement environmental protection measures over the course of building at the same time, putting environmental protection facilities into operation or use without being placed under acceptance check, or despite failing the acceptance check, failure to disclose the environmental protection facilities acceptance check report to the public, failure to conduct post-environmental impact assessment according to the law, and other illegal conduct, shall be investigated and punished according to the law. For regions with prominent illegal problems in the EIA of construction projects, the persons in charge of the local governments and relevant authorities shall be interviewed. (十五)严格环评违法行为查处。依法查处建设项目环评文件未经审批擅自开工建设、不依法备案环境影响登记表等违法行为。依法查处建设单位在建设项目初步设计中未落实防治污染和生态破坏的措施、建设过程中未同时组织实施环境保护措施、环境保护设施未经验收或者验收不合格即投入生产或使用、未公开环境保护设施验收报告、未依法开展环境影响后评价等违法行为。对建设项目环评违法问题突出的地区,要约谈地方政府及相关部门负责人。
16. Strictly regulating the EIA practice. The environmental protection authorities at all levels shall establish credit archives for EIA entities and professionals, keep records of ill preparation of construction project environmental impact reports (report forms), interruption of the order of the EIA market, and other negative credit information and the information of administrative punishment, and disclose them to the public. The Ministry of Environmental Protection shall circulate a notice in a regular and consolidated manner of the lists of entities and professionals that have been dishonest for a number of times. The irresponsibility or falsehood causing a construction project environmental impact report (report form) to be unfounded or have serious quality problems, or other conduct of an EIA entity or professional shall be strictly investigated and punished; if environmental pollution, ecological damage, or any other serious consequence is caused, joint and several liability shall be investigated; and if the conduct is criminally punishable, the offender shall be held criminally liable in accordance with the law. The environmental protection authorities at all levels and the public institutions affiliated thereto and their employees shall not engage in the preparation of construction project environmental impact reports (report forms), otherwise the violator and the person in charge of the corresponding authority shall be seriously held liable. (十六)严格环评从业监管。各级环保部门应建立环评单位和人员的诚信档案,记录建设项目环境影响报告书(表)编制质量差、扰乱环评市场秩序等不良信用情况和行政处罚情况,并向社会公开。环境保护部定期对累积失信次数多的单位和人员名单进行集中通报。严肃查处环评单位及人员不负责任、弄虚作假致使建设项目环境影响报告书(表)失实或存在严重质量问题等行为;造成环境污染或生态破坏等严重后果的,还应追究连带责任;构成犯罪的,依法追究刑事责任。各级环保部门及其所属事业单位和人员不得从事建设项目环境影响报告书(表)编制,一经发现应严肃追究违规者及所在部门负责人责任。
17. Imposing punishment for dishonesty. According to the requirements of the Guiding Opinions of the State Council on Establishing and Improving a System of Joint Incentive for Honesty and Joint Punishment for Dishonesty and Accelerating the Advancement of the Development of Social Honesty (No. 33 [2016], State Council) and the Memorandum of Understanding of 31 Departments including the National Development and Reform Commission and the Ministry of Environmental Protection on Jointly Punishing Dishonest Producers and Distributors and Their Relevant Personnel in the Field of Environmental Protection北大法宝 (No. 1580 [2016], NDRC), the environmental protection authorities at all levels shall promptly enter the administrative punishment, administrative compulsion, and other information of construction employers, EIA entities, technical assessment institutions, and their relevant personnel in the local or national credit information sharing platforms, implement the cross-departmental joint punishment mechanism, promote all the authorities so as to restrict or prohibit according to the laws and regulations the market access, administrative licensing or financing raising of relevant seriously dishonest entities, their legal representatives, and relevant liable persons and cease the implementation of the environmental protection, finance, and tax incentives enjoyed by them or take other punishment measures. (十七)实施失信惩戒。根据国务院《关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)和国家发展改革委、环境保护部等31部门《关于对环境保护领域失信生产经营单位及其有关人员开展联合惩戒的合作备忘录》(发改财金〔2016〕1580号)要求,各级环保部门应当及时将对建设单位、环评单位、技术评估机构及其有关人员作出的行政处罚、行政强制等信息纳入全国或者本地区的信用信息共享平台,落实跨部门联合惩戒机制,推动各部门依法依规对严重失信的有关单位及法定代表人、相关责任人员采取限制或禁止市场准入、行政许可或融资行为,停止执行其享受的环保、财政、税收方面优惠政策等惩戒措施。
VI. Forming joint social government   六、形成社会共治
