| For purposes of conscientiously implementing the spirit of the Opinions of the State Council on Deepening the Circulation System Reform and Accelerating the Development of the Circulation Industry (No. 39 [2012] of the State Council) and the Notice of the General Office of the State Council on Issuing the Scheme for Work Division of Major Departments Engaged in Deepening the Circulation System Reform and Accelerating the Development of the Circulation Industry (No. 69 [2013] of the General Office of the State Council), giving full play to the functions of administrations for industry and commerce, and promoting the accelerated development of the circulation industry, the following opinions are hereby put forward: | | 为认真贯彻落实《国务院关于深化流通体制改革加快流通产业发展的意见》（国发〔2012〕39号）和《国务院办公厅关于印发深化流通体制改革加快流通产业发展重点工作部门分工方案的通知》（国办函〔2013〕 69号）精神，充分发挥工商行政管理职能作用，促进流通产业加快发展，现提出如下意见。 |
| I. Having a clear understanding of the situation and task and enhancing the ideological awareness | | 一、认清形势任务，提高思想认识 |
| As an important part of modern service industry, the circulation industry is an elementary and pioneer industry of the national economy. To accelerate the development of the circulation industry is not only favorable to providing services for production and strengthening its competitiveness at the international market, but also is of great significance in facilitating people's lives, promoting household consumption, boosting the optimization and upgrading of industrial structure, and accelerating the transformation of economic development modes. | | 流通产业是现代服务业的重要组成部分，是国民经济的基础性和先导性产业。加快流通产业发展，不仅有利于服务生产，增强自身在国际市场上的竞争力，而且在方便群众生活、促进居民消费、促进产业结构优化升级、加快转变经济发展方式等方面具有重要意义。 |
| To accelerate the development of the circulation industry, we shall adhere to the combination of giving play to the role of market and improving government functions, that is, giving full play to the elementary role of market in allocating resources and effectively improving government's capabilities of public services, market supervision and administration, and macro-control. As a department of market supervision and administration, and administrative law enforcement, the administration for industry and commerce is closely related to the development of the circulation industry. The CPC Central Committee and the State Council have attached great importance to the development of the circulation industry. The State Council has issued the Opinions on Deepening the Circulation System Reform and Accelerating the Development of the Circulation Industry and the Notice on Issuing the Scheme for Work Division of Major Departments Engaged in Deepening the Circulation System Reform and Accelerating the Development of the Circulation Industry, raised specific requirements for accelerating the development of the circulation industry, and specified the work divisions of major departments. All regions shall conscientiously implement the spirit of the Eighteenth National Congress of the CPC and on the basis of functions of industry and commerce and by regarding deepening the efficacy building as the foothold, give more support to services, strengthen market supervision and administration, and law enforcement, and guarantee that various policies and measures of the State Council for accelerating the development of the circulation industry are implemented. | | 加快流通产业发展，要坚持发挥市场作用与完善政府职能相结合，既充分发挥市场配置资源的基础性作用，又切实提升政府公共服务、市场监管和宏观调控能力。工商部门作为市场监管和行政执法部门，与流通产业发展密切相关。党中央、国务院高度重视流通产业发展工作，国务院下发了《关于深化流通体制改革加快流通产业发展的意见》和《关于印发深化流通体制改革加快流通产业发展重点工作部门分工方案的通知》，对加快流通产业发展提出了具体要求，明确了重点工作部门分工。各地要认真贯彻落实党的十八大精神，立足工商职能，以深化效能建设为抓手，加大服务支持力度，加强市场监管执法，确保国务院加快流通产业发展的各项政策措施落到实处。 |
| II. Strengthening market supervision and administration, and law enforcement and creating a favorable market environment for the sound development of the circulation industry | | 二、加大市场监管执法力度，为流通产业健康发展营造良好的市场环境 |
