The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government; Xinjiang Production and Construction Corps; and relevant ministries and commissions of the CPC Central Committee and state agencies: 各省、自治区、直辖市人民政府,新疆生产建设兵团,中央和国家机关各有关部委:
The National Development and Reform Commission and the Ministry of Commerce followed the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era, conscientiously implemented the decisions and arrangements of the CPC Central Committee and the State Council and, in conjunction with all regions and relevant authorities, comprehensively revised the Market Access Negative List (2018) and developed the Market Access Negative List (2019), which is issued and comes into force with the approval of the CPC Central Committee and the State Council. The relevant requirements are hereby notified as follows: 国家发展改革委、商务部以习近平新时代中国特色社会主义思想为指导,认真落实党中央、国务院决策部署,会同各地区各有关部门对《市场准入负面清单(2018年版)》开展全面修订,形成《市场准入负面清单(2019年版)》,经党中央、国务院批准印发实施。现将有关要求通知如下:
I. Conscientiously and effectively implementing the list. For the matters on the list, all regions and authorities shall continue to optimize management methods, strictly regulate approval, optimize approval processes, improve the approval efficiency, and perform their duties correctly and efficiently. For any industry, field, business, or the like not on the list, various market participants may enter in a lawful and equal manner, and no administrative approval of market access may be separately established in violation of provisions. If the revision or improvement of any relevant law, regulation, or measure decided by the State Council needs to be requested, each region or authority shall make a request according to legal procedures as soon as possible and effectively develop, amend, or repeal the relevant rules and normative documents.   一、认真做好清单落地实施工作。对清单所列事项,各地区各部门要持续优化管理方式,严格规范审批行为,优化审批流程,提高审批效率,正确高效地履行职责。对清单之外的行业、领域、业务等,各类市场主体皆可依法平等进入,不得违规另设市场准入行政审批。需提请修改完善相关法律、法规、国务院决定的措施,各地区各部门要尽快按法定程序办理,并做好相关规章和规范性文件“立改废”工作。
II. Strictly implementing the administrative mode of "a list for the whole country." The unity, seriousness, and authority of the market access negative list system shall be resolutely maintained, so as to ensure that "one list contains anything required to be contained, and there is no another list." Relevant measures prepared as required by the CPC Central Committee and the State Council, involving industry, field, regional or any other aspect, required to be issued by administrative thinking or mode of a negative list, shall be included in the national unified market access negative list. For anything included, all relevant authorities shall effectively supervise and guide local governments' elaboration of measures and ensure the compliance with the administrative requirement for "one list for the whole country." A region or authority shall be prohibited from independently issuing a negative list in the nature of market access.   二、严格落实“全国一张清单”管理模式。坚决维护市场准入负面清单制度的统一性、严肃性和权威性,确保“一单尽列、单外无单”。按照党中央、国务院要求编制的涉及行业性、领域性、区域性等方面,需要用负面清单管理思路或管理模式出台相关措施的,应纳入全国统一的市场准入负面清单。已经纳入的,各有关部门要做好对地方细化措施的监督指导,确保符合“全国一张清单”管理要求。严禁各地区各部门自行发布市场准入性质的负面清单。
III. Accelerating the improvement of the public disclosure mechanism for information on the list. All regions and authorities shall cooperate in effectively improving and publicly disclosing information on the market access negative list, in reliance on the construction of the National Integrated Government Service Platform, further reorganize the management authority, approval processes, and essential elements of measures for the matters on the list, lay a solid foundation for the "clarity and one-website handling" of matters on the list, and continue to enhance the transparency and facilitation of market access.   三、加快完善清单信息公开机制。各地区各部门要配合做好市场准入负面清单的信息完善和公开工作,依托全国一体化政务服务平台建设,进一步梳理清单所列事项措施的管理权限、审批流程、办理要件等,为实现清单事项“一目了然、一网通办”打好基础,不断提升市场准入透明度和便捷性。
IV. Continuing to promote the lowering of market access thresholds. All regions and authorities shall pay close attention to market response, listen to the opinions of market participants and industry associations, among others, through multiple channels, promptly discover and promote the removal of unreasonable restrictions on and implicit barriers to market access in various forms, and strive to create a stable, fair, transparent and predictable business environment. The National Development and Reform Commission and the Ministry of Commerce will closely focus on major national strategies and select some regions to launch a pilot program of further relaxing market access restrictions with a focus on the service sector.   四、持续推动放宽市场准入门槛。各地区各部门要密切关注市场反映,多渠道听取市场主体、行业协会等意见,及时发现并推动破除各种形式的市场准入不合理限制和隐性壁垒,努力营造稳定公平透明可预期的营商环境。国家发展改革委、商务部将紧密围绕国家重大战略,选取部分地区以服务业为重点开展进一步放宽市场准入限制试点。
V. Improving the framework of market access systems. All regions and authorities shall continue to follow and pay attention to the implementation of the list, conscientiously research and resolve discovered problems, and put forward opinions on and recommendations for improving the market access negative list system in a timely manner. All regions and authorities shall further improve the access mechanism, approval mechanism, interim and ex-post regulatory mechanism, social credit system, incentive and disciplinary mechanism, commercial registration system, and the like commensurate with the market access negative list system and systematically integrate and collaboratively and efficiently advance the reform of the market access system.

   五、健全完善市场准入制度体系。各地区各部门要持续跟踪关注清单实施情况,认真研究解决发现的问题,及时提出完善市场准入负面清单制度的意见建议。要进一步健全完善与市场准入负面清单制度相适应的准入机制、审批机制、事中事后监管机制、社会信用体系和激励惩戒机制、商事登记制度等,系统集成、协同高效地推进市场准入制度改革工作。
