| For the purposes of giving play to the functions and roles of family trial and promoting the constant scientific development of family trials, the Supreme People's Court decided to choose some courts across the country to conduct the pilot program of the reform of the mode and working mechanism of family trial. The opinions on the pilot program of reform are hereby offered as follows: | | 为发挥家事审判职能作用，推动家事审判工作不断科学发展，最高人民法院决定在全国范围内选择部分法院开展家事审判方式和工作机制改革试点。现就改革试点工作提出如下意见： |

| Through the pilot program of the reform of the mode and working mechanism of family trial, the family trial concept shall be changed, the innovation in the mode and working mechanism of family trial shall be advanced, the development of family trial teams and hardware facilities shall be strengthened, the family procedure rules shall be explored, the exchange of experience and cooperation in family trial between courts from home and abroad shall be conducted and promoted, the specialized development of family trial shall be explored, the stability of marital and family relations shall be maintained, the lawful rights and interests of minors, women and the elderly shall be protected in accordance with the law, the core socialist values shall be advocated, and the sound and harmonious development of social construction shall be promoted. | | 通过家事审判方式和工作机制改革试点，转变家事审判理念，推进家事审判方式和工作机制创新，加强家事审判队伍及硬件设施建设，探索家事诉讼程序制度，开展和推动国内外法院之间家事审判经验交流和合作，探索家事审判专业化发展，维护婚姻家庭关系稳定，依法保护未成年人、妇女和老年人合法权益，弘扬社会主义核心价值观，促进社会建设健康和谐发展。 |

| 1. Adhering to advancement in a lawful and orderly manner. All the measures for the reform of the mode and working mechanism of family trial shall be within the framework of the law, closely integrated with the measures for the reform of such judicial systems as the classification management system of court personnel, the judge quota system and the presiding judge responsibility system and the development of the diversified dispute resolution mechanism, and advanced vigorously, steadily and properly from part regions to the whole country and from easy fields to difficult fields. | | 1．坚持依法有序推进。家事审判方式和工作机制改革的各项措施应当在法律框架内，紧密结合法院人员分类管理制度、法官员额制、主审法官责任制等司法体制改革措施及多元化纠纷解决机制的建设，由点到面、由易到难，积极稳妥推进。 |
| 2. Adhering to starting on a pilot basis. The reform of the mode and working mechanism of family trial not only involves the matter of principle of the judicial system and the judicial proceedings, but also involves some operational matters in judicial practices. Courts joining the pilot program shall, according to the reform direction and principles determined by the Supreme People's Court, make bold explorations and creative innovations to vigorously advance all the work concerning the pilot program of reform. | | 2．坚持先行先试。家事审判方式和工作机制改革既涉及司法制度和诉讼程序的原则性问题，也涉及司法实务中的操作性问题。试点法院要在最高人民法院确定的改革方向和原则下，大胆探索，锐意创新，积极推进改革试点各项工作。 |
| 3. Adhering to the combination of starting from the national conditions of China and absorbing overseas experience. The reform of the mode and working mechanism of family trial shall be based on the national conditions of China, start from the actual and present situation of the socialist judicial system with Chinese characteristics and economic and social development, and learn from the useful experience of other countries and regions to advance the reform of the mode and working mechanism of family trial in China. | | 3．坚持从本国国情出发与吸收域外经验相结合。家事审判方式和工作机制改革要立足我国国情，从中国特色社会主义司法制度和经济社会发展的实际出发，借鉴其他国家和地区的有益经验，推进我国家事审判方式和工作机制改革。 |

| 1. Civilized and progressive marital and family ethics shall be advocated, sound and proactive marital and family relations shall be maintained, core socialist values shall be vigorously developed and practiced, the traditional Chinese family virtues shall be promoted, and public order and good customs shall be protected. | | 1．倡导文明进步的婚姻家庭伦理道德观念，维护健康向上的婚姻家庭关系，积极培育和践行社会主义核心价值观，弘扬中华民族传统家庭美德，维护公序良俗。 |
2. A family-oriented trial concept shall be developed and, in the handling of family property relations, the collectivism helpful to family members living together shall be the value for pursuit. People orientation shall be adhered to, the diagnosis, repair and healing roles of family trial shall be played, and the organic integration of the judicial functions and social functions of family trial shall be realized.