| (1) Strengthening routine supervision and administration of products that concern the national economy and people's livelihood, or life security of the people in accordance with law. In the course of routine supervision and administration, the circulation of products that concern the national economy and people's livelihood, or life security of the people shall be treated as highlight in the classified supervision and administration of enterprises' credit, inspections shall be strengthened, supervision and administration information shall be recorded and reported in a timely manner, and circulation control of key commodities within jurisdictions shall be improved. In accordance with the coordination and joint operation mechanism of “consistency between powers and responsibilities, division of work and responsibilities, joint efforts in regulation and management, and comprehensive control,” coordination with the relevant departments shall be further strengthened to form joint force in supervision and administration, and law enforcement. | | （一）依法加强对关系国计民生、人民群众生命安全等商品的日常监管。在日常监管中，将关系国计民生、人民群众生命安全等商品的流通作为企业信用分类监管的重点，加大巡查力度，并将监管信息及时记录、反馈，提高辖区内重点商品流通控制力。按照“权责一致、分工负责、齐抓共管、综合治理”的协调联动机制，进一步加强与相关部门的协作配合，形成监管执法合力。 |
| (2) Strengthening supervision and inspection on the quality of commodities in the circulation field. Routine supervision and inspection on the quality of commodities in the circulation field shall be strengthened and business operators shall be urged to conscientiously perform their statutory responsibilities and obligations, effectively control the quality of incoming commodities, and conduct strict management of commodity quality and effective delisting of substandard commodities in a timely manner. For key commodities and business operators, supervision, administration, and monitoring of the quality of commodities in the circulation field shall be strengthened. The building of an information-based network system for commodity quality supervision and administration shall be actively promoted and monitoring information about commodity quality shall be summarized, counted, and analyzed by fully adopting information-based methods so as to constantly make monitoring more specific and effective. | | （二）加大流通领域商品质量监督检查力度。强化流通领域商品质量日常监督检查，督促经营者自觉履行法定责任和义务，把好商品质量进货关，严格商品质量内部管理，对不合格商品及时予以有效退市。针对重点商品、重点经营者，加大流通领域商品质量监管和监测工作力度。积极推进商品质量监管信息化网络体系建设，充分利用信息化手段及时汇总、统计、分析商品质量监测信息，不断提高监测工作的针对性和实效性。 |
(3) Improving the long-term mechanism for fighting against infringements upon intellectual property rights and fighting against production and sales of counterfeit and substandard commodities. Good experience and practice in the work of “double-fights” shall be diligently summarized and the long-term mechanism for fighting against infringements upon intellectual property rights and fighting against production and sales of counterfeit and substandard commodities shall be improved by voluntarily adapting to new situation and task. Such supervision and administration methods as market inspection and special inspection shall be improved, such working rules as reporting of clues to cases of trademarks and counterfeit and substandard commodities, collaboration in case investigation, consultation of complicated and difficult cases, and joint investigation and handling of key cases shall be improved, and timely reporting, rapid response, and joint law enforcement for cases involving infringements upon trademark rights of circulation enterprises and counterfeit and substandard commodities, and emergencies shall be conducted in a timely manner. Experience in the popularization of the system for licensed trademark business and the system for trademark recordation and publicity shall be conscientiously summarized and popularized, such market participants as medium and large-sized commercial enterprises shall be guided in conducting recordation, examination, and review of incoming commodity trademarks, and gradually move forward the gateway of market supervision and administration.
．．．．．． | | （三）完善打击侵犯知识产权和制售假冒伪劣商品违法行为长效机制。认真总结“双打”工作中好的经验做法，主动适应新的形势任务，完善打击侵犯知识产权和制售假冒伪劣商品违法行为长效机制。改进市场巡查、专项检查等监管方式，不断完善商标、假冒伪劣等案件线索通报、案件查处协作、复杂疑难案件会商、重大案件联合查办等工作制度，对涉及侵犯流通企业商标权、假冒伪劣的案件和突发事件，及时通报、快速反应、联合执法。认真总结推广商标授权经营和商标备案公示制度的经验，引导大中型商业企业等市场主体对进场商品商标进行备案、查验、审核，逐步实现市场监管关口前移。
