On October 29, 2009, the 11th meeting of the Standing Committee of the 11th National People's Congress attended to and deliberated the Report on Strengthening the Civil Enforcement Work and Protecting Legal Authority and Justice made by Wang Shengjun, president of the Supreme People's Court, and the members and deputies spoke highly of the report made by Mr. Wang Shengjun, and considered that the report has summarized the achievements true to the fact and thoroughly analyzed the problems, and the measures for strengthening and improving the work put forward in the report are feasible. The members and deputies participating in the meeting unanimously agreed that, in recent years, the courts at all levels throughout the country have earnestly implemented the spirit of the Central Government, voluntarily accepted the supervision of the people's congresses, effectively strengthened the building of the enforcement team and enforcement systems, taken effective measures to strengthen enforcement, carried out large-scale and intensive clear-up of long-pending enforcement cases, and achieved remarkable results in the enforcement work. However, the “hard nut of enforcement” has not yet been resolved fundamentally, and the task facing the enforcement work is even tougher. During deliberation, the members and deputies put forward some specific opinions and suggestions on strengthening the building of the enforcement team, raising the level of standardization of the enforcement work, improving the work pattern of comprehensive management of difficulty in enforcement, promoting the building of a socialintegrity system, making more efforts in enforcement relief, and improving the statistical work in enforcement.
 
2009年10月29日,十一届全国人大常委会第十一次会议听取和审议了最高人民法院王胜俊院长《关于加强民事执行工作维护法制权威和司法公正情况的报告》,委员和代表们对王胜俊院长的报告给予了高度评价,认为报告总结成绩实事求是,分析问题深刻透彻,报告中提出的加强和改进工作的措施切实可行。与会委员和代表普遍认为,近年来,全国各级法院认真贯彻落实中央精神,自觉接受人大监督,切实加强执行队伍和执行制度建设,采取有力措施加大执行力度,开展大规模集中清理执行积案活动,执行工作取得了明显成效。但是,“执行难”问题仍未从根本上得到解决,执行工作面临的任务更加艰巨。审议中,委员和代表们还就加强执行队伍建设、提高执行工作规范化水平、完善综合治理执行难的工作格局、推进社会诚信体系建设、加大执行救助力度和改进执行统计工作提出了一些具体的意见和建议。

In accordance with the deliberative opinions of the Standing Committee of the National People's Congress and the discussions of the members and deputies, and upon research of the Party group of the Supreme People's Court, we hereby notify you of further improving the enforcement work in the current and future periods as follows:
 
根据全国人大常委会的审议意见和委员、代表们讨论的情况,经最高人民法院党组研究,现就进一步做好当前和今后一个时期的执行工作,通知如下:

 
I. Paying close attention to standardizing the enforcement. The courts at all levels shall take the standardization of the enforcement work as the work theme in the current and future periods of time, and comprehensively improve the level of standardization of the enforcement work. Firstly, we shall make great efforts and take effective measures to solve the problems of random enforcement in seizure, assessment and auction, deferred enforcement, seizure of property of non-parties and other aspects. Secondly, we shall strictly apply the systems of enforcement demurs and reconsideration. Where any party raises any objection against the enforcement act or applies for reconsideration in accordance with law, we shall properly handle it so as to effectively protect the right of the party to raise objections, the right to apply for reconsideration and other relief rights. Thirdly, we shall focus on solving the problems of passive enforcement and deferred enforcement, and improve the management system for the procedure of enforcement cases. Where any party concerned complains about unfruitful enforcement, passive enforcement, deferred enforcement, etc., we shall timely verify the problems and promptly handle them. Fourthly, we shall focus on solving the problems existing in the authorized enforcement, and further improve the relevant systems for delegated enforcement; simplify the formalities for delegated enforcement and reduce the links of delegated enforcement; strengthen internal supervision and administration, establish a system dedicated for the registration of delegated enforcement cases, include the delegated cases into the case process management and uniform target evaluation, reinforce the systems of urging and supervising the handling of delegated enforcement, and strictly implement the accountability system. In 2010, the Supreme People's Court will carry out a designated clear-up of delegated enforcement cases within the national court system so as to effectively solve the long-pending delegated enforcement cases. Fifthly, we shall, in light of the common phenomenon of evading enforcement, explore the countermeasures against evaded enforcement, establish and improve the mechanism for preventing evasion of enforcement, further build consensus, broaden our thoughts, and promote the solution of the difficulty in enforcement. Sixthly, we shall further reinforce enforcement openness, effectively use the “Information Management System of Enforcement Cases of the Courts Countrywide” to disclose the enforcement processes, measures, results and other information, effectively ensure the parties' right to information, participation and supervision, and promote impartiality with openness and establish credibility on the basis of impartiality. Seventhly, we shall research and design more scientific and reasonable statistical systems for enforcement cases, detail the indicators such as the ratio of cases in which the enforcement objects are realized actually and closing methods of enforcement cases, so as to truly reflect the actual situation of the enforcement work. Eighthly, we shall strengthen investigation and research, systematically collate important links and aspects in the enforcement work and new situation and problems in the practice of enforcement, issue judicial interpretations and relevant systems as planned and by stages, and establish a sound long-term effect mechanism for the enforcement work.

   一、要狠抓规范执行。各级法院要把执行工作规范化建设作为当前和今后一个时期的工作主题,全面提高执行工作规范化水平。一是下大力气,采取有力措施,解决查封、评估拍卖、暂缓执行、查封案外人财产等方面存在的执行乱问题。二是严格适用执行异议和复议制度,当事人对执行行为依法提出异议、复议的,依法妥善处理,切实维护当事人的异议权、复议权等救济权利。三是重点解决消极执行、拖延执行问题,完善执行案件流程管理制度。当事人反映执行不力、消极执行、拖延执行等问题的,及时核查,迅速处理。四是重点解决委托执行中存在的问题,进一步完善委托执行的相关制度;简化委托执行手续,减少委托执行环节;强化内部监督和管理,建立委托执行案件专项登记制度,将受托案件纳入本院案件流程管理及统一目标考核,强化委托执行的催办、督办制度,严格责任追究制度。2010年我院将在全国法院系统开展委托执行案件专项清理活动,切实解决委托执行案件积压的问题。五是针对逃避执行现象普遍的问题,探索反规避执行的对策,建立和完善规避执行反制机制,进一步凝聚共识,拓宽思路,推动执行难问题的解决。六是进一步强化执行公开,有效利用“全国法院执行案件信息管理系统”公开执行过程、执行措施和执行结果等信息,切实保障当事人的知情权、参与权、监督权,以公开促公正,以公正立公信。七是研究设计更为科学、合理的执行案件统计体系,细化执行实际到位率、执行结案方式等指标,真实反映执行工作的实际情况。八是加强调查研究,对执行工作中的重点环节和方面,以及执行实践中的新情况、新问题,进行系统的梳理,有计划、有步骤地出台司法解释和相关制度,建立健全执行工作长效机制。
