The Government of the People's Republic of China and the Government of the Republic of Hungary (hereinafter referred to as "the Contracting Parties"), 中华人民共和国政府和匈牙利共和国政府(以下简称“缔约方”),希望便利两国人民之间的友好交往,发展两国民用航空方面的相互关系,作为一九四四年十二月七日在芝加哥开放签字的《国际民用航空公约》的参加国,就建立和经营两国领土之间及其以远地区的航班,达成协议如下:

Desiring to facilitate friendly contacts between their two peoples and develop mutual relations between the two countries in the field of civil aviation,
 

Being Parties to the Convention on International Civil Aviation opened for signature at Chicago on December 7.1944,
 第一条定义

Have agreed on the establishment and operation of air services between and beyond their respective territories as follows:
 
除非文中另有需要,本协定及其附件中:

 
(一)“芝加哥公约”,指一九四四年十二月七日在芝加哥开放签字的《国际民用航空公约》,包括根据该公约第九十条所通过的任何附件和根据该公约第九十四条对这些公约的附件所作的任何修改,只要这些附件和修改已经对缔约双方生效或已经双方批准,(二)“航空当局”,中华人民共和国方面指中国民用航空局,和/或者指受权执行该局目前所行使职能的任何个人或机构;匈牙利共和国方面指运输、通讯和水利部,和/或者指受权执行该部目前所行使职能的任何个人或机构,(三)“航班”,指为取酬或出租以航空器从事旅客、行李、货物或邮件公共运输的任何单项或混合定期航班,(四)“国际航班”,指飞经一个以上国家领土上空的航班,(五)“非运输业务性经停”,指目的不在于上下旅客、行李、货物和/或邮件的经停,(六)“空运企业”,指提供或者经营国际航班的任何航空运输企业,(七)“指定空运企业”,指根据本协定第三条指定和受权的任何空运企业,(八)“运价”,指运输旅客、行李和货物所采用的价格和价格条件,包括提供代理和其他附属服务的价格和价格条件,但不包括运输邮件的报酬和条件,(九)“使用者费用”,指因提供机场、航空导航设施和服务而向空运企业收取的费用,(十)“航线表”,指作为本协定附件的航线表或者根据本协定第二十条规定修改过的航线表。
ARTICLE 1 nbsp;   Definitions 

For the purpose of this Agreement and its Annex unless the context otherwise requires:
 第二条授权

(a)the term "Chicago Convention" means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944 and includes any Annex adopted under Article 90 of that Convention and any amendment of the Annexes of the Convention under Article 94 thereof so far as those Annexes and amendments have become effective for or have been ratified by both Parties,
 
一、缔约一方给予缔约另一方以本协定规定的权利,以便其指定空运企业在航线表规定的航线上建立和经营国际航班(以下分别称为“协议航班”和“规定航线”)。

(b)the term "aeronautical authorities" means, in the case of the People's Republic of China, the Civil Aviation Administration of China, and/or any person or body authorized to perform the functions presently exercised by the said Administration, and in the case of the Republic of Hungary, the Ministry of Transport, Communication and Water Management, and/or any person or body authorized to perform the functions presently exercised by the said Ministry,
 
二、在不违反本协定规定的情况下,缔约一方指定空运企业在规定航线上经营协议航班时,享有下列权利:

(c)the term "air service " means any scheduled air service performed by aircraft for the public transport of passengers, baggage, cargo or mail, separately or in combination for remuneration or hire,
 
(一)沿缔约另一方航空当局规定的在其领土上空的航路不降停飞越缔约另一方领土,(二)在缔约另一方领土内作非运输业务性经停,及(三)在规定航线上的缔约另一方领土内的地点经停,以便上下来自或者前往缔约一方领土或第三国的旅客、行李、货物和邮件。

(d)the term "international air service" means an air service which passes through the air space over the territory of more than one State,
 

(e)the term "stop for non-traffic purposes" means a landing for any purpose other than taking on or discharging passengers, baggage, cargo and/or mail,
 第三条空运企业的指定和许可

(f)the term "airline" means any air transport enterprise offering or operating international air services,
 
一、缔约一方有权书面向缔约另一方指定一家空运企业,在规定航线上经营协议航班,并且有权撤销或者更改上述指定。

(g)the term "designated airline" means any airline which has been designated and authorized in accordance with Article 3 of this Agreement,
 
二、缔约一方指定空运企业的主要所有权和有效管理权应属于该缔约方或者其国民。三、缔约一方航空当局可要求缔约另一方指定空运企业向其证明,该指定空运企业有资格履行根据法律和规章所规定的条件,这些法律和规章是该当局在通常情况下,在经营国际航班方面合理地予以实施的。

(h)the term "tariff" means the prices to be paid for the carriage of passengers, baggage and cargo and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary service, but excluding remuneration and conditions for the carriage of mail,
 
四、在不违反本条第二款和第三款规定的情况下,缔约另一方在收到上述指定后,应立即发给该指定空运企业以适当的经营许可,不应无故延误。

(i)the term "user charge" means a charge made to airlines for the provision of airport, air navigation facilities and services,
 
五、空运企业一经指定并获得许可,即可在缔约双方航空当局商定的日期,按照本协定的有关规定开始经营协议航班。

(j)the term "Route Schedule" means the Route Schedule annexed to this Agreement or as amended in accordance with the provisions of Article 20 of this Agreement.
 