18. Implementing EIA information disclosure mechanisms and plans. The environmental protection authorities at all levels shall improve the construction project EIA information disclosure mechanism and the internal supervision mechanism to disclose the EIA information of construction projects in accordance with the laws and regulations and advance the transparent approval of the EIA. The supervisory restraints on construction employers shall be tightened, and the whole-process and whole-coverage disclosure of the EIA information of construction projects shall be implemented, so as to ensure that the public can easily access to the EIA information of construction projects. The channels for public participation and social supervision shall be kept unimpeded, and the environmental interests of the public possibly affected by construction projects shall be guaranteed. (十八)落实环评信息公开机制方案。各级环保部门应健全建设项目环评信息公开机制和内部监督机制,依法依规公开建设项目环评信息,推进环评“阳光审批”。强化对建设单位的监督约束,落实建设项目环评信息的全过程、全覆盖公开,确保公众能够方便获取建设项目环评信息。畅通公众参与和社会监督渠道,保障可能受建设项目环境影响公众的环境权益。
19. Using the supervisory role of public participation in the EIA. Before submitting its construction project environmental impact report for approval, an construction employer shall, in an appropriate form and according to the principles of compliance with the law, order, openness, and convenience, request public comments and be responsible for the authenticity and results of public participation. The environmental protection authorities at all levels shall supervise construction employers to request public participation according to the law to ensure the right to knowledge of, participation in and supervision of environmental protection of the public. The formation of an environment governance system featuring multi-party participation and joint social governance shall be advanced. (十九)发挥公众参与环评的监督作用。建设单位在建设项目环境影响报告书报送审批前,应采取适当形式,遵循依法、有序、公开、便利的原则,公开征求公众意见并对公众参与的真实性和结果负责。各级环保部门应监督建设单位依法规范开展公众参与,保证公众环境保护知情权、参与权和监督权。推进形成多方参与、社会共治的环境治理体系。
VII. Strengthening organization and implementation   七、强化组织实施
20. Improving understanding. Strengthening interim and ex-post regulation of the EIA is significant for solving current prominent problems and maximizing the EIA's efficiency of source prevention. The environmental protection authorities at all levels must fully apprehend the necessity and importance of the interim and ex-post regulation of the EIA, correctly tackle the relationship between the fulfillment of regulatory responsibility and serving development, and pay attention to combining inspection with guidance, punishment with education, and regulation with services, so as to ensure that regulation is in place, in proper place, and with authority. (二十)提高思想认识。加强环评事中事后监管,对解决当前面临的突出问题,充分发挥环评源头预防效能具有重要意义。各级环保部门务必充分认识强化环评事中事后监管的必要性和重要性,正确处理履行监管职责与服务发展的关系,注重检查与指导、惩处与教育、监管与服务相结合,确保监管不缺位、不错位、不越位。
21. Strengthening organization and leadership. The environmental protection authorities at all levels shall conscientiously research and make territorial regulatory work plans based on the local actual circumstances, specify division of responsibility, detail the content of the work, enhance responsibility appraisal, establish and improve a work advancement mechanism, and vigorously enhance the implementation of the work. Environmental law enforcement administration rules in line with the characteristics of interim and ex-post regulation of the EIA and incentive rules favorable to regulatory law enforcement shall be researched and developed, regulatory law enforcement shall be tightened, and following and inspection shall be strengthened, so as to practically implement the interim and ex-post regulation of the EIA. (二十一)加强组织领导。各级环保部门要结合本地实际认真研究制定属地监管工作方案,明确职责划分,细化工作内容,强化责任考核,建立健全工作推进机制,着力强化工作执行力度。研究建立符合环评事中事后监管特点的环境执法管理制度和有利于监管执法的激励制度,强化监管执法,加强跟踪检查,切实把环评事中事后监管落到实处。
22. Effectively giving publicity and guidance. The environmental protection authorities at all levels shall strengthen the publicity given to the laws, regulations and policies relating to the EIA and encourage the whole society to participate in the interim and ex-post regulation of the EIA by various means, especially through new media, so as to create a social atmosphere of understanding, caring about and supporting interim and ex-post regulation. The main measures for and achievements in the interim and ex-post regulation of the EIA shall be vigorously publicized, relevant responsible parties shall be directed to raising their awareness of responsibility for environmental protection, the bottom line for environmental protection shall be adhered to, and a permanent mechanism for the interim and ex-post regulation of the EIA shall be established and improved. (二十二)做好宣传引导。各级环保部门要加强环评相关法律法规及政策宣传力度,通过多种形式特别是新媒体鼓励全社会参与环评事中事后监管,形成理解、关心、支持事中事后监管的社会氛围。积极宣传环评事中事后监管的主要措施、成效,引导相关责任方提高环境保护责任意识,坚守环境保护底线,健全完善环评事中事后监管工作长效机制。
