| In order to facilitate the lawful exercise of rights by the parties to apply for supervision and file a petition, these Provisions are formulated in accordance with the provisions of the Civil Procedure Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China and the Postal Law of the People's Republic of China and in consideration of the actual circumstances of the procuratorial work. | | 为了方便当事人依法行使申请监督和申诉权利，根据《中华人民共和国民事诉讼法》、《中华人民共和国行政诉讼法》、《中华人民共和国邮政法》等规定，结合检察工作实际，制定本规定。 |
| Article 1 A prosecutorial legal document which is able to be served by post as required by law may be delivered by the people's procuratorate to a postal enterprise to be served in the manner of express delivery for procuratorates, except under any of the following circumstances: | | 第一条 法律规定可以邮寄送达的检察法律文书，人民检察院可以交由邮政企业以检察专递方式邮寄送达，但下列情形除外： |
| (1) The person to be served, an agent ad litem of the person to be served, or a receiver designated by the person to be served agrees to go to the people's procuratorate to accept service within a specified time limit. | | （一）受送达人或者其诉讼代理人、受送达人指定的代收人同意在指定的期间内到人民检察院接受送达的； |
| (2) The whereabouts of the person to be served are unknown. | | （二）受送达人下落不明的； |
| (3) Legal documents shall be served otherwise as required by law or agreed upon under an international treaty concluded or acceded to by China. | | （三）法律规定、我国缔结或者参加的国际条约中约定有特别送达方式的。 |
| Article 2 The service of the prosecutorial legal documents in the manner of express delivery for procuratorates shall have equal legal effects as direct service by a people's procuratorate. | | 第二条 以检察专递方式邮寄送达有关检察法律文书的，该送达与人民检察院直接送达具有同等法律效力。 |
Article 3 When applying for supervision or filing a petition with or submitting the arguments to a people's procuratorate, a party shall provide the people's procuratorate with or confirm to the people's procuratorate the party's accurate address and contact information for service and fill out a confirmation letter for the party's contact information.