 第四条许可的撤销、暂停和附加条件
ARTICLE 2 nbsp;   Grant of Rights 
一、在下列任一情形下,缔约一方有权撤销或者暂停发给缔约另一方指定空运企业的经营许可,或者对该指定空运企业行使本协定第二条规定的权利附加它认为必要的条件:(一)缔约一方对该指定空运企业的主要所有权和有效管理权是否属于缔约另一方或者其国民有疑义,或者(二)该指定空运企业不遵守缔约一方的法律和规章,或者(三)该指定空运企业在其他方面没有按照本协定规定的条件经营。

(1)Each Contracting Party grants to the other Contracting Party the rights specified in this Agreement to enable its designated airline to establish and operate international air services on the route specified in the Route Schedule (hereinafter called "the agreed services" and "the specified route" respectively).
 
二、除非本条第一款所述的撤销、暂停或者附加条件必须立即执行,以防止进一步违反法律和规章,否则这种权利只能在与缔约另一方航空当局协商后方可行使。

(2)Subject to the provisions of this Agreement, the designated airline of each Contracting Party shall enjoy, while operating an agreed service on a specified route, the following rights;
 
此种航空当局间的协商应在收到要求后六十(60)天内开始。

(a)to fly without landing across the territory of the other Contracting Party along the air routes above its territory prescribed by the aeronautical authorities of the other Contracting Party,
 

(b)to make stops for non-traffic purposes in the territory of the other Contracting Party, and
 第五条使用者费用

(c)to make stops at the point on the specified route in the territory of the other Contracting Party for the purpose of taking on board and discharging passengers, baggage, cargo and mail originating in or destined for the first Contracting Party or to or from a third country.
 
缔约各方可以征收或允许被征收因使用其控制下的机场和其他设备而收取的合理费用。此类费用不应高于本国的航空器从事类似国际航班而征收的费用。

 
ARTICLE 3 nbsp;   Airline Designation and Authorization 第六条法律和规章的适用

(1)Each Contracting Party shall have the right to designate in writing to the other Contracting Party one airline to operate the agreed services on the specified route, and to withdraw or alter such designation.
 
一、缔约一方关于从事国际飞行的航空器进出其领土或者在其领土内停留的法律和规章,应适用于缔约另一方指定空运企业进出缔约一方领土或者在该方领土内停留的航空器。二、缔约一方关于旅客、机组、货物或邮件进出其领土或者在其领土内停留的法律和规章,例如关于入境、护照、海关和检疫的规章,应适用于缔约另一方指定空运企业进出缔约一方领土或者在该方领土内停留的航空器所载运的旅客、机组、货物或邮件。

(2)The substantial ownership and effective control of the airline designated by each Contracting Party shall remain vested in such Contracting Party or its nationals.
 

(3)The aeronautical authorities of the other Contracting Party may require the airline designated by the first Contracting Party to satisfy them that it is qualified to fulfil the conditions prescribed under the laws and regulations normally and reasonably applied by them to the operation of international air services by the said authorities.
 第七条简化的控制

(4)On receipt of such designation the other Contracting Party shall, subject to the provisions of paragraphs (2) and (3) of this Article, grant to the airline so designated the appropriate operating authorization without unreasonable delay.
 
对直接过境缔约一方领土的旅客及其行李和货物,如不离开为此目的而设的机场区域,只应实施简化的控制。

(5)When an airline has been so designated and authorized, it may commence operation of the agreed services from the date agreed upon between the aeronautical authorities of the two Contracting Parties in accordance with the relevant provisions of this Agreement.
 
对直接过境的行李或货物,不应征收关税和其他费用。

 
ARTICLE 4 nbsp;   Revocation, Suspension of Authorization and Imposition of Conditions 第八条运力规定

(1)Each Contracting Party shall have the right to revoke or suspend the operating authorization granted to the designated airline of the other Contracting Party or to impose such conditions as it may deem necessary on the exercise by the said designated airline of the rights specified in Article 2 of this Agreement, in any of the following cases;
 
一、缔约双方指定空运企业应享有公平均等的机会在规定航线上经营协议航班。

(a) where it is not satisfied that the substantial ownership and effective control of that airline are vested in the other Contracting Party or its nationals, or
 
二、在经营协议航班方面,缔约一方指定空运企业应考虑到缔约另一方指定空运企业的利益,以免不适当地影响后者在相同航线的全部或部分航段上提供的航班。

(b)where that airline fails to comply with the laws and regulations of the first Contracting Party, or
 
三、缔约双方指定空运企业提供的协议航班应与公众对规定航线上的运输需求保持密切联系,其主要目的应是以合理的载运比率提供足够的运力,以便满足目前和合理地预测到的缔约双方领土之间的旅客、货物和邮件的运输需要。

(b) where that airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement.
 
四、在指定空运企业的缔约一方以外国家领土内规定航线上的地点上下旅客、货物和邮件,应根据运力须与下列各点相联系的总原则予以规定:

(2)Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph (1) of this Article is essential to prevent further infringements of laws and regulations, such right shall be exercised only after consultation with the aeronautical authorities of the other Contracting Party.

(一)来自和前往指定该空运企业的缔约一方领土的运输需要,(二)该协议航班所经地区的运输需要,但应考虑该地区国家的空运企业所建立的其他航班,和(三)联程航班经营的需要。
